1515 SYNOPSIS:
1616 This bill would allow high school student
1717 athletes to receive compensation for the use of their
1818 name, image, or likeness.
1919 This bill would also provide requirements to be
2020 adhered to when compensating high school student
2121 athletes for the use of their name, image, or likeness.

2424 AN ACT
2525 Relating to high school athletics; to allow student
2626 athletes to receive compensation for the use of their name,
2727 image, or likeness; and to provide requirements for
2828 compensating student athletes for the use of their name,
2929 image, or likeness.
3030 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3131 Section 1. (a) For the purposes of this section, the
3232 following terms have the following meanings:
3333 (1) ATHLETIC ACTIVITY. The term as defined in Section
3434 16-30D-2, Code of Alabama 1975.
3535 (2) COMPENSATION. Any monetary or in-kind payment to a

6666 student athlete.
6767 (3) SCHOOL. Any public or nonpublic K-12 school in this
6868 state.
6969 (4) STUDENT ATHLETE. A student who is enrolled in a
7070 school and participates in any athletic activity.
7171 (b) No student athlete in this state shall be prevented
7272 from receiving compensation for the use of his or her name,
7373 image, or likeness.
7474 (c) The receipt of compensation by a student athlete
7575 for the use of his or her name, image, or likeness shall be
7676 subject to all of the following requirements:
7777 (1) Compensation may not be:
7878 a. Contingent on specific athletic performance or
7979 achievement.
8080 b. Provided as an incentive to enroll or remain
8181 enrolled at a specific school.
8282 c. Provided by any school or any individual acting as
8383 an agent for a school.
8484 (2) None of the following may be used, worn, or
8585 endorsed in relation to a student athlete receiving
8686 compensation for the use of his or her name, image, or
8787 likeness:
8888 a. Marks, including a school logo, school name, school
8989 mascot, or trademarked logo or acronym of an athletic
9090 association.
9191 b. School apparel or equipment, including a school
9292 uniform or any apparel displaying a trademarked logo or
9393 acronym of an athletic association.
9494 c. A school facility.

125125 d. Activities in conflict with a school's policies,
126126 including the use of tobacco products, alcohol products, or
127127 controlled substances.
128128 (3) Prior to receiving compensation as authorized by
129129 this section, a student athlete and a parent or legal guardian
130130 of the student athlete shall receive professional guidance as
131131 to the potential impacts and consequences of receiving the
132132 compensation, including collegiate financial aid and tax
133133 implications.
134134 (4) A student athlete may not receive compensation as
135135 permitted in this section unless the student athlete or a
136136 parent or legal guardian of the student athlete first notifies
137137 the principal or athletic director of the student athlete's
138138 school that the student athlete intends to enter into any type
139139 of name, image, or likeness contract or agreement no less than
140140 seven days prior to entering into the contract or agreement.
141141 Section 2. This act shall become effective on October
142142 1, 2025.
