---|
16 | 16 | | This bill would require the Attorney General to |

17 | 17 | | establish, maintain, and publish the Police Abuse |
---|
18 | 18 | | Registry. The purpose of the registry is to publish the |
---|
19 | 19 | | names and related information of individuals who have |
---|
20 | 20 | | been convicted of offenses against law enforcement |
---|
21 | 21 | | officers. |
---|
22 | 22 | | This bill would allow an individual registered |
---|
23 | 23 | | on the Policy Abuse Registry to have his or her name |
---|
24 | 24 | | removed from the registry by paying a fee to be |
---|
25 | 25 | | deposited in the Law Enforcement Injury Fund. |
---|
26 | 26 | | This bill would provide for the use of |
---|
27 | 27 | | information included in the registry and would provide |
---|
28 | 28 | | penalties for misuse of the information. |

72 | 72 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
73 | 73 | | Section 1. This act shall be known as the Back the Blue |
---|
74 | 74 | | Act. |
---|
75 | 75 | | Section 2. For the purposes of this act, the following |
---|
76 | 76 | | terms have the following meanings: |
---|
77 | 77 | | (1) CLEMENCY. The reduction or mitigation of a criminal |
---|
78 | 78 | | sentence or other repercussions of a criminal conviction, |
---|
79 | 79 | | including, but not limited to, pardons, commutations, or |
---|
80 | 80 | | reprieves. |
---|
81 | 81 | | (2) FUND. The Law Enforcement Injury Fund established |
---|
82 | 82 | | pursuant to this act. |
---|
83 | 83 | | (3) QUALIFYING OFFENSE. Any offense involving the use |
---|
84 | 84 | | or threatened use of force against an individual known to be |
---|
85 | 85 | | or identified as a law enforcement officer. |
---|
86 | 86 | | (4) REGISTRY. The Police Abuse Registry maintained by |
---|
87 | 87 | | the Attorney General pursuant to this act. |
---|
88 | 88 | | Section 3. (a) The Attorney General shall establish and |
---|
89 | 89 | | maintain the Policy Abuse Registry. The purpose of the |
---|
90 | 90 | | registry is to publish the names and related information of |
---|
91 | 91 | | individuals who have been convicted of offenses against law |
---|
92 | 92 | | enforcement officers. |
---|

125 | 125 | | (1) The individual's full name and any known aliases. |
---|
126 | 126 | | (2) The individual's date of birth. |
---|
127 | 127 | | (3) Each of the individual's convictions for a |
---|
128 | 128 | | qualifying offense. |
---|
129 | 129 | | (4) The date of the offense leading to each of the |
---|
130 | 130 | | individual's convictions for a qualifying offense. |
---|
131 | 131 | | (5) The date of each of the individual's convictions |
---|
132 | 132 | | for a qualifying offense. |
---|
133 | 133 | | (6) The date of any clemency granted for any qualifying |
---|
134 | 134 | | offense. |
---|
135 | 135 | | (7) The individual's last known address. |
---|
136 | 136 | | Section 4. (a) The Attorney General, within 30 days of |
---|
137 | 137 | | receipt of applicable information, shall enter any individual |
---|
138 | 138 | | convicted of a qualifying offense into the registry. |
---|
139 | 139 | | (b) Clemency from the Governor or the President of the |
---|
140 | 140 | | United States shall not abrogate the requirements of |
---|
141 | 141 | | subsection (a). |
---|
142 | 142 | | Section 5. (a) An individual included in the registry |
---|
143 | 143 | | may request removal from the registry through the removal |
---|
144 | 144 | | process established by the Attorney General pursuant to |
---|
145 | 145 | | subsection (b). |
---|
146 | 146 | | (b) The Attorney General, before January 1, 2026, shall |
---|
147 | 147 | | establish a procedure for individuals to request removal from |
---|
148 | 148 | | the registry. The procedure shall include the requirement that |
---|
149 | 149 | | an individual must pay five thousand dollars ($5,000) for each |
---|
150 | 150 | | conviction for a qualifying offense that the individual is |
---|
151 | 151 | | seeking to have removed from the registry. |

191 | 191 | | (1) Background checks for employment or certification. |

192 | 192 | | (2) Assisting investigations related to law enforcement |
---|

194 | 194 | | (3) Monitoring individuals residing in the agency's |
---|
195 | 195 | | jurisdiction. |
---|
196 | 196 | | (b) Unauthorized use or disclosure of registry |
---|
197 | 197 | | information is a Class A misdemeanor. |
---|
198 | 198 | | Section 7. (a) The Attorney General, within 30 days of |
---|
199 | 199 | | adding an individual to the registry, shall notify each local |
---|
200 | 200 | | law enforcement agency with jurisdiction over the individual's |
---|
201 | 201 | | last known address. |
---|
202 | 202 | | (b) Each notification made pursuant to subsection (a) |

203 | 203 | | shall include all information included in the individual's |
---|

205 | 205 | | Section 8. (a) The Law Enforcement Injury Fund is |

245 | 245 | | Attorney General, shall be used exclusively for financial |

246 | 246 | | assistance for law enforcement officers injured in the line of |
---|
247 | 247 | | duty or to support rehabilitation or medical costs for law |
---|
248 | 248 | | enforcement officers injured in the line of duty. |
---|
249 | 249 | | (d) The Attorney General, before the fifteenth |
---|
250 | 250 | | legislative day of each regular session of the Legislature, |
---|
251 | 251 | | shall submit a report to the Legislature detailing the |
---|
252 | 252 | | disbursements and uses of monies from the fund in the previous |
---|
253 | 253 | | calendar year. |
---|
254 | 254 | | Section 9. An individual harmed by a violation of |
---|
255 | 255 | | Section 6 may pursue a civil action against the party that |
---|
256 | 256 | | committed the violation. |
---|
257 | 257 | | Section 10. The Attorney General shall implement |
---|
258 | 258 | | safeguards to assure the confidentiality and security of the |
---|
259 | 259 | | registry. |
---|
260 | 260 | | Section 11. This act shall become effective on October |
---|
