1515 SYNOPSIS:
1616 Under existing law, the court is required to
1717 suspend the driver license of a person convicted of
1818 eluding or attempting to elude a law enforcement
1919 officer.
2020 This bill would provide that a court must
2121 sentence a person convicted for eluding or attempting
2222 to elude a law enforcement officer to a minimum of 60
2323 days confinement.
2424 This bill would also provide that a person
2525 arrested for eluding or attempting to elude a law
2626 enforcement officer shall not be released from jail
2727 under bond or otherwise for at least 48 hours.

3030 AN ACT
3131 Relating to crimes and offenses; to amend Section
3232 13A-10-52, Code of Alabama 1975; to further provide for the
3333 penalties for eluding or attempting to elude a law enforcement
3434 officer.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

6666 Section 1. Section 13A-10-52, Code of Alabama 1975, is
6767 amended to read as follows:
6868 "ยง13A-10-52
6969 (a) It shall be unlawful for a person to intentionally
7070 flee by any means from anyone the person knows to be a law
7171 enforcement officer if the person knows the officer is
7272 attempting to arrest the person.
7373 (b) It shall be unlawful for a person while operating a
7474 motor vehicle on a street, road, alley, or highway in this
7575 state, to intentionally flee or attempt to elude a law
7676 enforcement officer after having received a signal from the
7777 officer to bring the vehicle to a stop.
7878 (c)(1) A violation of subsection (a) or (b) is a Class
7979 A misdemeanor.
8080 (2) A violation of subsection (a) or (b) is a Class C
8181 felony if any of the following occur:
8282 a. The flight or attempt to elude causes the offender
8383 to strike or collide with another vehicle or pedestrian.
8484 b. The flight or attempt to elude causes physical
8585 injury to any other person.
8686 c. The flight or attempt to elude results in the
8787 offender crossing the lines of this state into a neighboring
8888 state.
8989 (3) A violation of subsection (a) or (b) is a Class B
9090 felony if either of the following occur:
9191 a. The flight or attempt to elude causes serious
9292 physical injury or death to any other person.
9393 b. During the flight or attempt to elude , the person
9494 exceeds 20 miles per hour over the legal maximum speed limit.

124124 exceeds 20 miles per hour over the legal maximum speed limit.
125125 (d) Upon conviction of subsection (a) or (b), the court
126126 shall do both of the following:
127127 (1) Sentence the defendant to a minimum of 60 days
128128 confinement.
129129 (2) order Order the suspension of the driver license of
130130 the defendant for a period of not less than six months nor
131131 more than two years.
132132 (e) It is not a violation of this section for an
133133 individual to continue traveling at or below the speed limit,
134134 with or without the vehicle's flashers turned on, with the
135135 intent of stopping the vehicle at the nearest safe place."
136136 Section 2. An individual charged with a violation of
137137 Section 13A-10-52, Code of Alabama 1975, shall be subject to a
138138 48-hour temporary holding period from the time of arrest. The
139139 individual shall be held in custody and any bond, appearance
140140 bond, secured appearance bond, or personal recognizance order
141141 shall not be enforced nor executed, and the individual shall
142142 not be released on bail or otherwise, until the passage of the
143143 48-hour temporary holding period from the time of the arrest
144144 has been completed.
145145 Section 3. This act shall become effective on October
146146 1, 2025.
