---|
16 | 16 | | This bill would prohibit certain covered |
---|
17 | 17 | | entities that maintain biological data or neural data |
---|
18 | 18 | | from transferring or disclosing a consumer's biological |
---|
19 | 19 | | data or neural data to a third party without the |
---|
20 | 20 | | express consent of the consumer. |
---|
21 | 21 | | This bill would prohibit a covered entity from |
---|
22 | 22 | | using a consumer's biological data or neural data for a |
---|
23 | 23 | | purpose other than what is necessary to perform the |
---|
24 | 24 | | services or provide the goods requested by the |
---|
25 | 25 | | consumer. |
---|
26 | 26 | | This bill would prohibit a covered entity from |
---|
27 | 27 | | marketing to a consumer based on the consumer's |
---|
28 | 28 | | biological data or neural data. |
---|
29 | 29 | | This bill would require a covered entity to |
---|
30 | 30 | | notify a consumer before his or her biological data or |
---|
31 | 31 | | neural data is otherwise transferred, disclosed, or |
---|
32 | 32 | | used, and would provide the consumer the ability to |
---|
33 | 33 | | limit or prevent the transfer, disclosure, or use of |
---|
34 | 34 | | the data. |
---|
35 | 35 | | This bill would also allow the Consumer Interest |
---|
36 | 36 | | Division of the Office of the Attorney General to |
---|
37 | 37 | | enforce this act and levy a civil penalty of $3,000 per |
---|

71 | 71 | | Relating to consumer protections; to prohibit a covered |
---|
72 | 72 | | entity from disclosing, transferring, or taking certain other |
---|
73 | 73 | | actions with regard to a consumer's biological data or neural |
---|
74 | 74 | | data without the consumer's express consent; to require the |
---|
75 | 75 | | Office of the Attorney General to enforce; and to provide a |
---|
76 | 76 | | civil penalty for violations. |
---|
77 | 77 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
78 | 78 | | Section 1. For the purposes of this act, the following |
---|
79 | 79 | | terms have the following meanings: |
---|
80 | 80 | | (1) BIOLOGICAL DATA. Data generated by: (i) the |
---|
81 | 81 | | technological processing, measurement, or analysis of an |
---|
82 | 82 | | individual's biological, genetic, biochemical, physiological, |
---|
83 | 83 | | or neural properties, compositions, or activities; or (ii) an |
---|
84 | 84 | | individual's body or bodily functions, which is used or |
---|
85 | 85 | | intended to be used for identification purposes. |
---|
86 | 86 | | (2) CONSUMER. Any individual who is an Alabama |
---|
87 | 87 | | resident. |
---|
88 | 88 | | (3) COVERED ENTITY. Any individual or entity that |
---|
89 | 89 | | maintains, owns, or licenses biological data or neural data in |
---|
90 | 90 | | the course of the individual's or entity's business, vocation, |
---|
91 | 91 | | or occupation. |
---|
92 | 92 | | (4) EXPRESS CONSENT. A consumer's acknowledgment or |
---|
93 | 93 | | permission, in writing or captured electronically, to a clear, |
---|

127 | 127 | | (5) NEURAL DATA. Information that is generated by the |
---|
128 | 128 | | measurement of the activity of an individual's central or |
---|
129 | 129 | | peripheral nervous systems and that can be processed by or |
---|
130 | 130 | | with the assistance of a device. |
---|
131 | 131 | | Section 2. (a) A covered entity may not do any of the |
---|
132 | 132 | | following without the express consent of the consumer, given |
---|
133 | 133 | | before each specific transfer, disclosure, or use takes place: |
---|
134 | 134 | | (1) Transfer a consumer's biological data or neural |
---|
135 | 135 | | data to a third party. |
---|
136 | 136 | | (2) Disclose the consumer's biological data or neural |
---|
137 | 137 | | data to a third party for a reason other than fulfillment of |
---|
138 | 138 | | the entity's products or services. |
---|
139 | 139 | | (3) Use the consumer's biological data or neural data |
---|
140 | 140 | | for a purpose other than what is necessary to perform the |
---|
141 | 141 | | services or provide the goods reasonably expected by an |
---|
142 | 142 | | average consumer who requests those goods of services. |
---|
143 | 143 | | (4) Market to a consumer based on the consumer's |
---|
144 | 144 | | biological data or neural data. |
---|
145 | 145 | | (b) A covered entity that transfers, discloses, or uses |
---|
146 | 146 | | a consumer's biological data or neural data for purposes other |
---|
147 | 147 | | than those provided in subsection (a), before the transfer, |
---|
148 | 148 | | disclosure, or use, shall notify the consumer that the |
---|
149 | 149 | | information may be transferred, disclosed, or used for a |
---|
150 | 150 | | specified purpose and provide the consumer the opportunity to |
---|
151 | 151 | | limit or prevent the transfer, disclosure, or use of the |

183 | 183 | | Section 3. (a) Any consumer may report a violation of |

186 | 186 | | (b) The Consumer Interest Division of the Office of the |

187 | 187 | | Attorney General may enforce this act by a civil action in |

188 | 188 | | circuit court to enjoin any practice or conduct in violation |

189 | 189 | | of this act or to recover a civil penalty of up to three |
---|
190 | 190 | | thousand dollars ($3,000) for each violation. |
---|
191 | 191 | | (c) Any civil penalty and costs may be waived if the |
---|
192 | 192 | | covered entity has made full restitution or has paid actual |
---|
193 | 193 | | damages to any consumer who has been injured by a violation of |
---|
194 | 194 | | this act. |
---|
195 | 195 | | (d) In any settlement of a claim or civil action |
---|
196 | 196 | | resulting from a violation of this act, the Office of the |
---|
197 | 197 | | Attorney General shall receive reasonable attorney fees and |
---|
198 | 198 | | costs. |
---|
199 | 199 | | Section 4. This act shall become effective on October |
---|
