15+SYNOPSIS:
16+This bill would create the crime of human
17+cloning and provide that a violation is a Class C
18+felony.
19+This bill would also provide that the
20+prohibitions created by this act do not restrict
21+certain scientific research and assisted reproductive
22+treatment, provided that those practices do not involve
23+human cloning.

1726 AN ACT
1827 Relating to human cloning; to create the crime of human
1928 cloning; and to provide criminal penalties.
2029 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2130 Section 1. For the purposes of this act, the following
2231 terms have the following meanings:
2332 (1) EMBRYO. An organism of the species homo sapiens
2433 from the single cell stage to eight weeks of development. This
2534 term includes an embryo that is derived by fertilization,
2635 parthenogenesis, human cloning, or any other means from one or
2736 more human gametes or human diploid cells.
28-(2) FETUS. An organism of the species homo sapien from
29-eight weeks of development until complete expulsion or
30-extraction from a woman's body, removal from an artificial
31-womb, or other similar environment designed to nurture the
32-development of the organism.
33-(3) HUMAN CLONING. a. The process of human asexual
34-reproduction, accomplished by:
35-1. Introducing the genetic material from one or more
36-human somatic cells into a fertilized or unfertilized oocyte
37-whose nuclear material has been removed or inactivated so as

6978 that is genetically virtually identical to an existing or
7079 previously existing human organism;
71-2. Artificially subdividing a human embryo at any time
80+b. Artificially subdividing a human embryo at any time
7281 from the two-cell stage onward resulting in more than one
7382 human organism;
74-3. Introducing pluripotent stem cells from any source
83+c. Introducing pluripotent stem cells from any source
7584 into a human embryo or artificially manufactured human embryo
7685 or trophoblast under conditions where the introduced cells
77-generate all or most of the body tissues of the
78-fully-developed living organism; or
79-4. Genetically modifying human skin cells or organisms
86+generate all or most of the body tissues of the developing
87+organism; or
88+d. Genetically modifying human skin cells or organisms
8089 into viable oocyte or sperm with genetic material from the
8190 same source as the oocyte or sperm used in reproduction to
8291 create an embryo.
83-b. This term does not apply to in vitro fertilization,
84-the administration of fertility-enhancing drugs, or other
85-procedures used to assist a woman in becoming or remaining
86-pregnant, unless performed with specific intent to result in
87-the gestation or birth of a child genetically identical to
88-another embryo, fetus, or human being, living or dead.
8992 (4) OOCYTE. The human female germ cell, the egg.
9093 (5) SOMATIC CELL. A diploid cell, having a complete set
9194 of chromosomes, obtained or derived from a living or deceased
92-human body at any stage of development.
93-Section 2. (a) A person commits the crime of human
94-cloning if the person intentionally does any of the following:
95-(1) Performs or attempts to perform human cloning.

126+Section 2. (a) A person commits the crime of human
127+cloning if the person intentionally does any of the following:
125128 (1) Performs or attempts to perform human cloning.
126129 (2) Participates in an attempt to perform human
127130 cloning.
128131 (3) Ships, transfers, or receives for any purpose an
129132 embryo produced by human cloning.
130133 (4) Ships, transfers, or receives, in whole or in part,
131134 any oocyte, embryo, fetus, or human somatic cell for the
132135 purpose of human cloning.
133136 (b) A violation of this section is a Class C felony.
134-Section 3. This act does not restrict areas of

146+pregnant, provided that the procedure is not specifically
147+intended to result in the gestation or birth of a child who is
148+genetically identical to another embryo, fetus, or human
149+being, living or dead.
140150 Section 4. This act shall become effective on October
141151 1, 2025.
