2121 SYNOPSIS:
2222 This bill would propose an amendment to the
2323 Constitution of Alabama of 2022, relating to public
2424 K-12 schools, to require local boards of education to
2525 adopt policies requiring each K-12 public school to
2626 broadcast or sanction the performance of the first
2727 stanza of The Star-Spangled Banner at least once per
2828 week during school hours.

3232 Proposing an amendment to the Constitution of Alabama
3333 of 2022, to require local boards of education to adopt
3434 policies requiring each K-12 public school to broadcast or
3535 sanction the performance of the first stanza of The
3636 Star-Spangled Banner at least once per week during school
3737 hours.
3838 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3939 Section 1. The Legislature finds and declares the
4040 following:
4141 (1) During the Battle of Baltimore of the War of 1812,
4242 Francis Scott Key visited the British fleet in the Chesapeake

7272 Francis Scott Key visited the British fleet in the Chesapeake
7373 Bay on September 7, 1814, to secure the release of Dr. William
7474 Beanes, who had been captured after the British burned
7575 Washington, D.C.
7676 (2) The release of Dr. Beanes was secured, but Key and
7777 Beanes were held by the British during the shelling of Fort
7878 McHenry, one of the forts defending Baltimore.
7979 (3) On the morning of September 14, 1814, after the
8080 25-hour British bombardment of Fort McHenry, Key peered
8181 through the clearing smoke to see a 42-foot by 30-foot
8282 American flag flying proudly atop the Fort.
8383 (4) He was so inspired to see the enormous flag still
8484 flying over the Fort that he began penning a song, which he
8585 named The Defence of Fort McHenry, to commemorate the
8686 occasion, and he included a note that it should be sung to the
8787 tune of the popular British melody To Anacreon in Heaven.
8888 (5) In 1916, President Woodrow Wilson ordered that the
8989 anthem, which had been popularly renamed The Star-Spangled
9090 Banner, be played at military and naval occasions.
9191 (6) On March 3, 1931, President Herbert Hoover signed
9292 a resolution of Congress that officially designated The
9393 Star-Spangled Banner as the National Anthem of the United
9494 States.
9595 (7) For over 100 years, The Star-Spangled Banner has
9696 served to inspire generations of patriotic Americans, and it
9797 is imperative that students have exposure to this history and
9898 inspiration.
9999 Section 2. The following amendment to the Constitution

131131 PROPOSED AMENDMENT
132132 (a) Each local board of education shall adopt a policy
133133 requiring each public K-12 school under its jurisdiction to
134134 broadcast The Star-Spangled Banner during school hours, at
135135 least once per week.
136136 (b)(1) A local board of education shall select for
137137 broadcast, pursuant to subsection (a), any recording of the
138138 first stanza of The Star-Spangled Banner that is archived
139139 within the Library of Congress and available on the Library of
140140 Congress website.
141141 (2) A local board of education, alternatively, may
142142 adopt a policy allowing, during school hours, for the
143143 performance of the first stanza of The Star-Spangled Banner
144144 from original sheet music, archived within the Library of
145145 Congress and available on its website, by a school-sanctioned
146146 band program, choral program, vocal group, or vocalist.
147147 Upon ratification of this constitutional amendment, the
148148 Code Commissioner shall number and place this amendment as
149149 appropriate in the constitution omitting this instructional
150150 paragraph and may make the following nonsubstantive revisions:
151151 change capitalization, hierarchy, spelling, and punctuation
152152 for purposes of style and uniformity; correct manifest
153153 grammatical, clerical, and typographical errors; revise
154154 internal or external citations and cross-references; harmonize
155155 language; and translate effective dates.
156156 Section 3. An election upon the proposed amendment
157157 shall be held in accordance with Sections 284 and 285 of the
158158 Constitution of Alabama of 2022, and the election laws of this

189189 state. The appropriate election official shall assign a ballot
190190 number for the proposed constitutional amendment on the
191191 election ballot and shall set forth the following description
192192 of the substance or subject matter of the proposed
193193 constitutional amendment:
194194 "Proposing an amendment to the Constitution of Alabama
195195 of 2022, to require local boards of education to adopt
196196 policies requiring each K-12 public school to broadcast or
197197 sanction the performance of the first stanza of The
198198 Star-Spangled Banner at least once per week during school
199199 hours.
200200 Proposed by Act ____. "
201201 This description shall be followed by the following
202202 language:
203203 "Yes( ) No( )."
204204 Section 4. The proposed amendment shall become valid as
205205 a part of the Constitution of Alabama of 2022, when approved
206206 by a majority of the qualified electors voting thereon.
