1717 AN ACT
1818 Relating to Fayette County; to amend Section 45-29-240,
1919 Code of Alabama 1975, to further provide for the duties of the
2020 revenue commissioner; and to further provide for the
2121 compensation of the revenue commissioner.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. Section 45-29-240, Code of Alabama 1975, is
2424 amended to read as follows:
2525 "ยง45-29-240
2626 (a) At the expiration of the terms of office, or if a
2727 vacancy occurs in either the office of Tax Assessor or the
2828 office of Tax Collector of Fayette County before such date,
2929 then immediately upon the occurrence of such vacancy there
3030 shall be established the office of county revenue commissioner
3131 in Fayette County. If such office is established upon the
3232 occurrence of a vacancy in either the office of tax assessor
3333 or tax collector, then the tax assessor or tax collector, as
3434 the case may be, remaining in office shall be the county
3535 revenue commissioner for the remainder of the term for which
3636 he or she was elected. A revenue commissioner shall be elected
3737 at an election called for that purpose and every six years

6767 at an election called for that purpose and every six years
6868 thereafter. He or she shall serve for a term of office of six
6969 years.
7070 (b) The county revenue commissioner shall do and
7171 perform all acts, duties, and functions required by law to be
7272 performed either by the tax assessor or by the tax collector
7373 of the county relative to the assessment of property for ad
7474 valorem taxation, the collection of such taxes, the keeping of
7575 records, and the making of reports concerning assessments for
7676 and the collection of taxes.
7777 (c) Subject to the approval of the county commission,
7878 the county revenue commissioner shall appoint and fix the
7979 duties and compensation of a sufficient number of deputies,
8080 clerks, and assistants to perform properly the duties of his
8181 or her office. The acts of deputies shall have the same force
8282 and legal effect as if performed by the county revenue
8383 commissioner.
8484 (d) Before entering upon the duties of office, the
8585 county revenue commissioner shall take the oath of office
8686 prescribed by Article XVI Section 279 of the Constitution of
8787 Alabama of 19012022, and execute a bond in such sum as may be
8888 fixed by the county commission, giving as security thereon a
8989 bonding company authorized to do business in Alabama. The bond
9090 shall be conditioned, as other official bonds are conditioned,
9191 and shall be approved by and filed with the judge of probate.
9292 The cost of the bond required herein shall be paid out of the
9393 general funds of the county on a warrant of the county
9494 commission and shall be a preferred claim against the county.
9595 (e) The county commission shall provide the necessary

125125 (e) The county commission shall provide the necessary
126126 offices for the county revenue commissioner in the courthouse
127127 and shall provide all stationery, equipment, and office
128128 supplies, not otherwise furnished by law, needed for the
129129 efficient performance of the duties of the office.
130130 (f) The county revenue commissioner shall collect and
131131 pay into the general fund of the county all fees, percentages,
132132 commissions, and other allowances which the tax assessor and
133133 the tax collector are now or hereafter by law authorized or
134134 directed to charge or collect for the performance of any duty
135135 imposed by law on any such those officers and hereby
136136 transferred to and imposed on the county revenue commissioner.
137137 As compensation for performance of the duties of his or her
138138 office, the county revenue commissioner shall receive a
139139 minimum salary of thirty-five thousand dollars ($35,000) per
140140 annum, as provided by Section 40-6A-2, payable in 12 equal
141141 monthly installments, with the exact amount to be set by
142142 resolution of the county commission prior to the county
143143 revenue commissioner taking office. If no action is taken by
144144 the county commission before the county revenue commissioner
145145 takes office at each term, his or her salary shall be
146146 thirty-five thousand dollars ($35,000).
147147 (g) The offices of Tax Assessor and Tax Collector of
148148 Fayette County are hereby abolished effective on the last day
149149 of the term to which they are elected, or on such earlier
150150 date, as is prescribed in subsection (a), if a vacancy occurs
151151 in either the office of tax assessor or tax collector .
152152 (h) It is the purpose of this section to conserve
153153 revenue and promote the public convenience in Fayette County

183183 revenue and promote the public convenience in Fayette County
184184 by consolidating the offices of tax assessor and tax collector
185185 into one county office.
186186 (i) If the office of tax assessor or tax collector
187187 should become vacant between the time of ratification of this
188188 section by the electors of Fayette County and the expiration
189189 of the term of office of either the tax assessor or tax
190190 collector, this section shall become effective immediately and
191191 the election thereon shall be called within 45 days of such
192192 vacancy."
193193 Section 2. (a) Until October 1, 2027, the Revenue
194194 Commissioner of Fayette County shall continue to receive the
195195 same base annual salary the commissioner is receiving on
196196 September 30, 2025.
197197 (b) Beginning October 1, 2025, in addition to the base
198198 salary authorized in subsection (a), the revenue commissioner
199199 shall receive an expense allowance of fifteen thousand dollars
200200 ($15,000) per annum, payable in equal monthly installments
201201 from the county general fund.
202202 (c) Beginning October 1, 2027, the revenue
203203 commissioner's base salary shall be sixty-seven thousand
204204 dollars ($67,000) per annum, and the salary and expense
205205 allowance authorized in subsections (a) and (b) are void.
206206 Section 3. This act shall become effective on June 1,
207207 2025.
