1515 SYNOPSIS:
1616 Existing law provides for the membership of the
1717 Board of Trustees of the University of South Alabama.
1818 This bill would increase the number of board
1919 members from the United States at-large from two
2020 members to three members.
2121 This bill would increase the number of board
2222 members from the state at-large from five members to
2323 nine members.
2424 This bill would remove the requirement that one
2525 member be appointed from each of the following
2626 combinations of state senatorial districts: (i) the
2727 Sixteenth and Seventeenth; (ii) the Nineteenth and
2828 Twentieth; (iii) the Twenty-first; (iv) the
2929 Twenty-third, Twenty-fifth, and Thirtieth; and (v) the
3030 Thirty-fifth, and would provide that trustees currently
3131 holding those seats may complete their terms, at which
3232 point the Governor may appoint a successor reflecting
3333 the revised membership.
3434 This bill would require the board to hold a
3535 regular annual meeting during June of each year, rather
3636 than the first Monday in June.
3737 This bill would also revise notice requirements
3838 for special meetings of the board from at least 10 days
3939 in advance of the date of the meeting to as soon as

7676 Relating to the University of South Alabama; to amend
7777 Sections 16-55-2 and 16-55-6, Code of Alabama 1975; to revise
7878 the membership of the Board of Trustees of the University of
7979 South Alabama; and to revise notice and other requirements for
8080 meetings of the board.
8181 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8282 Section 1. Sections 16-55-2 and 16-55-6, Code of
8383 Alabama 1975, are amended to read as follows:
8484 "§16-55-2
8585 (a) The board of trustees shall consist of three
8686 members from Mobile County, five nine members from the state
8787 at large, twoat-large, three members from the United States at
8888 largeat-large, and the Governor, who shall be ex officio
8989 president of the board , and one each from each of the
9090 following state senatorial districts, or combinations thereof,
9191 as those districts existed in 1963: Sixteenth and Seventeenth
9292 Districts comprising Monroe and Wilcox Counties and Butler,
9393 Conecuh, and Covington Counties, respectively; Nineteenth and
9494 Twentieth Districts comprising Choctaw, Clarke, and Washington

124124 Twentieth Districts comprising Choctaw, Clarke, and Washington
125125 Counties and Marengo and Sumter Counties, respectively;
126126 Twenty-first District comprising Baldwin and Escambia
127127 Counties; Twenty-third, Twenty-fifth, and Thirtieth Districts
128128 comprising Dale and Geneva Counties, Coffee and Crenshaw
129129 Counties, and Dallas and Lowndes Counties, respectively; and
130130 the Thirty-fifth District comprising Henry and Houston
131131 Counties. The trustees shall be appointed by the Governor, by
132132 and with the advice and consent of the State Senate, and all
133133 appointees appointed on and after June 1, 2014, shall hold
134134 office for a term of six years, and until their successors
135135 shall be appointed and qualified. Any trustee appointed to
136136 serve a 12-year term before June 1, 2014, shall continue to
137137 serve for the remainder of that term. As terms expire after
138138 that date, appointments to fill positions on the board shall
139139 be for six-year terms. The board shall be divided into three
140140 classes, as nearly equal as may be, so that one thirdone-third
141141 may be chosen as provided in Section 16-55-5. Vacancies
142142 occurring in the office of trustee from death or resignation,
143143 and the vacancies regularly occurring by expiration of the
144144 term shall be filled by the Governor, and the appointee shall
145145 hold office until the next meeting of the Legislature.
146146 Successors to those trustees whose terms expire during an
147147 interim shall hold office for the full term unless they are
148148 rejected by the Senate. No trustee shall receive any pay or
149149 emolument other than his or her actual expenses incurred in
150150 the discharge of his or her duties as a trustee.
151151 (b) As the terms of the trustees holding the seats for
152152 each of the following combinations of state senatorial

184184 trustees in accordance with subsection (a):
185185 (1) The Sixteenth and Seventeenth Districts.
186186 (2) The Nineteenth and Twentieth Districts.
187187 (3) The Twenty-first District.
188188 (4) The Twenty-third, Twenty-fifth, and Thirtieth

190190 (5) The Thirty-fifth District. "

192192 (a) Seven members of the board of trustees shall
193193 constitute a quorum, but a smaller number may adjourn from day
194194 to day until a quorum is present. The board shall hold a
195195 regular annual meeting each year at the university on the
196196 first Monday in June, unless the board, in regular session,
197197 shall determine determines to hold its meeting at some other
198198 time and place.
199199 (b)(1) Special meetings of the board may be called by
200200 assembled by either one of the two methods outlined as
201201 follows: Special meetings may be called by the :
202202 a. The chair pro tempore of the board or the;
203203 b. The Governor; or
204204 c. The chair pro tempore of the board or the Governor,
205205 upon application in writing of any three or more members of
206206 the board.
207207 (2) Once a special meeting is called, by written notice
208208 mailed shall be provided to each trustee at least 24 hours
209209 before the meeting is scheduled to begin at least 10 days in
210210 advance of the date of the meeting; and a special meeting

241241 shall be called by the chair pro tempore or the Governor upon
242242 application in writing of any three or more members of the
243243 board. No special meeting shall be held on a date less than 10
244244 days subsequent to the date of the chair pro tempore's or the
245245 Governor's notice of the meeting , except in case of emergency,
246246 which the chair pro tempore or the Governor shall specify in
247247 his or her notice to the trustees."
248248 Section 2. This act shall become effective on June 1,
249249 2025.
