1515 SYNOPSIS:
1616 This bill would prohibit certain covered
1717 entities that maintain biological data or neural data
1818 from transferring or disclosing a consumer's biological
1919 data or neural data to a third party without the
2020 express consent of the consumer.
2121 This bill would prohibit a covered entity from
2222 using a consumer's biological data or neural data for a
2323 purpose other than what is necessary to perform the
2424 services or provide the goods requested by the
2525 consumer.
2626 This bill would prohibit a covered entity from
2727 marketing to a consumer based on the consumer's
2828 biological data or neural data.
2929 This bill would require a covered entity to
3030 notify a consumer before his or her biological data or
3131 neural data is otherwise transferred, disclosed, or
3232 used, and would provide the consumer the ability to
3333 limit or prevent the transfer, disclosure, or use of
3434 the data.
3535 This bill would also allow the Consumer Interest
3636 Division of the Office of the Attorney General to
3737 enforce this act and levy a civil penalty of $3,000 per
3838 violation.

7070 AN ACT
7171 Relating to consumer protections; to prohibit a covered
7272 entity from disclosing, transferring, or taking certain other
7373 actions with regard to a consumer's biological data or neural
7474 data without the consumer's express consent; to require the
7575 Office of the Attorney General to enforce; and to provide a
7676 civil penalty for violations.
7777 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7878 Section 1. For the purposes of this act, the following
7979 terms have the following meanings:
8080 (1) BIOLOGICAL DATA. Data generated by: (i) the
8181 technological processing, measurement, or analysis of an
8282 individual's biological, genetic, biochemical, physiological,
8383 or neural properties, compositions, or activities; or (ii) an
8484 individual's body or bodily functions, which is used or
8585 intended to be used for identification purposes.
8686 (2) CONSUMER. Any individual who is an Alabama
8787 resident.
8888 (3) COVERED ENTITY. Any individual or entity that
8989 maintains, owns, or licenses biological data or neural data in
9090 the course of the individual's or entity's business, vocation,
9191 or occupation.
9292 (4) EXPRESS CONSENT. A consumer's acknowledgment or
9393 permission, in writing or captured electronically, to a clear,

123123 permission, in writing or captured electronically, to a clear,
124124 meaningful, and prominent written notice regarding the
125125 disclosure or use of the consumer's biological data or neural
126126 data.
127127 (5) NEURAL DATA. Information that is generated by the
128128 measurement of the activity of an individual's central or
129129 peripheral nervous systems and that can be processed by or
130130 with the assistance of a device.
131131 Section 2. (a) A covered entity may not do any of the
132132 following without the express consent of the consumer, given
133133 before each specific transfer, disclosure, or use takes place:
134134 (1) Transfer a consumer's biological data or neural
135135 data to a third party.
136136 (2) Disclose the consumer's biological data or neural
137137 data to a third party for a reason other than fulfillment of
138138 the entity's products or services.
139139 (3) Use the consumer's biological data or neural data
140140 for a purpose other than what is necessary to perform the
141141 services or provide the goods reasonably expected by an
142142 average consumer who requests those goods of services.
143143 (4) Market to a consumer based on the consumer's
144144 biological data or neural data.
145145 (b) A covered entity that transfers, discloses, or uses
146146 a consumer's biological data or neural data for purposes other
147147 than those provided in subsection (a), before the transfer,
148148 disclosure, or use, shall notify the consumer that the
149149 information may be transferred, disclosed, or used for a
150150 specified purpose and provide the consumer the opportunity to
151151 limit or prevent the transfer, disclosure, or use of the

181181 limit or prevent the transfer, disclosure, or use of the
182182 biological data or neural data.
183183 Section 3. (a) Any consumer may report a violation of
184184 this act to the Consumer Interest Division of the Office of
185185 the Attorney General.
186186 (b) The Consumer Interest Division of the Office of the
187187 Attorney General may enforce this act by a civil action in
188188 circuit court to enjoin any practice or conduct in violation
189189 of this act or to recover a civil penalty of up to three
190190 thousand dollars ($3,000) for each violation.
191191 (c) Any civil penalty and costs may be waived if the
192192 covered entity has made full restitution or has paid actual
193193 damages to any consumer who has been injured by a violation of
194194 this act.
195195 (d) In any settlement of a claim or civil action
196196 resulting from a violation of this act, the Office of the
197197 Attorney General shall receive reasonable attorney fees and
198198 costs.
199199 Section 4. This act shall become effective on October
200200 1, 2025.
