15	15	SYNOPSIS:
16	16	This bill would establish an affirmative defense
17	17	against a civil action for damages for personal injury,
18	18	wrongful death, or property damage sustained while
19	19	obstructing traffic on a street, highway, bridge, or
20	20	road under certain conditions.
21	21	A BILL
22	22	TO BE ENTITLED
23	23	AN ACT
24	24	Relating to civil practice; to establish an affirmative
25	25	defense relating to the damages incurred while obstructing
26	26	traffic on a street, highway, bridge, or road under certain
27	27	conditions; and to further provide for the procedure of such
28	28	actions.
29	29	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
30	30	Section 1. (a) In a civil action for damages for
31	31	personal injury, wrongful death, or property damage, it is an
32	32	affirmative defense that the action arose from an injury or
33	33	damage sustained by an individual who willfully obstructed the
34	34	free, convenient, and normal use of any public street,
35	35	highway, bridge, or road by doing any of the following:
36	36	(1) Impeding, hindering, stifling, or restraining

66	66	(1) Impeding, hindering, stifling, or restraining
67	67	traffic or passage on the street, highway, bridge, or road.
68	68	(2) Standing on or remaining in the street, highway,
69	69	bridge, or road.
70	70	(3) Endangering the safe movement of vehicles or
71	71	pedestrians traveling on the street, highway, bridge, or road.
72	72	(b) In a civil action in which a defendant raises an
73	73	affirmative defense under this section, the court, on motion
74	74	by the defendant, shall stay the action during the pendency of
75	75	any criminal action the factual basis of which forms the
76	76	factual basis for the defense.
77	77	Section 2. This act shall become effective on October
78	78	1, 2025.
