1515 SYNOPSIS:
1616 Under the Constitution of Alabama of 2022, an
1717 individual is not eligible to be elected or appointed
1818 to a judicial office after reaching 70 years of age.
1919 This bill would propose an amendment to the
2020 Constitution of Alabama of 2022, to provide that an
2121 individual is not eligible to be elected or appointed
2222 to a judicial office after reaching 75 years of age.

2525 AN ACT
2626 Relating to judges; to propose an amendment to Section
2727 155 of the Constitution of Alabama of 2022, to further provide
2828 for eligibility to be elected or appointed as a judge.
2929 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3030 Section 1. The following amendment to the Constitution
3131 of Alabama of 2022, is proposed:

6666 The legislature Legislature shall provide by law for
6767 the retirement of judges, including supernumerary judges, with
6868 such conditions, retirement benefits, and pensions for them
6969 and their dependents as it may prescribe. No person An
7070 individual shall not be elected or appointed to a judicial
7171 office after reaching the age of seventy 75 years of age,
7272 provided that a judge over the age of seventy 75 years of age
7373 may be appointed to the office of supernumerary judge if he or
7474 she is not eligible to receive state judicial retirement
7575 benefits.
7676 Upon ratification of this constitutional amendment, the
7777 Code Commissioner shall number and place this amendment as
7878 appropriate in the constitution omitting this instructional
7979 paragraph and may make the following nonsubstantive revisions:
8080 change capitalization, hierarchy, spelling, and punctuation
8181 for purposes of style and uniformity; correct manifest
8282 grammatical, clerical, and typographical errors; revise
8383 internal or external citations and cross-references; harmonize
8484 language; and translate effective dates.
8585 END OF PROPOSED AMENDMENT
8686 Section 2. An election upon the proposed amendment
8787 shall be held in accordance with Sections 284 and 285 of the
8888 Constitution of Alabama of 2022, and the election laws of this
8989 state. The appropriate election official shall assign a ballot
9090 number for the proposed constitutional amendment on the
9191 election ballot and shall set forth the following description
9292 of the substance or subject matter of the proposed
9393 constitutional amendment:
9494 "Proposing an amendment to the Constitution of Alabama
