17	17	AN ACT
18	18	Relating to Marion County; to create the Service of
19	19	Process Fund; to provide for service of process; and to
20	20	provide for the collection and distribution of fees associated
21	21	with service of process.
22	22	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	23	Section 1. (a) The Marion County Service of Process
24	24	Fund is created in the county treasury. The county commission
25	25	shall keep an account of all transactions associated with the
26	26	fund for audit by the Department of Examiners of Public
27	27	Accounts at the same time as the commission's other accounts
28	28	are audited.
29	29	(b) The Sheriff of Marion County may contract with a
30	30	private, public, or governmental entity for the purpose of
31	31	service of process for any document other than a warrant for
32	32	arrest.
33	33	(c)(1) In addition to all existing charges, fees,
34	34	judgments, and costs of court, the clerk, sheriff, or other
35	35	appropriate court official in the criminal division of the
36	36	district and circuit courts of Marion County shall collect a
37	37	service of process fee of fifty dollars ($50) per case for

68	68	each party requiring personal service of process by the
69	69	sheriff, which shall be paid into the fund.
70	70	(2) In addition to all existing charges, fees,
71	71	judgments, and costs of court, the clerk, sheriff, or other
72	72	appropriate court official in the civil division of the
73	73	district and circuit courts of Marion County shall collect a
74	74	service of process fee of fifty dollars ($50) per case for
75	75	each party requiring personal service of process by the
76	76	sheriff, which shall be paid into the fund.
77	77	(d) The Marion County Commission may use the monies
78	78	generated by this section at its discretion for any lawful
79	79	purpose.
80	80	(e) The monies generated by this section shall not
81	81	diminish or take the place of any other source of income for
82	82	the county or any subdivision of the county.
83	83	(f) The district attorney and grand juries shall be
84	84	exempt from payment of the fees provided for in this section.
85	85	Section 2. This act shall become effective on October
86	86	1, 2025.
