1717 SYNOPSIS:
1818 This bill would prohibit an employer or
1919 prospective employer from discriminating against an
2020 individual on the basis of the individual's refusal of
2121 certain drugs, vaccines, or facial coverings for
2222 reasons of conscience, including religious convictions.
2323 This bill would prohibit a place of public
2424 accommodation from discriminating against any
2525 individual on the basis of the individual's
2626 immunization status or refusal to wear a facial
2727 covering.
2828 This bill would prohibit a hospital or health
2929 plan insurer from discriminating against any individual
3030 based on the individual's refusal of certain drugs,
3131 vaccines, or facial coverings, except for surgical
3232 masks during the performance of a surgical, medical, or
3333 dental procedure, for reasons of conscience, including
3434 religious convictions.
3535 This bill would prohibit an occupational
3636 licensing board from denying, suspending, revoking, or
3737 refusing to issue, renew, or reinstate a license
3838 because of the immunization status of the licensee or
3939 applicant for a license.
4040 This bill would authorize any individual subject
4141 to discrimination by an employer, prospective employer,

7373 insurer, or occupational licensing board in violation
7474 of the bill to seek a permanent or preliminary
7575 injunction, and would provide for remedies for the
7676 violation.
7777 This bill would authorize the Attorney General
7878 to bring a civil cause of action against an employer,
7979 prospective employer, place of public accommodation,
8080 hospital, health plan insurer, or occupational
8181 licensing board for a violation.
8282 This bill would also authorize the Attorney
8383 General to defend or participate in a suit on behalf of
8484 an employer, place of public accommodation, hospital,
8585 health plan insurer, or occupational licensing board
8686 that is subject to federal fines, penalties, or
8787 mandates relating to the requirements of this bill.

9191 Relating to health; to prohibit certain entities from
9292 taking certain discriminatory acts against individuals who
9393 refuse certain immunizations, drugs, or facial coverings for
9494 reasons of conscience; to provide for a private cause of
9595 action for a violation of this act; to authorize the Attorney
9696 General to enforce this act; to provide additional remedies

126126 General to enforce this act; to provide additional remedies
127127 for a violation; and to authorize the Attorney General to
128128 defend or participate in a suit on behalf of an entity subject
129129 to certain federal penalties relating to the requirements of
130130 this act.
131131 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
132132 Section 1. This act shall be known and may be cited as
133133 the Alabama Conscientious Right to Refuse Act.
134134 Section 2. (a) For the purposes of this section, the
135135 following terms have the following meanings:
136136 (1) DISCRIMINATE or DISCRIMINATION. The discharge,
137137 refusal to hire, refusal to promote, demotion, harassment,
138138 segregation, or discrimination in matters of compensation or
139139 benefits against an employee. This term includes any
140140 imposition, requirement, or burden on one class of employees
141141 that is not mandated for all other employees.
142142 (2) EMPLOYER. Any person that accepts the services of
143143 another, including, but not limited to, the services of an
144144 independent contractor or volunteer.
145145 (b) An employer or prospective employer shall not
146146 discriminate against an otherwise qualified individual on the
147147 basis of the individual's refusal of any biologic, DNA-based
148148 product, drug, facial covering, gene editing technology,
149149 pharmaceutical, RNA-based product, or vaccine for reasons of
150150 conscience, including religious convictions, with regard to
151151 job application procedures; the hiring, advancement, or
152152 discharge of employees; employee compensation; job training;
153153 or other terms, conditions, or privileges of employment.
154154 (c)(1) Any individual who is subject to discrimination

186186 permanent injunction before a circuit court of competent
187187 jurisdiction to enforce this section. A circuit court may
188188 enter any order necessary to remedy the violation, assess
189189 penalties, and award reasonable attorney fees and costs,
190190 including expert fees, to a prevailing plaintiff.
191191 (2) No security in any form may be required for an
192192 action filed under this subsection.
193193 (d)(1) The Attorney General may enforce the provisions
194194 of this section.
195195 (2) If an employer or prospective employer is subject
196196 to federal fines, penalties, or mandates: (i) due to its
197197 compliance with this section; or (ii) which conflict with the
198198 requirements of this section, the Attorney General may defend
199199 or participate in the suit on behalf of the employer or
200200 prospective employer in order to protect its right to comply
201201 with this section.
202202 Section 3. (a) For the purposes of this section, the
203203 following terms have the following meanings:
204204 (1) DISCRIMINATE or DISCRIMINATION. The denial of the
205205 opportunity of an individual or class to participate in an
206206 equal manner as all other individuals, not separate or
207207 segregated, or the denial of equal benefit from the goods,
208208 services, facilities, privileges, advantages, or
209209 accommodations of a place of public accommodation.
210210 (2) IMMUNIZATION STATUS. Whether an individual has the
211211 presence or absence of antibodies or has received or has not
212212 received any vaccination, including biologics, a DNA-based

242242 received any vaccination, including biologics, a DNA-based
243243 product, gene editing technology, pharmaceutical, or an
244244 RNA-based product administered for the purpose of preventing
245245 an infectious disease.
246246 (3) PUBLIC ACCOMODATION. The same meaning as provided
247247 in Title III of the Americans with Disabilities Act, 42 U.S.C.
248248 ยง 12181.
249249 (b) A place of public accommodation shall not
250250 discriminate against any individual on the basis of the
251251 individual's immunization status or refusal to wear a facial
252252 covering for reasons of conscience, including religious
253253 convictions, by denying or restricting in any way the
254254 individual's full and equal enjoyment of goods, services,
255255 facilities, privileges, advantages, or accommodations of the
256256 place of public accommodation.
257257 (c)(1) Any individual who is subject to discrimination
258258 in violation of this section may seek a preliminary or
259259 permanent injunction before a circuit court of competent
260260 jurisdiction to enforce this section. A circuit court may
261261 enter any order necessary to remedy the violation, assess
262262 penalties, and award reasonable attorney fees and costs,
263263 including expert fees, to a prevailing plaintiff.
264264 (2) No security in any form may be required for an
265265 action filed under this subsection.
266266 (d)(1) The Attorney General may enforce the provisions
267267 of this section.
268268 (2) If a place of public accommodation is subject to
269269 federal fines, penalties, or mandates: (i) due to its
270270 compliance with this act; or (ii) which conflict with the

300300 compliance with this act; or (ii) which conflict with the
301301 requirements of this act, the Attorney General may defend or
302302 participate in the suit on behalf of the place of public
303303 accommodation in order to protect its right to comply with
304304 this section.
305305 Section 4. (a) For the purposes of this section, the
306306 following terms have the following meanings:
307307 (1) DISCRIMINATE or DISCRIMINATION. The denial or
308308 restriction of medical care, public service, or insurance
309309 coverage, payments, reimbursements, or claims to an
310310 individual.
311311 (2) HEALTH PLAN INSURER. All health insurance plan
312312 issuers doing business in Alabama, including any public or
313313 private medical insurance program.
314314 (3) HOSPITALS. The same meaning as provided in Section
315315 22-21-20, Code of Alabama 1975.
316316 (b) A hospital or health plan insurer shall not
317317 discriminate in any way or take any adverse action against:
318318 (i) an individual based on the individual's refusal; or (ii)
319319 an unemancipated minor based on the refusal made on the
320320 minor's behalf by his or her parent, guardian, or legal
321321 representative, of any biologic, DNA-based product, drug,
322322 facial covering, gene editing technology, pharmaceutical,
323323 RNA-based product, or vaccine for reasons of conscience,
324324 including religious convictions, including, but not limited
325325 to, through:
326326 (1) Denying a service, including medical care, a public
327327 service, or organ donation, to the individual;
328328 (2) Penalizing the individual or using financial

358358 (2) Penalizing the individual or using financial
359359 coercion against the individual; or
360360 (3) Refusing or restricting insurance coverage,
361361 payments, reimbursements, or claims to an individual.
362362 (c)(1) For the purposes of this section, the term
363363 "facial covering" does not include a surgical mask worn during
364364 the performance of a surgical, medical, or dental procedure.
365365 (2) This section may not be construed to prevent the
366366 recommendation of, education on, or access to a facial
367367 covering or other medical intervention specified in this
368368 section.
369369 (d)(1) Any individual who is subject to discrimination
370370 or adverse action in violation of this section may seek a
371371 preliminary or permanent injunction before a circuit court of
372372 competent jurisdiction to enforce this act. A circuit court
373373 may enter any order necessary to remedy the violation, assess
374374 penalties, and award reasonable attorney fees and costs,
375375 including expert fees, to a prevailing plaintiff.
376376 (2) No security in any form may be required for an
377377 action filed under this subsection.
378378 (e)(1) The Attorney General may enforce the provisions
379379 of this section.
380380 (2) If a hospital or health plan insurer is subject to
381381 federal fines, penalties, or mandates: (i) due to its
382382 compliance with this section; or (ii) which conflict with the
383383 requirements of this section, the Attorney General may defend

417417 Section 5. (a) For the purposes of this section, the

419419 (1) IMMUNIZATION STATUS. The same meaning as provided
420420 in Section 3.
421421 (2) OCCUPATIONAL LICENSING BOARD. The same meaning as
422422 provided in Section 41-9A-1, Code of Alabama 1975.
423423 (b) An occupational licensing board shall not deny,
424424 suspend, revoke, or refuse to issue, renew, or reinstate a
425425 license, as defined by Section 41-9A-1, Code of Alabama 1975,
426426 because of the immunization status of the licensee or
427427 applicant for a license.
428428 (c)(1) Any individual who is subject to any action
429429 described in subsection (b) by an occupational licensing board
430430 may seek a preliminary or permanent injunction before a
431431 circuit court of competent jurisdiction to enforce this
432432 section. A circuit court may enter any order necessary to
433433 remedy the violation, assess penalties, and award reasonable
434434 attorney fees and costs, including expert fees, to a
435435 prevailing plaintiff.
436436 (2) No security in any form may be required for an
437437 action filed under this subsection.
