1515 SYNOPSIS:
1616 Existing law does not expressly permit employees
1717 to take time off to attend school-related activities.
1818 This bill would establish the Parental Right to
1919 Participate in Schools Act.
2020 This bill would permit employees who are parents
2121 or guardians of school-age children to take up to 48
2222 hours of leave annually from employment to attend
2323 school-related activities.
2424 This bill would permit employers to deny leave
2525 in certain circumstances.
2626 This bill would require employers to post and
2727 maintain notice of this act, and provide a penalty for
2828 noncompliance.
2929 This bill would also require enforcement of the
3030 act by the Alabama Department of Workforce.

6767 implementation; and to provide for enforcement by the Alabama
6868 Department of Workforce.
6969 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7070 Section 1. This act shall be known and may be cited as
7171 the "Parental Right to Participate in Schools Act."
7272 Section 2. (a) For the purposes of this section, the
7373 following terms have the following meanings:
7474 (1) EMPLOYEE. Employee as defined in Section 11-80-16,
7575 Code of Alabama 1975.
7676 (2) EMPLOYER. Any individual, partnership, association,
7777 corporation, or business entity that employs one or more
7878 employees within the state.
7979 (3) PARENT or GUARDIAN. Is any of the following:
8080 a. A biological mother or father of a child.
8181 b. An individual with legal custody of a child.
8282 c. An individual who acts as a guardian of a child.
8383 d. An aunt, uncle, or grandparent of a child.
8484 e. An individual married to or in a domestic
8585 partnership with any individual listed in paragraphs a.
8686 through d.
8787 (4) SCHOOL-RELATED ACTIVITY. A parent-teacher
8888 conference, school-sponsored performance, rehearsal, sporting
8989 event, or any other school function where the child is a
9090 participant.
9191 (b)(1) An employee who is a parent or guardian may take
9292 up to 48 hours of leave within a 12-month period to attend
9393 school-related activities for his or her child.
9494 (2) The leave may be unpaid or substituted with any

124124 (2) The leave may be unpaid or substituted with any
125125 available paid leave, including vacation, personal, family,
126126 compensatory, or leave bank leave, at the discretion of the
127127 employee.
128128 (3) An employee shall provide at least 10 days' advance
129129 written notice of the leave request unless the school-related
130130 activity was not reasonably foreseeable.
131131 (4) An employer may deny leave if granting such leave
132132 would create a substantial disruption to business operations
133133 or make production or service unusually difficult.
134134 (c)(1) Employers shall post and maintain notice of this
135135 act in a conspicuous place within the workplace.
136136 (2) An employer who willfully fails to post the
137137 required notice may be fined up to one hundred dollars ($100)
138138 for each day the notice remains unposted.
139139 (d) The Alabama Department of Workforce shall enforce
140140 the provisions of this section.
141141 (e) Employees may file complaints regarding violations
142142 of this act with the Alabama Department of Workforce.
143143 Section 3. This act shall become effective on October
144144 1, 2025.
