15	15	SYNOPSIS:
16	16	This bill would propose an amendment to the
17	17	Constitution of Alabama of 2022, relating to Baldwin
18	18	County, to establish the Belforest Landmark District,
19	19	to prohibit the annexation by local law of any property
20	20	within the district into any municipality except under
21	21	certain conditions, and to specify that the district is
22	22	not a legal entity.

24	24	TO BE ENTITLED
25	25	AN ACT
26	26	To propose an amendment to the Constitution of Alabama
27	27	of 2022, relating to Baldwin County, to establish the
28	28	Belforest Landmark District within the county and to prohibit
29	29	the annexation by local law of any property within the
30	30	district into any municipality except under certain
31	31	conditions.
32	32	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
33	33	Section 1. The following amendment to the Constitution
34	34	of Alabama of 2022, is proposed:
35	35	PROPOSED AMENDMENT
36	36	(a) For purposes of this amendment, the "Belforest

66	66	(a) For purposes of this amendment, the "Belforest
67	67	Landmark District" in Baldwin County is defined as follows:
68	68	All of Sections 11, 14, 23, 24, 25, and 36, Township 5
69	69	South, Range 2 East, and Sections 19 and 30, Township 5 South,
70	70	Range 3 East of Baldwin County, Alabama.
71	71	LESS AND EXCEPT any portion of the above described
72	72	property that lies within the corporate limits of the City of
73	73	Daphne, Alabama.
74	74	(b) No property within the Belforest Landmark District
75	75	may be annexed into any municipality by local law.
76	76	(c) Subsection (b) shall not apply to any municipality
77	77	incorporated after the ratification of this amendment which
78	78	includes any part of the Belforest Landmark District.
79	79	(d) The Belforest Landmark District shall not be
80	80	considered a legal entity and shall not have any of the
81	81	following powers or authority:
82	82	(1) Standing to sue or be sued.
83	83	(2) Taxing authority.
84	84	(3) Zoning authority.
85	85	(4) Police power and public safety authority.
86	86	(5) Authority to adopt ordinances, rules, or
87	87	regulations within its boundaries.
88	88	(6) Any other authority or power commonly associated
89	89	with a legal entity.
90	90	Upon ratification of this constitutional amendment, the
91	91	Code Commissioner shall number and place this amendment as
92	92	appropriate in the constitution omitting this instructional
93	93	paragraph and may make the following nonsubstantive revisions:
94	94	change capitalization, hierarchy, spelling, and punctuation

124	124	change capitalization, hierarchy, spelling, and punctuation
125	125	for purposes of style and uniformity; correct manifest
126	126	grammatical, clerical, and typographical errors; revise
127	127	internal or external citations and cross-references; harmonize
128	128	language; and translate effective dates.
129	129	END OF PROPOSED AMENDMENT
130	130	Section 2. An election upon the proposed amendment
131	131	shall be held in accordance with Sections 284, 284.01, and 285
132	132	of the Constitution of Alabama of 2022, and the election laws
133	133	of this state. The appropriate election official shall assign
134	134	a ballot number for the proposed constitutional amendment on
135	135	the election ballot and shall set forth the following
136	136	description of the substance or subject matter of the proposed
137	137	constitutional amendment:
138	138	"Relating to Baldwin County, proposing an amendment to
139	139	the Constitution of Alabama of 2022, to define the Belforest
140	140	Landmark District within the county and to prohibit the
141	141	annexation by local law of any property within the district
142	142	into any municipality except under certain conditions.
143	143	Proposed by Act ____."
144	144	This description shall be followed by the following
145	145	language:
146	146	"Yes( ) No( )."
147	147	Section 3. The proposed amendment shall become valid as
148	148	part of the Constitution of Alabama of 2022, when approved by
149	149	a majority of the qualified electors voting thereon.
