1515 SYNOPSIS:
1616 This bill would establish an affirmative defense
1717 against a civil action for damages for personal injury,
1818 wrongful death, or property damage sustained while
1919 obstructing traffic on a street, highway, bridge, or
2020 road under certain conditions.

2424 Relating to civil practice; to establish an affirmative
2525 defense relating to the damages incurred while obstructing
2626 traffic on a street, highway, bridge, or road under certain
2727 conditions; and to further provide for the procedure of such
2828 actions.
2929 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3030 Section 1. (a) In a civil action for damages for
3131 personal injury, wrongful death, or property damage, it is an
3232 affirmative defense that the action arose from an injury or
3333 damage sustained by an individual who willfully obstructed the
3434 free, convenient, and normal use of any public street,
3535 highway, bridge, or road by doing any of the following:
3636 (1) Impeding, hindering, stifling, or restraining

6666 (1) Impeding, hindering, stifling, or restraining
6767 traffic or passage on the street, highway, bridge, or road.
6868 (2) Standing on or remaining in the street, highway,
6969 bridge, or road.
7070 (3) Endangering the safe movement of vehicles or
7171 pedestrians traveling on the street, highway, bridge, or road.
7272 (b) In a civil action in which a defendant raises an
7373 affirmative defense under this section, the court, on motion
7474 by the defendant, shall stay the action during the pendency of
7575 any criminal action the factual basis of which forms the
7676 factual basis for the defense.
7777 Section 2. This act shall become effective on October
7878 1, 2025.
