17+AN ACT
1618 Relating to Monroe County; to provide for the
1719 qualifications of the sheriff; and to require completion of
1820 continuing education.
1921 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2022 Section 1. This act shall only apply in Monroe County.
2123 Section 2. On or after June 1, 2025, an individual
2224 qualifying for election to the office of sheriff in the county
2325 or any individual appointed to serve as a sheriff shall, in
2426 addition to any other qualifications required by law:
2527 (1) Be a citizen of the United States;
2628 (2) Have been a resident of the county for at least one
2729 year immediately prior to the qualification date;
2830 (3) Have the qualifications of an elector pursuant to
2931 state and federal law and been registered to vote in the
3032 county at least one year immediately prior to qualifying;
3133 (4) Have been awarded a high school diploma or a GED
3234 equivalent;
3335 (5) Be 25 years of age or older prior to qualifying;
3436 (6) Have three or more years of full-time prior service
3537 as a law enforcement officer having the power of arrest, which
36-service is certified by the Alabama Peace Officers' Standards
37-and Training Commission, and not have been retired or
38-separated from full-time active law enforcement certified
39-through the Alabama Peace Officers' Standards and Training
40-Commission for more than two consecutive years from the date
41-of qualifying, or in the event the individual has been retired

67+as a law enforcement officer having the power of arrest, which
68+service is certified by the Alabama Peace Officers' Standards
69+and Training Commission, and not have been retired or
70+separated from full-time active law enforcement certified
71+through the Alabama Peace Officers' Standards and Training
72+Commission for more than two consecutive years from the date
7173 of qualifying, or in the event the individual has been retired
7274 or separated from active law enforcement for more than two
7375 consecutive years, have obtained a recertification of
7476 full-time active law enforcement status as a law enforcement
7577 officer from the Alabama Peace Officers' Standards and
7678 Training Commission prior to the date of qualifying; and
7779 (7) Have never been convicted of a felony criminal
7880 offense in this state or convicted of a criminal offense in
7981 another jurisdiction where a conviction of the offense would
8082 be considered a felony offense in this state.
8183 Section 3. Upon election, the sheriff of the county
8284 shall attend annually a minimum of 12 hours of executive level
8385 continuing education approved by the Alabama Sheriffs
8486 Association, National Sheriffs' Association, or any other
8587 recognized executive level continuing education program
8688 designed for law enforcement.
8789 Section 4. This act shall become effective on June 1,
8890 2025.
