19 | 19 | | 45-27-234, Code of Alabama 1975, to further provide for the |

20 | 20 | | qualifications of the sheriff. |

21 | 21 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

22 | 22 | | Section 1. Section 45-27-234, Code of Alabama 1975, is |
---|
23 | 23 | | amended to read as follows: |

24 | 24 | | "ยง45-27-234 |
---|
25 | 25 | | (a) On or after May 18, 2020 Beginning June 1, 2025 , a |
---|
26 | 26 | | person an individual qualifying for election as Sheriff of |
---|
27 | 27 | | Escambia County or any person individual appointed to serve as |
---|
28 | 28 | | a sheriff shall meet all of the following minimum |
---|
29 | 29 | | qualifications, in addition to any other qualifications |
---|
30 | 30 | | required by law: |
---|
31 | 31 | | (1) The person individual is a citizen of the United |
---|
32 | 32 | | States. |
---|
33 | 33 | | (2) The person individual has been a resident of the |
---|
34 | 34 | | county for at least one year immediately prior to the |
---|
35 | 35 | | qualification date. |
---|
36 | 36 | | (3) The person individual has the qualifications of an |
---|
37 | 37 | | elector pursuant to state and federal law and the person has |
---|

70 | 70 | | (4) The person individual has been awarded a high |

71 | 71 | | school diploma or a GED equivalent. |
---|
72 | 72 | | (5) The person individual is 25 years of age or older |
---|
73 | 73 | | prior to qualifying. |
---|
74 | 74 | | (6) The person individual has three or more years of |
---|
75 | 75 | | full-time prior service as a law enforcement officer having |
---|
76 | 76 | | the power of arrest, which service is certified by the Alabama |
---|
77 | 77 | | Peace Officers' Standards and Training Commission, and the |
---|
78 | 78 | | person has not been retired or separated from full-time active |
---|
79 | 79 | | law enforcement certified through the Alabama Peace Officers' |
---|
80 | 80 | | Standards and Training Commission for more than two |
---|
81 | 81 | | consecutive years one year from the date of qualifying, or in |
---|
82 | 82 | | the event the person individual has been retired or separated |
---|
83 | 83 | | from active law enforcement for more than two consecutive |
---|
84 | 84 | | yearsone year, the person individual has obtained a |
---|
85 | 85 | | recertification of full-time active law enforcement status as |
---|
86 | 86 | | a law enforcement officer from the Alabama Peace Officers' |
---|
87 | 87 | | Standards and Training Commission prior to the date of |
---|
88 | 88 | | qualifying. In addition, if the individual has ever retired |
---|
89 | 89 | | from active law enforcement, the individual has three or more |
---|
90 | 90 | | years of full-time post-retirement law enforcement service |
---|
91 | 91 | | prior to the date of qualifying. |
---|
92 | 92 | | (7) The person individual has never been convicted of a |
---|
93 | 93 | | felony criminal offense in this state or convicted of a |
---|
94 | 94 | | criminal offense in another jurisdiction where a conviction of |
---|
95 | 95 | | the offense would be considered a felony offense in this |
---|
