1717 AN ACT
1818 Relating to Marion County; to create the Service of
1919 Process Fund; to provide for service of process; and to
2020 provide for the collection and distribution of fees associated
2121 with service of process.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. (a) The Marion County Service of Process
2424 Fund is created in the county treasury. The county commission
2525 shall keep an account of all transactions associated with the
2626 fund for audit by the Department of Examiners of Public
2727 Accounts at the same time as the commission's other accounts
2828 are audited.
2929 (b) The Sheriff of Marion County may contract with a
3030 private, public, or governmental entity for the purpose of
3131 service of process for any document other than a warrant for
3232 arrest.
3333 (c)(1) In addition to all existing charges, fees,
3434 judgments, and costs of court, the clerk, sheriff, or other
3535 appropriate court official in the criminal division of the
3636 district and circuit courts of Marion County shall collect a
3737 service of process fee of fifty dollars ($50) per case for

6767 service of process fee of fifty dollars ($50) per case for
6868 each party requiring personal service of process by the
6969 sheriff, which shall be paid into the fund.
7070 (2) In addition to all existing charges, fees,
7171 judgments, and costs of court, the clerk, sheriff, or other
7272 appropriate court official in the civil division of the
7373 district and circuit courts of Marion County shall collect a
7474 service of process fee of fifty dollars ($50) per case for
7575 each party requiring personal service of process by the
7676 sheriff, which shall be paid into the fund.
7777 (d) The Marion County Commission may use the monies
7878 generated by this section at its discretion for any lawful
7979 purpose.
8080 (e) The monies generated by this section shall not
8181 diminish or take the place of any other source of income for
8282 the county or any subdivision of the county.
8383 (f) The district attorney and grand juries shall be
8484 exempt from payment of the fees provided for in this section.
8585 Section 2. This act shall become effective on October
8686 1, 2025.
