2121 SYNOPSIS:
2222 Under existing rule, persons must have a permit
2323 issued by the Department of Conservation and Natural
2424 Resources to possess protected wild birds or animals.
2525 This bill would provide that individuals may
2626 care for injured or orphaned wild birds and animals
2727 that are not federally protected.

3030 AN ACT
3131 Relating to conservation; Alabama Good Samaritan
3232 Wildlife Rehabilitation Act established to authorize
3333 individuals to provide care to injured or orphaned wild birds
3434 and animals under certain conditions.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3636 Section 1. This act shall be known and may be cited as
3737 the Alabama Good Samaritan Wildlife Rehabilitation Act.
3838 Section 2. (a) Notwithstanding any law to the contrary,
3939 an individual may in good faith provide care or treatment to
4040 sustain life or reduce disability to any injured, orphaned, or
4141 debilitated wild bird or animal that is not federally
4242 protected or otherwise endangered so that the organism may be

7272 protected or otherwise endangered so that the organism may be
7373 returned to the wild.
7474 (b) Nothing in this section shall be construed to do
7575 either of the following:
7676 (1) Authorize an individual engaged in wildlife
7777 rehabilitation to engage in the practice of veterinary
7878 medicine as defined in Section 34-29-61, Code of Alabama 1975.
7979 (2) Exempt an individual from the crime of cruelty to
8080 animals as provided in Section 13A-11-14, Code of Alabama
8181 1975.
8282 Section 3. This act shall become effective on October
8383 1, 2025.
