18	18	Relating to Randolph County; to amend Section 6 of Act
19	19	2003-213, 2003 Regular Session (Acts 2003, p. 541), as last
20	20	amended by Act 2018-84, 2018 Regular Session, now appearing as
21	21	Section 45-56-243.05, Code of Alabama 1975, to further provide
22	22	for the distribution of the county tobacco tax.
23	23	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	24	Section 1. Section 6 of Act 2003-213, 2003 Regular
25	25	Session (Acts 2003, p. 541), as last amended by Act 2018-84,
26	26	2018 Regular Session, now appearing as Section 45-56-243.05,
27	27	Code of Alabama 1975, is amended to read as follows:
28	28	"§45-56-243.05
29	29	(a) The proceeds from the tax authorized, less two
30	30	percent of the actual amount of collection which shall be
31	31	retained by the state Department of Revenue, shall be
32	32	distributed to the Randolph County General Fund to be
33	33	distributed within 15 days of receipt as follows:
34	34	(1) Thirty-two percent of the proceeds shall be
35	35	distributed in equal shares to the recognized volunteer fire
36	36	departments located in the county and to the Randolph County
37	37	Rescue Squad, with each volunteer fire department receiving

67	67	Rescue Squad, with each volunteer fire department receiving
68	68	one share and the Randolph County Rescue Squad receiving one
69	69	share, to be used for fire protection and emergency medical
70	70	services in the county, as provided in subsection (b).
71	71	(2) Twenty-four percent of the proceeds shall be
72	72	distributed to the Randolph County Industrial Development
73	73	Councilused for tourism or economic development in the county .
74	74	(3) Twenty-four percent shall be retained in the
75	75	Randolph County General Fund to be utilized as are other
76	76	county funds.
77	77	(4) Ten percent of the proceeds shall be distributed to
78	78	the Randolph County Equine and Agricultural Association
79	79	Center, Inc. to be used to pursue educational opportunities
80	80	related to and to promote all types of agriculture in Randolph
81	81	County and its surrounding area.
82	82	(5) Ten percent of the proceeds shall be distributed to
83	83	the Randolph County Animal Shelter to be used for small animal
84	84	control on a countywide basis.
85	85	(b)(1) The funds distributed to the recognized
86	86	volunteer fire departments shall be payable on a monthly basis
87	87	and shall be expended only for purposes of fire protection,
88	88	prevention, and fire safety education in order to encourage a
89	89	strong volunteer firefighter network in Randolph County. The
90	90	proceeds shall be distributed to volunteer fire departments in
91	91	the county meeting the minimum state standards as determined
92	92	by the Alabama Forestry Commission and recognized by the
93	93	Randolph County Volunteer Firefighters Association. None of
94	94	the proceeds shall be used for salaries or to pay members for
95	95	any performance of duties associated with the department. Any

125	125	any performance of duties associated with the department. Any
126	126	member fire department which fails to meet the minimum
127	127	standards shall be denied its share of the funding. The
128	128	association shall give noncomplying member fire departments
129	129	proper notice of all deficiencies and a reasonable time period
130	130	to correct the deficiencies before any funds shall be denied.
131	131	(2) The share of the funds distributed to the Randolph
132	132	County Rescue Squad shall be payable on a monthly basis and
133	133	shall be expended only for the delivery of emergency services .
134	134	(c) None of the funds distributed to the Randolph
135	135	County Equine and Agricultural Association may be used for
136	136	salaries, but the members of the board shall be entitled to
137	137	reimbursement from funds of the association for their actual
138	138	and necessary expenses incurred in the performance of their
139	139	actual duties. Any additional monies needed for salaries shall
140	140	be generated from other sources .
141	141	Section 2. This act shall become effective immediately.
