1515 SYNOPSIS:
1616 Under existing law, a municipal governing body,
1717 by ordinance, may adjust the boundaries of its
1818 municipal voting districts.
1919 This bill would require that any time a
2020 municipal governing body adjusts the boundaries of a
2121 municipal voting district, the municipal governing body
2222 must send a certified copy of the resolution and a copy
2323 of the map showing the new boundaries to the Permanent
2424 Legislative Committee on Reapportionment.

2828 Relating to municipal elections; to amend Section
2929 11-46-23, Code of Alabama 1975, to require certain
3030 municipalities to provide a copy of the new boundaries of its
3131 municipal voting districts to the Permanent Legislative
3232 Committee on Reapportionment following an adjustment of the
3333 boundaries.
3434 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

6868 (a) The boundaries of wards within municipalities which
6969 have been divided into wards as now defined shall so remain
7070 until changed by ordinance. Hereafter the A municipal
7171 governing body may, in its discretion, may readjust the
7272 boundary lines of wards and may divide or consolidate any
7373 number of wards and resubdivide the same into voting
7474 districts; provided, that no such adjustment shall be made
7575 within three months of any election unless such adjustment is
7676 made during calendar year 1984 for the purpose of complying
7777 with the Voting Rights Act of 1965 , as amended.
7878 (b) Whenever the municipal governing body readjusts any
7979 ward lines or divides a ward into voting districts, the
8080 ordinance whereby the ward is established or subdivided into
8181 voting districts shall describe the territory composing the
8282 ward, and when the ward has been subdivided, the territory
8383 composing each district therein, by metes and bounds, and the
8484 municipal clerk, within five days after adoption of the
8585 ordinance, shall file with the judge of probate of the any
8686 county in which any portion of the municipality lies a
8787 certified copy of such the ordinance, accompanied by a map or
8888 plat of the city or town municipality showing the bounderies
8989 boundaries of all wards and voting districts in wards into
9090 which the municipality is then divided and shall also publish
9191 notice of all such changes or adjustments of boundaries of
9292 wards and voting districts within wards in a newspaper
9393 published in such city or town the municipality , or if there is
9494 no newspaper is published therein then in the municipality by

124124 no newspaper is published therein then in the municipality by
125125 posting notice thereof at three public places in such city or
126126 townthe municipality . This published notice need not be
127127 accompanied by a map or plat of the city or townmunicipality.
128128 (c) Within 30 days after the adoption of any ordinance
129129 as provided in this section, the municipal governing body
130130 shall send to the Permanent Legislative Committee on
131131 Reapportionment a certified copy of the resolution and a copy
132132 of the map showing the new district boundaries together with a
133133 written description of the boundaries. "
