1717 SYNOPSIS:
1818 Under existing law, a juvenile court may issue
1919 an emergency ex parte order of protection or restraint
2020 upon a showing of verified written or verbal evidence
2121 of abuse or neglect.
2222 This bill would provide that a circuit court and
2323 district court may also issue an emergency ex parte
2424 order of protection or restraint in certain
2525 circumstances.

2828 AN ACT
2929 Relating to child custody; to add Section 30-3-11 to
3030 the Code of Alabama 1975, to allow a circuit or district court
3131 to issue an ex parte order of protection or restraint in
3232 certain circumstances.
3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. Section 30-3-11 is added to the Code of
3535 Alabama 1975, to read as follows:

3737 (a) For the purposes of this section, "department"

6868 means the local county department of human resources as
6969 described in Section 38-2-8.
7070 (b) Pending all petitions for divorce or legal
7171 separation, or other actions seeking modification,
7272 interpretation, or enforcement of a final decree, the court
7373 may issue an emergency ex parte order of protection or
7474 restraint upon making specific findings of evidence of abuse
7575 or neglect of a child, as defined in Section 26-14-1.
7676 (c) The court entering an emergency ex parte order may
7777 order the child removed from his or her parent or legal
7878 custodian and placed into the custody of an appropriate
7979 relative as determined by the court. If no relative is found,
8080 the court may place the child into the temporary protective
8181 custody of the department. The court shall include in its
8282 order specific findings that no parent or legal custodian of
8383 the child is able to provide appropriate care and protection
8484 to the child based on the evidence the court relied upon and
8585 that it is contrary to the welfare of the child to remain in
8686 the home of a parent or legal guardian.
8787 (d) Immediate verbal and written notice and copies of
8888 the order shall be given to the department pursuant to Section
8989 26-14-3. Upon notice, the department shall proceed in
9090 accordance with the duties set forth under Chapter 14 of Title
9191 26. The department may give or cause to be given effective
9292 consent for medical, dental, health, and hospital services as
9393 needed for the child.
9494 (e) The emergency ex parte order shall remain in effect
9595 until the juvenile court, exercising jurisdiction pursuant to
9696 Section 12-15-114, conducts a hearing pursuant to Section

126126 Section 12-15-114, conducts a hearing pursuant to Section
127127 12-15-308, on a petition filed by a relative, the department,
128128 or by the court that entered the emergency ex parte order. The
129129 juvenile court may ratify the emergency ex parte order or
130130 enter its own order upon the conclusion of a hearing.
131131 Section 2. This act shall become effective on June 1,
