18-Relating to the Alabama Justice Information Commission;
19-to amend Sections 41-9-590, 41-9-594, 41-9-625, and 41-9-650,

22-authorize the use of certain approved biometric identification
23-devices by law enforcement officers to identify individuals;

69125 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
70126 Section 1. Sections 41-9-590, 41-9-594, 41-9-625, and
71127 41-9-650, Code of Alabama 1975, are amended to read as
72128 follows:
73129 "§41-9-590
74130 When used in this article, the following terms shall
75131 have the following meanings, respectively, unless the context
76132 clearly indicates a different meaning:
77133 (1) AJIC or COMMISSION. The Alabama Justice Information
78134 Commission.
79135 (2) ALEA. The Alabama State Law Enforcement Agency.
80136 (3) ALEA CJIS. The Criminal Justice Information
81137 Services Division of the ALEA State Bureau of Investigations.
82138 (4) BACKGROUND CHECK. A report produced by one or more
83139 information systems within ALEA that identifies a specific
84140 person's criminal history record within the state criminal
85141 history repository. The report may also include criminal
86142 history record information from the national criminal history
87143 repository maintained by the FBI or other public
88144 safety-related information maintained or accessed through the
89145 authority of ALEA.
90146 (5) CRIMINAL HISTORY RECORD INFORMATION. Information
91147 collected by criminal justice agencies on individuals
92148 consisting of identifiable descriptions including fingerprints
93149 and other biometric information, and notations of arrests,
94150 detentions, indictments, or other formal charges, and any
95151 disposition arising therefrom, including acquittal,

127183 The term does not include identification information such as
128184 fingerprint records if such information does not indicate the
129185 individual's involvement with the criminal justice system.
130186 (3)(6) CRIMINAL JUSTICE AGENCIES. Federal, state,
131187 local, and tribal public agencies that perform substantial
132188 activities or planning for activities relating to the
133189 identification, apprehension, prosecution, adjudication, or
134190 rehabilitation of civil, traffic, and criminal offenders.
135191 (4)(7) CRIMINAL JUSTICE INFORMATION. Data necessary for
136192 criminal justice Information based upon data under the
137193 authority of ALEA or AJIC necessary for criminal justice and
138194 public safety agencies to perform their duties and enforce
139195 existing law missions. This term includes , but is not limited
140196 to, biometrics, business, biometric, identity history, person,
141197 organization, and property, when accompanied by any personally
142198 identifiable information, bond conditions and provisions,
143199 case/incident case or incident history data reports, and any
144200 other data deemed criminal justice information by the FBI CJIS
145201 Security Policy. The term also includes ALEA-provided or FBI
146202 CJIS-provided data necessary to make hiring decisions. In
147203 addition, the term may refer to the ALEA CJIS-provided or FBI
148204 CJIS-provided data necessary for civil agencies to perform
149205 their missions, including, but not limited to, data used to
150206 make hiring decisions.
151207 (5)(8) CRIMINAL JUSTICE INFORMATION SERVICES DIVISION
152208 or FBI CJIS. The division of the Federal Bureau of
153209 Investigation that equips law enforcement, national security,

190246 (9) FBI. The Federal Bureau of Investigation.
191247 (6)(10) INFORMATION SYSTEM. A system of people, data,
192248 and processes, whether manual or automated, established for
193249 the purpose of managing information.
194250 (7)(11) NLETS. Network provider The national
195251 organization that provides for exchange of criminal justice
196252 and public safety information among multiple between state,
197253 federal, and international criminal justice agencies.
198254 (8)(12) NLETS SYSTEM AGENCY or NSA. The state agency
199255 responsible for the administration of the NLETS network
200256 information provided by NLETS to criminal justice and public
201257 safety agencies within this state and represents the state on
202258 the governing board for NLETS .
203259 (13) NONCRIMINAL JUSTICE PURPOSE. The uses of criminal
204260 history records for purposes authorized by federal or state
205261 law other than purposes relating to the administration of
206262 criminal justice, including employment suitability, licensing
207263 determinations, immigration and naturalization matters, and
208264 national security clearances.
209265 (9)(14) OFFENSE. Any act that is a felony, misdemeanor,
210266 state violation, municipal ordinance violation, or violation,
211267 or an act of delinquency.

245301 whose fingerprints are registered in the ALEA CJIS biometric
246302 identity repository or the FBI CJIS national fingerprint file.
247303 (10)(16) SECRETARY. The Secretary of the Alabama State
248304 Law Enforcement Agency.
249305 (11)(17) SBI. The State Bureau of Investigation
250306 Investigations.
251307 (12)(18) USER AGENCY. Any agency or entity that
252308 subscribes to, accesses, or views any ALEA information system
253309 or service provided under the authority of this article."
254310 "§41-9-594
255311 (a) The commission shall establish its own rules and
256312 policies for the performance of the responsibilities charged
257313 to it in under this article. Unless otherwise stated, the
258314 rules of the commission are subject to the Administrative
259315 Procedure Act, Chapter 22 of Title 41. ALEA may establish
260316 procedures to implement the rules and policies of the
261317 commission or as otherwise stated in state law.
262318 (b) The commission shall establish adopt rules and
263319 policies that will restrict the information obtained under
264320 authority of this article to the items germane to the
265321 implementation of this article and restrict the use of
266322 information only to authorized persons and agencies.
267323 (c) The chair of the commission shall appoint a Privacy
268324 and Security Committee from the membership of the commission
269325 who are elected officials, or their designees, consisting of a

300356 chair and three members, to study the privacy and security
301357 implications of sharing criminal justice information and to
302358 formulate rule or policy recommendations for consideration by
303359 the commission concerning the collection, storage,
304360 dissemination, or usage of criminal justice information.
305361 (d) The commission may adopt rules and policies
306362 regarding the collection, storage, and dissemination of
307363 criminal justice information that conform to the policies of
308364 the FBI CJIS. The commission may adopt rules and policies that
309365 permit ALEA to perform background checks for noncriminal
310366 justice purposes and may provide for the procedure for
311367 obtaining the records including, but not limited to, charging
312368 a fee not to exceed twenty-five dollars ($25) for securing
313369 records through ALEA. All fees shall be deposited into the
314370 State Treasury to the credit of the Public Safety Fund and
315371 shall be used to cover the expenses for improving criminal
316372 history records and the state repository at ALEA.
317373 (e) Any rule or policy of the commission to the
318374 contrary notwithstanding, the police department of any college
319375 or university in this state which offers medical, nursing, and
320376 health care education, or which operates a hospital may
321377 request from ALEA a criminal background check on any person
322378 who applies for employment with the college or university, and
323379 ALEA may charge a background search fee of up to twenty-five
324380 dollars ($25) from each applicant for each search conducted on
325381 the applicant. All fee proceeds from the background check fee
326382 shall be deposited in the State Treasury to the credit of the
327383 Public Safety Fund and shall be used to cover expenses for

361417 services rendered by ALEA under the authority of this article.

364420 develop, maintain, and promote operations as authorized in
365421 this article."

367423 (a) All persons in this state in charge of law
368424 enforcement and correctional agencies shall obtain biometric
369425 identifiers, which may include fingerprints, photographs, palm
370426 prints, retina scans, or other identifiers specified by the
371427 FBI, according to the biometric identification system at ALEA
372428 and the rules established by the commission of all persons
373429 arrested or taken into custody as fugitives from justice, and
374430 of all unidentified human corpses in their jurisdictions. All
375431 biometric identifiers collected according to this section
376432 shall be provided to ALEA according to the rules of the
377433 commission.
378434 (b) If any person arrested or taken into custody is
379435 subsequently released without charge or cleared of the offense
380436 through criminal justice proceedings, the disposition shall be
381437 reported by all state, county, and municipal criminal justice
382438 agencies to ALEA within 30 days of such action, and all of the
383439 information shall be eliminated and removed.
384440 (a) When an individual is arrested for a criminal
385441 offense, the arresting agency shall obtain biometric

475531 that provide the officer authority to request or otherwise
476532 take action to identify an individual. The device must meet
477533 FBI or AJIC standards to compare the captured identifier to
478534 the state or federal biometric identification repositories. "

480536 In addition to any other requirements, any agency,
481537 board, or commission in this state that issues a permit or
482538 license, by rule, may require a criminal background check
483539 through ALEA as part of its licensing or permitting
484540 requirements. Any agency, board, or commission adopting a rule
485541 requiring a background check shall be subject to rules and
486542 procedures of the commission for the use of the background
487543 check.
488544 (a) ALEA shall establish and operate a service, to be
489545 called the Alabama Background Check Service, that allows
490546 authorized persons and entities to obtain background checks on
491547 individuals for noncriminal justice purposes.
492548 (b) AJIC shall adopt rules for the governance of the
493549 Alabama Background Check Service. ALEA shall establish
494550 procedures for the operation of the service that are
495551 consistent with the commission's rules.
496552 (c) ALEA may contract with one or more vendors or other
497553 third-party entities to facilitate any or all functions of the
498554 service on behalf of ALEA. "
499555 Section 2. Sections 41-9-650.1, 41-9-650.2, 41-9-650.3,
500556 41-9-650.4, and 41-9-650.5 are added to the Code of Alabama

533589 (a) For the noncriminal justice purposes specified
534590 herein, ALEA may provide a background check to any of the
535591 following persons or entities:
536592 (1) Any public or private employer, to screen a
537593 prospective employee or contractor or for other employment
538594 purposes.
539595 (2) Any government agency, board, or commission with
540596 legal authority to issue a license, permit, or certification,
541597 to screen an applicant for the issuance or renewal of the
542598 license, permit, or certification.
543599 (3) Any nonprofit or volunteer organization, to screen
544600 a prospective or current volunteer of the organization.
545601 (4) Any housing authority or lessor of rental property,
546602 to screen a prospective or current resident.
547603 (5) Any educational entity, for the purpose of
548604 screening student applicants, prospective or current
549605 volunteers involved with entity-related activities, or other
550606 individuals directly related to the operations or events of
551607 the entity and subject to the entity's authority.
552608 (6) Any agency or organization established by federal
553609 or state law, for an official purpose of the agency or
554610 organization.
555611 (7) Any person or entity authorized by the rules of the
556612 commission to obtain a background check for noncriminal
557613 justice purposes.
558614 (b) Except as otherwise provided by law, an individual
559615 that is the subject of a background check for noncriminal

592648 requesting the check prior to ALEA's dissemination of
593649 background check information. The subject's written permission
594650 shall be maintained, physically or digitally, by the
595651 requesting person or entity for a period of three years or for
596652 the term of the subject's association with the requester,
597653 whichever is longer.
598654 (c) A background check will not be provided on any
599655 individual under 18 years of age without parental consent.

649705 (b) A name-based search shall be initiated by
650706 submitting an individual's name to ALEA through an Internet
651707 web portal or other commission-approved mechanism, which shall
652708 allow for the electronic transfer of records and shall only
653709 return state information results.
654710 (c) The response to a biometric-based search shall only
655711 be provided upon the receipt of biometric information by ALEA
656712 or a commission-approved third-party entity acting on behalf
657713 of ALEA that meets all FBI standards for biometric
658714 identification collection. This search shall provide state
659715 information results as well as other state and federal
660716 information as allowed by law.
661717 (d) An applicant for a license, permit, or
662718 certification shall provide the issuing government agency,
663719 board, or commission with his or her name, date of birth,
664720 Social Security Number, and written permission for the release
665721 of information on a form sworn by the applicant. This
666722 information shall be digitally provided to ALEA. If a
667723 biometric-based check is requested, the applicant shall submit
668724 fingerprints or other biometrics in accordance with rules of
669725 ALEA and AJIC. If a national record check is required, ALEA
670726 shall forward or process the applicant's prints or other
671727 biometrics to the FBI for a national criminal background check
672728 in a manner consistent with federal law.

708764 (b) Additional costs may be assessed to a person or
709765 entity requesting a background check for any of the following:
710766 (1) The cost for a national criminal background check,
711767 as determined by the FBI.
712768 (2) Financial transaction fees.
713769 (3) A reasonable one-time account registration fee.
714770 (c) ALEA may enter into an agreement with one or more
715771 vendors or other third-party entities to perform background
716772 check services for ALEA on the basis of fee sharing or by
717773 adding an additional convenience fee for third-party services.
718774 (d) Requests for background checks made by the Alabama
719775 Peace Officers' Standards and Training Commission or by any
720776 criminal justice agency are exempt from fees established
721777 pursuant to this section, if the request is made for criminal
722778 justice purposes or for the purpose of making an employment
723779 suitability decision.
724780 (e) All monies received for background checks shall be
725781 deposited in the State Treasury to the credit of the Public
726782 Safety Fund. Such monies shall be used for the purposes of
727783 ALEA CJIS and for other ALEA expenses as determined by the
728784 secretary.

764820 of the rap back service is to allow ALEA to notify
765821 participating entities when an enrolled individual is the
766822 subject of a rap back notification event, including, but not
767823 limited to, being arrested for or convicted of a criminal
768824 offense.
769825 (b) As used in this section, the following words have
770826 the following meanings:
771827 (1) INDIVIDUAL. Any person who has undergone a
772828 fingerprint-based background check in order to care for
773829 children, the disabled, or the elderly, or to be licensed,
774830 certified, or perform volunteer service, or for any other FBI
775831 or federally authorized purpose with a participating entity
776832 and who has been enrolled by that participating entity in the
777833 Alabama Rap Back Program.
778834 (2) PARTICIPATING ENTITY. An entity with statutory
779835 authority to require an individual to undergo a
780836 fingerprint-based background check as a condition to care for
781837 children, the disabled, or the elderly, or to be licensed,
782838 certified, or perform volunteer service, or for any other FBI
783839 or federally authorized purpose and has elected to enroll
784840 those individuals in the Alabama Rap Back Program.
785841 (c) ALEA may submit fingerprints and accompanying
786842 records to the FBI to be retained in and advised through the
787843 FBI's NGI Rap Back Service when an enrolled individual is
788844 arrested for or convicted of a criminal offense. Fingerprints
789845 submitted to the FBI may be used for future searches,
790846 including latent searches.
791847 (d) ALEA shall ensure that notification is made to the

822878 participating entity that enrolls an individual in the Alabama
823879 Rap Back Program when an FBI Rap Back report notification is
824880 received. The information contained in the notification shall
825881 be used by the participating entity for purposes of
826882 determining the eligibility of the continued service of the
827883 individual and shall not be further disseminated.
828884 (e) No liability shall be imposed upon any law
829885 enforcement official who disseminates information, or does not
830886 disseminate information, in a good faith attempt to comply
831887 with the requirements of this section. Nothing in this
832888 subsection shall be construed to grant immunity for gross
833889 negligence or willful misconduct.
834890 (f) ALEA shall adopt rules governing the operation and
835891 maintenance of the Alabama Rap Back Program and the removal
836892 and destruction of records on individuals who are deceased or
837893 who are no longer individuals as defined in this section. Such
838894 rules shall provide that a participating entity shall
839895 disenroll any individual who is deceased or is no longer an
840896 individual as defined in this section within five business
841897 days of death or such event that no longer requires the
842898 individual to be enrolled in the Alabama Rap Back Program to
843899 ensure the prompt removal and destruction of records from the
844900 Alabama Rap Back Program.
845901 (g) ALEA may assess an annual fee not to exceed twelve
846902 dollars ($12) per individual enrolled in the Alabama Rap Back
847903 Program. The fee shall be paid by the participating entity
848904 enrolling an individual in the Alabama Rap Back Program. When

881937 shall be responsible for paying the full cost for maintenance
882938 and notification. Any fees collected shall be deposited in the
883939 State Treasury to the credit of the Public Safety Fund. Such
884940 monies shall be used for the purposes of ALEA CJIS and for
885941 other ALEA expenses as determined by the secretary.
886942 (h) No participating entity authorized to submit
887943 fingerprints shall be considered negligent per se in a civil
888944 action solely because the entity elected not to enroll an
889945 individual in the Alabama Rap Back Program pursuant to this
890946 section.
891947 (i) ALEA may establish an in-state rap back service for
892948 any person or entity that does not qualify to receive
893949 information from the FBI Rap Back Service but that has
894950 authority to require a state-only background check.

896952 (a) An individual commits the crime of misuse of a
897953 background check report if he or she does any of the
898954 following:
899955 (1) Knowingly receives, disseminates, or otherwise uses
900956 a background check contrary to the purposes allowed by this
901957 article or otherwise allowed in law.
902958 (2) Performs a background check on an individual
903959 without first receiving a release, when required, from the
904960 subject of the report.
905961 (3) Willfully uses information submitted to the Alabama
906962 Rap Back Program for purposes not authorized in this article
907963 with the intent to harass or intimidate another individual.
