1515 SYNOPSIS:
1616 This bill would require the Attorney General to
1717 establish, maintain, and publish the Police Abuse
1818 Registry. The purpose of the registry is to publish the
1919 names and related information of individuals who have
2020 been convicted of offenses against law enforcement
2121 officers.
2222 This bill would allow an individual registered
2323 on the Policy Abuse Registry to have his or her name
2424 removed from the registry by paying a fee to be
2525 deposited in the Law Enforcement Injury Fund.
2626 This bill would provide for the use of
2727 information included in the registry and would provide
2828 penalties for misuse of the information.
2929 This bill would establish the Law Enforcement
3030 Injury Fund and provide for the use of monies in the
3131 fund.
3232 This bill would also authorize civil actions
3333 related to misuse of information from the registry.

6666 Relating to law enforcement; to provide for the
6767 creation of the Police Abuse Registry; to provide for the
6868 inclusion and use of information on the registry; to provide
6969 for the creation of the Law Enforcement Injury Fund and the
7070 use of monies in the fund; to provide penalties for
7171 violations; and to authorize civil actions.
7272 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7373 Section 1. This act shall be known as the Back the Blue
7474 Act.
7575 Section 2. For the purposes of this act, the following
7676 terms have the following meanings:
7777 (1) CLEMENCY. The reduction or mitigation of a criminal
7878 sentence or other repercussions of a criminal conviction,
7979 including, but not limited to, pardons, commutations, or
8080 reprieves.
8181 (2) FUND. The Law Enforcement Injury Fund established
8282 pursuant to this act.
8383 (3) QUALIFYING OFFENSE. Any offense involving the use
8484 or threatened use of force against an individual known to be
8585 or identified as a law enforcement officer.
8686 (4) REGISTRY. The Police Abuse Registry maintained by
8787 the Attorney General pursuant to this act.
8888 Section 3. (a) The Attorney General shall establish and
8989 maintain the Policy Abuse Registry. The purpose of the
9090 registry is to publish the names and related information of
9191 individuals who have been convicted of offenses against law
9292 enforcement officers.
9393 (b) An entry created or maintained pursuant to Section

123123 (b) An entry created or maintained pursuant to Section
124124 4 shall include all of the following information:
125125 (1) The individual's full name and any known aliases.
126126 (2) The individual's date of birth.
127127 (3) Each of the individual's convictions for a
128128 qualifying offense.
129129 (4) The date of the offense leading to each of the
130130 individual's convictions for a qualifying offense.
131131 (5) The date of each of the individual's convictions
132132 for a qualifying offense.
133133 (6) The date of any clemency granted for any qualifying
134134 offense.
135135 (7) The individual's last known address.
136136 Section 4. (a) The Attorney General, within 30 days of
137137 receipt of applicable information, shall enter any individual
138138 convicted of a qualifying offense into the registry.
139139 (b) Clemency from the Governor or the President of the
140140 United States shall not abrogate the requirements of
141141 subsection (a).
142142 Section 5. (a) An individual included in the registry
143143 may request removal from the registry through the removal
144144 process established by the Attorney General pursuant to
145145 subsection (b).
146146 (b) The Attorney General, before January 1, 2026, shall
147147 establish a procedure for individuals to request removal from
148148 the registry. The procedure shall include the requirement that
149149 an individual must pay five thousand dollars ($5,000) for each
150150 conviction for a qualifying offense that the individual is
151151 seeking to have removed from the registry.

182182 (c) All monies collected pursuant to subsection (b)
183183 shall be deposited in the fund.
184184 (d) The Attorney General, within 30 days of an
185185 individual's complete and satisfactory compliance with the
186186 removal process, shall remove the individual's information
187187 from the registry.
188188 Section 6. (a) The Attorney General shall only grant
189189 access to the registry to law enforcement agencies for any of
190190 the following purposes:
191191 (1) Background checks for employment or certification.
192192 (2) Assisting investigations related to law enforcement
193193 safety.
194194 (3) Monitoring individuals residing in the agency's
195195 jurisdiction.
196196 (b) Unauthorized use or disclosure of registry
197197 information is a Class A misdemeanor.
198198 Section 7. (a) The Attorney General, within 30 days of
199199 adding an individual to the registry, shall notify each local
200200 law enforcement agency with jurisdiction over the individual's
201201 last known address.
202202 (b) Each notification made pursuant to subsection (a)
203203 shall include all information included in the individual's
204204 registry entry.
205205 Section 8. (a) The Law Enforcement Injury Fund is
206206 established in the State Treasury and shall be maintained by
207207 the Attorney General.
208208 (b) Monies collected pursuant to this act shall be
209209 deposited to the State Treasury to the credit of the Law

239239 deposited to the State Treasury to the credit of the Law
240240 Enforcement Injury Fund of the Attorney General. Amounts
241241 deposited into the fund shall be budgeted and allotted in
242242 accordance with Sections 41-4-80 through 41-4-96 and Sections
243243 41-19-1 through 41-19-12, Code of Alabama 1975.
244244 (c) Monies in the fund, at the discretion of the
245245 Attorney General, shall be used exclusively for financial
246246 assistance for law enforcement officers injured in the line of
247247 duty or to support rehabilitation or medical costs for law
248248 enforcement officers injured in the line of duty.
249249 (d) The Attorney General, before the fifteenth
250250 legislative day of each regular session of the Legislature,
251251 shall submit a report to the Legislature detailing the
252252 disbursements and uses of monies from the fund in the previous
253253 calendar year.
254254 Section 9. An individual harmed by a violation of
255255 Section 6 may pursue a civil action against the party that
256256 committed the violation.
257257 Section 10. The Attorney General shall implement
258258 safeguards to assure the confidentiality and security of the
259259 registry.
260260 Section 11. This act shall become effective on October
261261 1, 2025.
