1515 SYNOPSIS:
1616 Under existing law, a state employee receives a
1717 meal allowance of 15 percent of the regular per diem
1818 rate for a trip of six to 12 hours' duration.
1919 This bill would provide that a state employee
2020 receives a meal allowance of 17.5 percent of the
2121 regular per diem rate for a trip of six to 12 hours'
2222 duration.

2525 AN ACT
2626 Relating to state employees; to amend Section 36-7-20,
2727 Code of Alabama 1975, to further provide for the meal
2828 allowance in certain circumstances.
2929 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3030 Section 1. Section 36-7-20, Code of Alabama 1975, is
3131 amended to read as follows:
3232 "ยง36-7-20
3333 (a) Except as otherwise provided in Section 36-7-21,
3434 the amount allowable to an individual traveling inside the
3535 State of Alabama in the service of the state or any of its
3636 departments, institutions, boards, bureaus, commissions,

6666 departments, institutions, boards, bureaus, commissions,
6767 councils, committees, or other like agencies for expenses
6868 other than transportation may be fixed by the Governor at not
6969 less than seventy-five dollars ($75) per day, and this amount
7070 shall be uniform in operation as to all individuals traveling
7171 within the state on official business under this section,
7272 provided, no individual shall be entitled to reimbursement
7373 under both this section and under Section 36-7-21 for any
7474 travel segment.
7575 (b) No travel allowance shall be paid for a trip of
7676 less than six hours' duration. For travel that does not
7777 require an overnight stay, the traveler shall be paid a meal
7878 allowance of 15 17.5 percent of the regular per diem rate for
7979 a trip of from six to 12 hours' duration, and for travel in
8080 excess of 12 hours' duration, the traveler shall be paid one
8181 meal allowance and one-fourth of the per diem allowance.
8282 (c) The per diem allowance shall not be paid to an
8383 employee stationed at the same place in the state for a period
8484 in excess of two consecutive months. After two consecutive
8585 months the amount of the allowance shall be reduced to 75
8686 percent of the regular per diem rate per day.
8787 (d) This section shall not apply to examiners or other
8888 individuals designated by the Commissioner of Insurance to
8989 examine or cause to be examined the domestic insurance
9090 corporations qualified in this state when the expense incurred
9191 by those individuals shall be paid by, collected, or received
9292 from the corporations examined under Section 27-2-25.
9393 (e) This section shall be optional with the employing
9494 agency in those instances where the employee is required to

124124 agency in those instances where the employee is required to
125125 attend training sessions, schools, seminars, or other like
126126 group functions at a facility when it would serve the best
127127 interests of both the state and the employee, or in those
128128 instances when the employee is assigned to assist in
129129 suppressing on-going natural disaster situations, or other
130130 emergencies. In those cases, the cost of meals and per diem
131131 may be paid as set forth herein or by the employing agency of
132132 the state directly to the contract facility furnishing the
133133 service, but the costs of these services shall not exceed the
134134 amount allowable to the individual employee for in-state
135135 travel.
136136 (f) For purposes of applying this section to members of
137137 the Legislature, each of the following shall apply:
138138 (1) The presiding officer of the house to which the
139139 member belongs shall determine if the travel is in the service
140140 of the state.
141141 (2) In connection with the same travel, members of the
142142 Legislature shall receive per diem under this section except
143143 in either of the following instances:
144144 a. For attendance on special or regular session days or
145145 committee meeting days of the Legislature when otherwise
146146 compensated pursuant to law.
147147 b. For attendance on interim committee meeting days of
148148 the Legislature when otherwise compensated pursuant to law.
149149 (3) Travel means a departure from the place of
150150 residence of the member of the Legislature."
151151 Section 2. This act shall become effective on October
152152 1, 2025.
