	17	+	SYNOPSIS:
	18	+	This bill would provide that a criminal
	19	+	defendant who is an illegal alien who is convicted of a
	20	+	felony offense must receive an enhanced sentence.
	21	+	This bill would also provide that a criminal
	22	+	defendant who is an illegal alien who is convicted of a
	23	+	misdemeanor where the victim was a minor shall be
	24	+	sentenced to a Class C felony.

18	26		TO BE ENTITLED
19	27		AN ACT
20	28		Relating to crimes and offenses; to provide that a
21	29		defendant who is an illegal alien who is convicted of a
22	30		criminal offense must receive an enhanced sentence in certain
23	31		circumstances.
24	32		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
25	33		Section 1. (a) For the purpose of this section "illegal
26	34		alien" means an individual not entitled to lawfully reside or
27	35		work in the United States.
28	36		(b) In all cases when it is shown that a criminal
29	37		defendant, who is an illegal alien, has been convicted of a
30		-	felony where the victim is a minor, he or she must be punished
31		-	as follows:
32		-	(1) On a conviction of a Class D felony, for a Class C
33		-	felony.
34		-	(2) On a conviction of a Class C felony, for a Class B
35		-	felony.
36		-	(3) On a conviction of a Class B felony, for a Class A
37		-	felony.
38		-	(4) On a conviction of a Class A felony, by

	69	+	(1) On a conviction of a Class D felony, for a Class C

	73	+	(3) On a conviction of a Class B felony, for a Class A

68	75		(4) On a conviction of a Class A felony, by
69	76		imprisonment for life or for any term of not more than 99
70	77		years, but not less than 15 years.
71	78		(c) In all cases when it is shown that a criminal
72	79		defendant, who is an illegal alien, has been convicted of a
73	80		misdemeanor offense where the victim is a minor, he or she
74	81		shall be punished for a Class C felony.
75	82		Section 2. This act shall become effective on October
