15	15	SYNOPSIS:
16	16	Under existing law, the court is required to
17	17	suspend the driver license of a person convicted of
18	18	eluding or attempting to elude a law enforcement
19	19	officer.
20	20	This bill would provide that a court must
21	21	sentence a person convicted for eluding or attempting
22	22	to elude a law enforcement officer to a minimum of 60
23	23	days confinement.
24	24	This bill would also provide that a person
25	25	arrested for eluding or attempting to elude a law
26	26	enforcement officer shall not be released from jail
27	27	under bond or otherwise for at least 48 hours.

30	30	AN ACT
31	31	Relating to crimes and offenses; to amend Section
32	32	13A-10-52, Code of Alabama 1975; to further provide for the
33	33	penalties for eluding or attempting to elude a law enforcement
34	34	officer.
35	35	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
36	36	Section 1. Section 13A-10-52, Code of Alabama 1975, is

66	66	Section 1. Section 13A-10-52, Code of Alabama 1975, is
67	67	amended to read as follows:
68	68	"§13A-10-52
69	69	(a) It shall be unlawful for a person to intentionally
70	70	flee by any means from anyone the person knows to be a law
71	71	enforcement officer if the person knows the officer is
72	72	attempting to arrest the person.
73	73	(b) It shall be unlawful for a person while operating a
74	74	motor vehicle on a street, road, alley, or highway in this
75	75	state, to intentionally flee or attempt to elude a law
76	76	enforcement officer after having received a signal from the
77	77	officer to bring the vehicle to a stop.
78	78	(c)(1) A violation of subsection (a) or (b) is a Class
79	79	A misdemeanor.
80	80	(2) A violation of subsection (a) or (b) is a Class C
81	81	felony if any of the following occur:
82	82	a. The flight or attempt to elude causes the offender
83	83	to strike or collide with another vehicle or pedestrian.
84	84	b. The flight or attempt to elude causes physical
85	85	injury to any other person.
86	86	c. The flight or attempt to elude results in the
87	87	offender crossing the lines of this state into a neighboring
88	88	state.
89	89	(3) A violation of subsection (a) or (b) is a Class B
90	90	felony if either of the following occur:
91	91	a. The flight or attempt to elude causes serious
92	92	physical injury or death to any other person.
93	93	b. During the flight or attempt to elude , the person
94	94	exceeds 20 miles per hour over the legal maximum speed limit.

124	124	exceeds 20 miles per hour over the legal maximum speed limit.
125	125	(d) Upon conviction of subsection (a) or (b), the court
126	126	shall do both of the following:
127	127	(1) Sentence the defendant to a minimum of 60 days
128	128	confinement.
129	129	(2) order Order the suspension of the driver license of
130	130	the defendant for a period of not less than six months nor
131	131	more than two years.
132	132	(e) It is not a violation of this section for an
133	133	individual to continue traveling at or below the speed limit,
134	134	with or without the vehicle's flashers turned on, with the
135	135	intent of stopping the vehicle at the nearest safe place."
136	136	Section 2. An individual charged with a violation of
137	137	Section 13A-10-52, Code of Alabama 1975, shall be subject to a
138	138	48-hour temporary holding period from the time of arrest. The
139	139	individual shall be held in custody and any bond, appearance
140	140	bond, secured appearance bond, or personal recognizance order
141	141	shall not be enforced nor executed, and the individual shall
142	142	not be released on bail or otherwise, until the passage of the
143	143	48-hour temporary holding period from the time of the arrest
144	144	has been completed.
145	145	Section 3. This act shall become effective on October
146	146	1, 2025.
