18+This bill would direct the Alabama State Law
19+Enforcement Agency to establish, develop, manage, and
20+maintain the Alabama Criminal Enterprise Database.
21+This bill would also provide for submission to
22+and use of the database.

2026 Relating to crimes and offenses; to amend Section
2127 13A-6-260, Code of Alabama 1975, to further provide for
2228 definitions; and to add Section 13A-6-264 to the Code of
2329 Alabama 1975, to provide for the establishment, development,
2430 management, and maintenance of the Alabama Criminal Enterprise
2531 Database.
2632 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2733 Section 1. Section 13A-6-260, Code of Alabama 1975, is
2834 amended to read as follows:
2935 "§13A-6-260
3036 For the purposes of this article, the following terms
3137 have the following meanings:
3238 (1) ALEA. The Alabama State Law Enforcement Agency.
33-(1)(2) CRIMINAL ENTERPRISE. Any combination,
34-confederation, alliance, network, conspiracy, understanding,
35-or other similar arrangement in law or in fact, including a
36-streetgang as defined in Section 13A-6-26, of three or more
37-persons, through its membership or through the agency of any
38-member, that engages in a course or pattern of criminal
39-activity.

68+(1) ALEA. The Alabama State Law Enforcement Agency.
69+(1)(2) CRIMINAL ENTERPRISE. Any combination,
70+confederation, alliance, network, conspiracy, understanding,
71+or other similar arrangement in law or in fact, including a
72+streetgang as defined in Section 13A-6-26, of three or more
73+persons, through its membership or through the agency of any
74+member, that engages in a course or pattern of criminal
6975 activity.
7076 (2)(3) CRIMINAL ENTERPRISE MEMBER. a. An individual who
7177 meets three or more of the following at the time of the
7278 planning or commission of the underlying offense:
7379 a.1. Admits to criminal enterprise membership.
7480 b.2. Is voluntarily identified as a criminal enterprise
7581 member by a parent or guardian.
7682 c.3. Is identified as a criminal enterprise member by a
7783 reliable informant.
7884 d.4. Adopts the style of dress of a criminal
7985 enterprise.
8086 e.5. Adopts the use of a hand sign identified as used
8187 by a criminal enterprise.
8288 f.6. Has a tattoo identified as used by a criminal
8389 enterprise.
8490 g.7. Associates with one or more known criminal
8591 enterprise members.
8692 h.8. Is identified as a criminal enterprise member by
8793 physical evidence.
8894 i.9. Has been observed in the company of one or more
8995 known criminal enterprise members four or more times.
9096 Observation in a custodial setting requires a willful
91-association. This paragraph may be used to identify criminal
92-enterprise members who recruit and organize in jails, prisons,
93-and or other detention settings.
94-j.10. Has authored any communication indicating
95-responsibility for the commission of any crime by a criminal
96-enterprise.
97-b. Where a single act or factual transaction satisfied

128+enterprise members who recruit and organize in jails, prisons,
129+and or other detention settings.
130+j.10. Has authored any communication indicating
131+responsibility for the commission of any crime by a criminal
132+enterprise.
127133 b. Where a single act or factual transaction satisfied
128134 the requirements of more than one of the criteria in this
129135 subdivisionparagraph a., each of those criteria has been
130136 satisfied for the purposes of this subdivisiondefinition.
131137 (4) CRIMINAL JUSTICE AGENCY. Any federal law
132138 enforcement agency, prosecuting agency, or corrections agency,
133139 or any state, county, or municipal law enforcement agency,
134140 prosecuting agency, or corrections agency in this state.
135141 (5) DATABASE. The Alabama Criminal Enterprise Database.
136-(6) DATABASE INFORMATION. Either of the following:
137-a. Any contents of the database.
138-b. Any records, including electronically stored
139-information, that are generated or transmitted to ALEA's
140-possession, custody, or control due to a criminal justice
142+(6) DATABASE INFORMATION. Any contents of the database
143+or any records that are generated by a criminal justice
141144 agency's submission of information for inclusion in the
142145 database.
143146 (3)(7) DESTRUCTIVE DEVICE. The same meaning as in
144147 Section 13A-10-190.
145148 (4)(8) FIREARM. Any of the following:
146149 a. Any weapon which will, is designed to, or may be
147150 readily be converted to expel a projectile by the action of an
148151 explosive or the frame or receiver of any such weapon.
149152 b. A firearm silencer.
150153 c. A destructive device.
151154 (5)(9) FIREARMS SILENCER. Any device for silencing,
152-muffling, or diminishing the report of a portable firearm,
153-including any combination of parts, designed or redesigned,
154-and intended for use in assembling or fabricating a firearm
155-silencer, and any part intended only for use in such assembly

184+(5)(9) FIREARMS SILENCER. Any device for silencing,
185+muffling, or diminishing the report of a portable firearm,
186+including any combination of parts, designed or redesigned,
187+and intended for use in assembling or fabricating a firearm
185188 silencer, and any part intended only for use in such assembly
186189 or fabrication.
187190 (6)(10) MACHINE GUN. Any weapon that shoots, is
188191 designed to shoot, or can be readily restored to shoot
189192 automatically more than one shot, without manual reloading, by
190193 a single function of the trigger. The term shall also include
191194 the frame receiver of any such weapon, any part designed and
192195 intended solely and exclusively, or combination of parts
193196 designed and intended, for use in converting a weapon into a
194197 machine gun, and any combination of parts from which a machine
195198 gun can be assembled if such parts are in the possession or
196199 under the control of a person.
197200 (11) SECRETARY. The Secretary of ALEA.
198201 (7)(12) SHORT-BARRELED RIFLE. The same meaning as in
199202 Section 13A-11-62.
200203 (8)(13) SHORT-BARRELED SHOTGUN. The same meaning as in
201204 Section 13A-11-62."
202205 Section 2. Section 13A-6-264 is added to the Code of
203206 Alabama 1975, to read as follows:
204207 §13A-6-264
205208 (a) Subject to the availability of funding, ALEA shall
206209 establish a statewide inter-jurisdictional criminal
207210 intelligence system known as the Alabama Criminal Enterprise
208211 Database.
209212 (b) ALEA shall establish, develop, manage, and maintain
210-the database in accordance with the Criminal Intelligence
211-Systems Operating Policies adopted by the United States
212-Department of Justice and codified in 28 C.F.R. Part 23.
213-(c) Any criminal justice agency may submit information

242+(b) ALEA shall establish, develop, manage, and maintain
243+the database in accordance with the Criminal Intelligence
244+Systems Operating Policies adopted by the United States
245+Department of Justice and codified in 28 C.F.R. Part 23.
243246 (c) Any criminal justice agency may submit information
244247 for inclusion in the database.
245248 (d) To the extent permitted under subsection (b), the
246249 database may contain any information about a person reasonably
247250 suspected of criminal conduct or activity that meets both of
248251 the following criteria:
249252 (1) The information is relevant to the person's
250253 suspected criminal conduct or activity.
251254 (2) The information is relevant to identifying an
252255 individual as a criminal enterprise member or identifying a
253256 criminal enterprise.
254257 (e) Subject to rules established by the secretary, any
255258 criminal justice agency may access the database for legitimate
256259 law enforcement or criminal justice purposes.
257-(f) ALEA may not permit any person or entity to access
258-database information in its possession, custody, or control
259-unless one of the following conditions applies:
260-(1) The access is made by personnel of a criminal
261-justice agency pursuant to subsection (e).
262-(2) The access is necessary for ALEA to establish,
263-develop, manage, or maintain the database.
264-(3) The access is necessary for ALEA to comply with a
265-court order, discovery request, or subpoena for the production
266-of database information as authorized in subsection (h).
267-(4) The access is permitted under subsection (b).
260+(f) ALEA shall permit an individual or a criminal
261+justice agency to access the database for any of the following
262+reasons:
263+(1) As authorized pursuant to subsection (e).
264+(2) As necessary to establish, develop, manage, or
265+maintain the database.
266+(3) As necessary to comply with a person's rights under
267+the Constitution of the United States or the Constitution of
268+Alabama of 2022.
269+(4) As otherwise permitted under subsection (b).
268270 (g) Database information shall be deemed confidential
269-and shall not be subject to public disclosure under Article 3
270-of Chapter 12 of Title 36, Code of Alabama 1975.
271-(h) In any criminal, civil, or administrative

300+(g) Database information shall be deemed confidential
301+and shall not be subject to public disclosure under Article 3
302+of Chapter 12 of Title 36.
301303 (h) In any criminal, civil, or administrative
302304 proceeding, database information shall not be used as evidence
303-or be subject to discovery by subpoena or otherwise, except as
304-required by subsection (b), the Constitution of Alabama of
305-2022, the Constitution of the United States, or as necessary
306-for a criminal justice agency to pursue a legitimate law
307-enforcement or criminal justice purpose.
308-(i) Nothing in this section shall affect the
309-disclosure, discovery, or admissibility of information that a
310-criminal justice agency has in its possession, custody, or
311-control by any means other than the agency's access to the
312-database or submission of information to the database.
313-(j)(1) The secretary shall adopt rules establishing a
305+and shall not be subject to discovery by subpoena or
306+otherwise, unless the party using or seeking the information
307+is permitted to access the information pursuant to
308+subdivisions (f)(1), (f)(3), or (f)(4).
309+(i)(1) The secretary shall adopt rules establishing a
314310 uniform digital process for criminal justice agencies to
315311 submit information for inclusion in the database.
316312 (2) The secretary shall adopt rules regarding the use
317313 of database information and may establish and impose civil
318314 penalties and other sanctions for the violation of such rules.
319315 (3) The secretary may adopt rules that otherwise
320316 promote the effective establishment, development, management,
321317 maintenance, or use of the database in compliance with federal
322318 standards.
323319 Section 3. This act shall become effective on June 1,
324320 2025.
