1717 AN ACT
1818 Relating to Escambia County; to amend Section
1919 45-27-234, Code of Alabama 1975, to further provide for the
2020 qualifications of the sheriff.
2121 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2222 Section 1. Section 45-27-234, Code of Alabama 1975, is
2323 amended to read as follows:
2424 "ยง45-27-234
2525 (a) On or after May 18, 2020 Beginning June 1, 2025 , a
2626 person an individual qualifying for election as Sheriff of
2727 Escambia County or any person individual appointed to serve as
2828 a sheriff shall meet all of the following minimum
2929 qualifications, in addition to any other qualifications
3030 required by law:
3131 (1) The person individual is a citizen of the United
3232 States.
3333 (2) The person individual has been a resident of the
3434 county for at least one year immediately prior to the
3535 qualification date.
3636 (3) The person individual has the qualifications of an
3737 elector pursuant to state and federal law and the person has

6767 elector pursuant to state and federal law and the person has
6868 been registered to vote in the county at least one year
6969 immediately prior to qualifying.
7070 (4) The person individual has been awarded a high
7171 school diploma or a GED equivalent.
7272 (5) The person individual is 25 years of age or older
7373 prior to qualifying.
7474 (6) The person individual has three or more years of
7575 full-time prior service as a law enforcement officer having
7676 the power of arrest, which service is certified by the Alabama
7777 Peace Officers' Standards and Training Commission, and the
7878 person has not been retired or separated from full-time active
7979 law enforcement certified through the Alabama Peace Officers'
8080 Standards and Training Commission for more than two
8181 consecutive years one year from the date of qualifying, or in
8282 the event the person individual has been retired or separated
8383 from active law enforcement for more than two consecutive
8484 yearsone year, the person individual has obtained a
8585 recertification of full-time active law enforcement status as
8686 a law enforcement officer from the Alabama Peace Officers'
8787 Standards and Training Commission prior to the date of
8888 qualifying. In addition, if the individual has ever retired
8989 from active law enforcement, the individual has three or more
9090 years of full-time post-retirement law enforcement service
9191 prior to the date of qualifying.
9292 (7) The person individual has never been convicted of a
9393 felony criminal offense in this state or convicted of a
9494 criminal offense in another jurisdiction where a conviction of
9595 the offense would be considered a felony offense in this

125125 the offense would be considered a felony offense in this
126126 state.
127127 (b) Upon election, the sheriff of the county shall
128128 attend annually a minimum of 12 hours of executive level
129129 continuing education approved by the Alabama Sheriff's
130130 Association, National Sheriff's Association, or any other
131131 recognized executive level continuing education program
132132 designed for law enforcement."
133133 Section 2. This act shall become effective on June 1,
134134 2025.
