18	18	Relating to the City of Alabaster; to authorize the
19	19	City Council of the City of Alabaster to establish and
20	20	regulate the operation of entertainment districts as
21	21	designated by ordinance; and to authorize the city council to
22	22	provide penalties for violations.
23	23	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	24	Section 1. This act is adopted pursuant to the
25	25	authority in subdivision (31) of Section 104 of the
26	26	Constitution of Alabama of 2022.
27	27	Section 2. (a) The City Council of the City of
28	28	Alabaster, by ordinance, may provide for the establishment of
29	29	not more than two entertainment districts in the city, as
30	30	those districts are defined in the Alabaster City Code. The
31	31	entertainment districts may contain one or more Alabama
32	32	Alcoholic Beverage Control Board licensees in an area that
33	33	does not exceed one-half mile by one-half mile. The ordinance
34	34	of the city council shall regulate hours of operation of an
35	35	entertainment district, may provide for the revocation of the
36	36	entertainment district designation, and may regulate any other
37	37	aspect of the operation of entertainment districts.

67	67	aspect of the operation of entertainment districts.
68	68	(b) Any retail licensee of the Alabama Alcoholic
69	69	Beverage Control Board licensed to sell alcoholic beverages
70	70	for on-premises consumption located in an entertainment
71	71	district may obtain an entertainment district permit.
72	72	Notwithstanding any other provision of law, any licensee that
73	73	receives an entertainment district permit shall comply with
74	74	all laws and rules governing its license, except that patrons,
75	75	guests, or members of the licensee may exit the licensed
76	76	premises with open containers of alcoholic beverages anywhere
77	77	within the confines of the entertainment district but may not
78	78	enter the premises of another licensee with open containers or
79	79	closed containers of alcoholic beverages acquired elsewhere.
80	80	In addition, the ordinance shall prohibit a person other than
81	81	a retail licensee from possessing or bringing into the
82	82	entertainment district an open or closed container of
83	83	alcoholic beverages acquired outside of the entertainment
84	84	district during the hours of operation of the entertainment
85	85	district.
86	86	(c) The ordinance of the city council shall be enforced
87	87	by the City of Alabaster and shall provide penalties for
88	88	violations of the ordinance as otherwise authorized by law.
89	89	Section 3. This act shall become effective June 1,
90	90	2025.
