17	17		AN ACT
18	18		Relating to Lamar County; to amend Section 45-38-71.01,
19	19		Code of Alabama 1975; to revise the process for personal
20	20		property auctions by the county commission; to remove any
21	21		publication requirement for the disposition of county property
22	22		via online auction; and to make nonsubstantive, technical
23	23		revisions to update existing code to current language style.
24	24		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
25	25		Section 1. Section 45-38-71.01, Code of Alabama 1975,
26	26		is amended to read as follows:
27	27		"§45-38-71.01
28	28		(a) This section shall only apply in Lamar County.
29	29		(b)(1) All contracts for the sale or disposal of real
30	30		property, or tangible personal property , equipment, or other
31	31		items owned by or under the control of the county commission
32	32		shall be let by free and open competitive sealed bids. The
33	33		chair of the county commission shall certify to the
34	34		description and condition of the property, shall give
35	35		jurisdiction in writing for the disposal of the property,
36	36		shall estimate the value of the property, and shall keep the
37	37		certification as a part of the permanent record of the

67	67		certification as a part of the permanent record of the
68	68		commission. Tangible personal property , equipment, or other
69	69		items owned by or under the control of the county commission
70	70		which havehas trade-in value may be offered as a credit
71	71		against the cost of property purchased in accordance with the
72	72		Alabama Competitive Bid Law Article 3 of Chapter 16 of Title
73	73		41.
74	74		(2) Every proposal to make a sale covered by this
75		-	section shall be publicly advertised for four consecutive

77	77		one time in a newspaper of statewide circulation not less than
78	78		seven days in advance of the date fixed for closing the
79	79		receipt of bids. The advertisements shall state a description
80	80		of the property to be sold along with the date, time, and
81	81		place of opening of the sealed bids.
82	82		(c) All bids shall be publicly opened and all bidders
83	83		shall be entitled to be present at the bid opening in person
84	84		or by representative. Any agreement or collusion among bidders
85	85		or prospective bidders or any other person in restraint of
86	86		freedom of competition, by any agreement to bid at a fixed
87	87		price or to refrain from bidding, shall render the bids of the
88	88		bidders void and shall cause such bidders to be disqualified
89	89		from submitting further bids on the sale. Any disclosure prior
90	90		to opening the sealed bids or the terms of a bid shall render
91	91		the proceedings void.
92	92		(d) In lieu of the bidding procedures provided in
93	93		subsections (b) and (c), tangible personal property ,
94	94		equipment, or other items owned by or under the control of the
95	95		county commission may be sold at a public auction , whether at

125	125		county commission may be sold at a public auction , whether at
126	126		a public auction in person or online, by public bidding . once
127	127		a year.The county shall publicly advertise for two
128	128		consecutive weeks in advance the The date, time, and location
129	129		of the auction. shall be publicly advertised for four
130	130		consecutive weeks in advance of the auction. If the auction
131	131		will be online, the county is not required to publicly
132	132		advertise the auction. A list of the items to be auctioned
133	133		shall be available in the offices of the county commission.
134	134		(e) All proceeds from the sale or other disposition of
135	135		the property under this section shall be deposited in the fund
136	136		of the district owning the property or the general fund of the
137	137		county, if the property was owned by the county.
138	138		(f) Anyone who knowingly violates this section shall be
139	139		guilty of a Class B felony and upon conviction shall be fined
140	140		up to fifteen thousand dollars ($15,000) and may be imprisoned
141	141		in the state penitentiary for up to seven years.
142	142		(g)(f) Any taxpayer of the area within the jurisdiction
143	143		of the county and any bona fide unsuccessful bidder on a
144	144		particular contract may bring a civil action in the
145	145		appropriate court to enjoin execution of any contract entered
146	146		into in violation of this section."
147	147		Section 2. This act shall become effective on June 1,
148	148		2025.
