	17	+	AN ACT
16	18		Relating to Choctaw County; to provide for the
17	19		assessment of an additional fee on documents submitted for
18	20		recording in the Probate Court which are subject to a deed or
19	21		mortgage tax; and providing for the deposit of the funds in
20	22		the Choctaw County Probate Judge Fund for the operation of the
21	23		office of the judge of probate, including technology
22	24		improvements.
23	25		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	26		Section 1. The Judge of Probate of Choctaw County shall
25	27		assess and collect an additional fee of ten dollars ($10) per
26	28		instrument for all documents submitted for recording in
27	29		Probate Court which are subject to a deed or mortgage tax.
28	30		Section 2. The Choctaw County Probate Judge Fund is
29	31		created in the county treasury. The funds generated from the
30	32		additional recording fee levied by this act, and any interest
31	33		earned thereon, shall be deposited into the Choctaw County
32	34		Probate Judge Fund on a monthly basis and shall be used only
33	35		by the judge of probate, in his or her sole discretion, for
34	36		the operation of the office of the judge of probate,
35	37		including, but not limited to, the digitalization of records;
36		-	acquiring, updating, and replacing existing technology; and
37		-	otherwise for the use of the office of the judge of probate
38		-	for improvements of the recordkeeping in the office.
39		-	Section 3. This act shall become effective on June 1,
