18	18	Relating to Talladega County; to establish a service of
19	19	process fee for the service or attempted service of certain
20	20	documents by the Talladega County Sheriff's Office in the
21	21	civil division; to provide for the disposition of service of
22	22	process fees.
23	23	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	24	Section 1. This act shall only apply to Talladega
25	25	County.
26	26	Section 2. (a)(1) The Talladega County Sheriff's Office
27	27	shall collect a service of process fee of fifty dollars ($50)
28	28	for service or attempted service of process by the sheriff for
29	29	matters pending or to be commenced in a court outside the
30	30	State of Alabama.
31	31	(2) The Talladega County Sheriff's Office shall collect
32	32	a service of process fee of one hundred dollars ($100) for
33	33	service or attempted service of process by the sheriff to an
34	34	inmate at the Federal Correctional Institution in Talladega
35	35	for matters pending or to be commenced in a court outside of
36	36	the State of Alabama.

67	67	(b) The clerk of the court or other designee in
68	68	Talladega County shall collect the service of process fee
69	69	designated in subsection (a) and shall remit the fee directly
70	70	to the sheriff for deposit in the Sheriff's Official Account.
71	71	(c) The Sheriff's Official Account shall be an
72	72	additional account separate from the budget of the sheriff as
73	73	provided for in the county general fund. The fees deposited
74	74	into the Sheriff's Official Account shall not diminish,
75	75	offset, or take the place of budgeted funds or any other
76	76	source of income established for the sheriff or for the
77	77	operation of the Talladega County Sheriff's Office. Amounts in
78	78	the Sheriff's Official Account may be expended at the
79	79	discretion of the sheriff for law enforcement purposes.
80	80	(d) The district attorney, law enforcement, grand
81	81	juries, Talladega County, and all other counties in the State
82	82	of Alabama shall be exempt from payment of the fees provided
83	83	for in this act.
84	84	Section 3. This act shall become effective October 1,
85	85	2025.
