1515 SYNOPSIS:
1616 Under existing law, the Retired Senior Volunteer
1717 Program, administered by the State Board of Medical
1818 Examiners, authorizes retired physicians to provide
1919 volunteer medical care at free medical clinics and
2020 other facilities approved by the board to patients who
2121 are unable to pay for medical care.
2222 To qualify, a retired physician must perform a
2323 minimum of 100 hours of voluntary service annually.
2424 This bill would remove the requirement that a
2525 retired physician perform at least 100 hours of annual
2626 service.

3030 Relating to physicians; to amend Section 34-24-75.1,
3131 Code of Alabama 1975; to remove a requirement that a physician

3434 Board of Medical Examiners.

6666 Section 1. Section 34-24-75.1, Code of Alabama 1975, is
6767 amended to read as follows:
6868 "ยง34-24-75.1
6969 (a)(1) The State Board of Medical Examiners may board,
7070 at its discretion and subject to the rules and regulations
7171 promulgated adopted by the board, may issue a certificate of
7272 qualification in on behalf of physicians meeting the
7373 requirements for participation in the Retired Senior Volunteer
7474 Program (RSVP).
7575 (2) The Retired Senior Volunteer Program is created for
7676 the purpose of permitting doctors of medicine and doctors of
7777 osteopathy who are fully retired from the active practice of
7878 medicine to obtain a limited license without cost which would
7979 permit the provision of outpatient health care services at
8080 established free clinics operated pursuant to the Volunteer
8181 Medical Professional Act, Section 6-5-660, et seq. Physicians
8282 having certificates issued under this section must perform no
8383 fewer than 100 hours of voluntary service annually and must
8484 limit their practice to the confines of an established free
8585 medical clinic, as that term is defined in Section 6-5-662, or
8686 such other nonprofit organizations or facilities located in
8787 Alabama which are approved by the board and which provide
8888 outpatient medical care to individuals unable to pay for it
8989 the care.
9090 (3) Certificates issued under this section and licenses
9191 based thereon shall state on their faces that they the
9292 certificates are issued under the RSVP and are subject to
9393 restrictions.
9494 (4) Any physician in on whose behalf a certificate of

124124 (4) Any physician in on whose behalf a certificate of
125125 qualification is issued under this section shall be subject to
126126 having his or her license suspended or revoked by the Medical
127127 Licensure Commission for the same causes or reasons and in the
128128 same manner as provided by law in the case of other
129129 physicians.
130130 (5) Certificates of qualification issued under this
131131 section shall expire annually .and physiciansPhysicians may
132132 apply to the board for renewal of their certificate, but the
133133 board shall have full discretion to accept or reject the
134134 application for renewal.
135135 (b) A physician is eligible to receive a certificate of
136136 qualification issued under subsection (a) if he or she meets
137137 the following qualifications:
138138 (1) The applicant currently has or has had a full and
139139 unrestricted license to practice medicine in the State of
140140 Alabama or in any other state of the United States or the
141141 District of Columbia, which license is or was at the time of
142142 expiration unrestricted and in good standing with no pending
143143 disciplinary actions or investigations at the time of
144144 expiration.
145145 (2) The applicant certifies, on a form prescribed by
146146 the board, that he or she is fully retired from the active
147147 practice of medicine.
148148 (3) The applicant is in good health and is not
149149 currently undergoing treatment for a physical or mental
150150 condition which would impair the individual's ability to
151151 practice medicine with reasonable skill and safety to
152152 patients.

183183 (4) The applicant certifies, on a form prescribed by
184184 the board, that he or she intends to limit his or her medical
185185 practice to the provision of outpatient services at an
186186 established free medical clinic as that term is defined in
187187 Section 6-5-662 or such other nonprofit organization or
188188 facility that has been approved by the board and that
189189 furnishes outpatient medical care to patients unable to pay
190190 for it the care.
191191 (5) The applicant certifies, on a form prescribed by
192192 the board, that his or her license to practice medicine in any
193193 state or the District of Columbia has never been revoked,
194194 suspended, placed on probation, or otherwise subject to
195195 disciplinary action and that the applicant has not had his or
196196 her hospital medical staff privileges revoked, suspended,
197197 curtailed, limited, or surrendered while under investigation.
198198 (6) The applicant acknowledges, on a form prescribed by
199199 the board, that he or she is subject to the continuing medical
200200 education requirements for physicians as specified in Chapter
201201 14 of the rules and regulations of the State Board of Medical
202202 Examiners.
203203 (7) The applicant furnishes a certification of the
204204 employment arrangements or agreement with the qualified clinic
205205 or nonprofit organization.
206206 (c) A certificate of qualification issued under
207207 subsection (a) shall be issued at no cost to the applicant.
208208 (d) The Medical Licensure Commission and the State
209209 Board of Medical Examiners are each authorized to
