1717 AN ACT
1818 Relating to Randolph County; to amend Section 6 of Act
1919 2003-213, 2003 Regular Session (Acts 2003, p. 541), as last
2020 amended by Act 2018-84, 2018 Regular Session, now appearing as
2121 Section 45-56-243.05, Code of Alabama 1975, to further provide
2222 for the distribution of the county tobacco tax.
2323 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2424 Section 1. Section 6 of Act 2003-213, 2003 Regular
2525 Session (Acts 2003, p. 541), as last amended by Act 2018-84,
2626 2018 Regular Session, now appearing as Section 45-56-243.05,
2727 Code of Alabama 1975, is amended to read as follows:
2828 "ยง45-56-243.05
2929 (a) The proceeds from the tax authorized, less two
3030 percent of the actual amount of collection which shall be
3131 retained by the state Department of Revenue, shall be
3232 distributed to the Randolph County General Fund to be
3333 distributed within 15 days of receipt as follows:
3434 (1) Thirty-two percent of the proceeds shall be
3535 distributed in equal shares to the recognized volunteer fire
3636 departments located in the county and to the Randolph County
3737 Rescue Squad, with each volunteer fire department receiving

6767 Rescue Squad, with each volunteer fire department receiving
6868 one share and the Randolph County Rescue Squad receiving one
6969 share, to be used for fire protection and emergency medical
7070 services in the county, as provided in subsection (b).
7171 (2) Twenty-four percent of the proceeds shall be
7272 distributed to the Randolph County Industrial Development
7373 Councilused for tourism or economic development in the county .
7474 (3) Twenty-four percent shall be retained in the
7575 Randolph County General Fund to be utilized as are other
7676 county funds.
7777 (4) Ten percent of the proceeds shall be distributed to
7878 the Randolph County Equine and Agricultural Association
7979 Center, Inc. to be used to pursue educational opportunities
8080 related to and to promote all types of agriculture in Randolph
8181 County and its surrounding area.
8282 (5) Ten percent of the proceeds shall be distributed to
8383 the Randolph County Animal Shelter to be used for small animal
8484 control on a countywide basis.
8585 (b)(1) The funds distributed to the recognized
8686 volunteer fire departments shall be payable on a monthly basis
8787 and shall be expended only for purposes of fire protection,
8888 prevention, and fire safety education in order to encourage a
8989 strong volunteer firefighter network in Randolph County. The
9090 proceeds shall be distributed to volunteer fire departments in
9191 the county meeting the minimum state standards as determined
9292 by the Alabama Forestry Commission and recognized by the
9393 Randolph County Volunteer Firefighters Association. None of
9494 the proceeds shall be used for salaries or to pay members for
9595 any performance of duties associated with the department. Any

125125 any performance of duties associated with the department. Any
126126 member fire department which fails to meet the minimum
127127 standards shall be denied its share of the funding. The
128128 association shall give noncomplying member fire departments
129129 proper notice of all deficiencies and a reasonable time period
130130 to correct the deficiencies before any funds shall be denied.
131131 (2) The share of the funds distributed to the Randolph
132132 County Rescue Squad shall be payable on a monthly basis and
133133 shall be expended only for the delivery of emergency services .
134134 (c) None of the funds distributed to the Randolph
135135 County Equine and Agricultural Association may be used for
136136 salaries, but the members of the board shall be entitled to
137137 reimbursement from funds of the association for their actual
138138 and necessary expenses incurred in the performance of their
139139 actual duties. Any additional monies needed for salaries shall
140140 be generated from other sources .
141141 Section 2. This act shall become effective immediately.
