This bill would increase the levy that may be assessed on the sale of a cotton bale. This bill would also make nonsubstantive, technical revisions to update the existing code language to current style. A BILL TO BE ENTITLED AN ACT Relating to agriculture; to amend Section 2-8-199, Code of Alabama 1975, to increase the levy that may be assessed on the sale of cotton bales; and to make nonsubstantive, technical revisions to update the existing code language to current style. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. Section 2-8-199, Code of Alabama 1975, is amended to read as follows: "ยง2-8-199 (a) If in the referendum a majority or more of the cotton producers who are eligible to participate and who actually vote therein, shall vote in the affirmative and in favor of the levying and collection of collecting the assessment proposed in the referendum, then the assessment shall be levied on a per bale basis and collected in the manner hereinafter provided. (b) All cotton producers who produced cotton in the crop year immediately preceding the referendum shall be eligible to may participate in the referendum. Following the referendum and within 30 days thereafter, the certified commission shall canvass, tabulate, and publicly declare and announce the results thereof. (c) The assessment levied upon the sale of cotton shall may not exceed one dollar and thirty cents ($1) ($1.30) per bale. The commission shall determine the assessment amount on an annual basis."
