16	16	This bill would allow high school student
17	17	athletes to receive compensation for the use of their
18	18	name, image, or likeness.
19	19	This bill would also provide requirements to be
20	20	adhered to when compensating high school student
21	21	athletes for the use of their name, image, or likeness.
22	22	A BILL
23	23	TO BE ENTITLED
24	24	AN ACT
25	25	Relating to high school athletics; to allow student
26	26	athletes to receive compensation for the use of their name,
27	27	image, or likeness; and to provide requirements for
28	28	compensating student athletes for the use of their name,
29	29	image, or likeness.
30	30	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
31	31	Section 1. (a) For the purposes of this section, the
32	32	following terms have the following meanings:
33	33	(1) ATHLETIC ACTIVITY. The term as defined in Section
34	34	16-30D-2, Code of Alabama 1975.
35	35	(2) COMPENSATION. Any monetary or in-kind payment to a
36	36	student athlete.

67	67	(3) SCHOOL. Any public or nonpublic K-12 school in this
68	68	state.
69	69	(4) STUDENT ATHLETE. A student who is enrolled in a
70	70	school and participates in any athletic activity.
71	71	(b) No student athlete in this state shall be prevented
72	72	from receiving compensation for the use of his or her name,
73	73	image, or likeness.
74	74	(c) The receipt of compensation by a student athlete
75	75	for the use of his or her name, image, or likeness shall be
76	76	subject to all of the following requirements:
77	77	(1) Compensation may not be:
78	78	a. Contingent on specific athletic performance or
79	79	achievement.
80	80	b. Provided as an incentive to enroll or remain
81	81	enrolled at a specific school.
82	82	c. Provided by any school or any individual acting as
83	83	an agent for a school.
84	84	(2) None of the following may be used, worn, or
85	85	endorsed in relation to a student athlete receiving
86	86	compensation for the use of his or her name, image, or
87	87	likeness:
88	88	a. Marks, including a school logo, school name, school
89	89	mascot, or trademarked logo or acronym of an athletic
90	90	association.
91	91	b. School apparel or equipment, including a school
92	92	uniform or any apparel displaying a trademarked logo or
93	93	acronym of an athletic association.

125	125	d. Activities in conflict with a school's policies,
126	126	including the use of tobacco products, alcohol products, or
127	127	controlled substances.
128	128	(3) Prior to receiving compensation as authorized by
129	129	this section, a student athlete and a parent or legal guardian
130	130	of the student athlete shall receive professional guidance as
131	131	to the potential impacts and consequences of receiving the
132	132	compensation, including collegiate financial aid and tax
133	133	implications.
134	134	(4) A student athlete may not receive compensation as
135	135	permitted in this section unless the student athlete or a
136	136	parent or legal guardian of the student athlete first notifies
137	137	the principal or athletic director of the student athlete's
138	138	school that the student athlete intends to enter into any type
139	139	of name, image, or likeness contract or agreement no less than
140	140	seven days prior to entering into the contract or agreement.
141	141	Section 2. This act shall become effective on October
142	142	1, 2025.
