1717 SYNOPSIS:
1818 Under existing law, local boards of education
1919 have the authority to adopt local policies relating to
2020 pocket pagers, cellular telephones, and other
2121 electronic communication devices.
2222 This bill would require the State Board of
2323 Education to adopt a model policy restricting the use
2424 of cell phones and other electronic communication
2525 devices in public K-12 schools during the school day,
2626 with some exceptions.
2727 This bill would also require each local board of
2828 education to adopt a policy relating to the use of
2929 electronic communication devices based on that model
3030 policy.

3434 Relating to public K-12 education; to amend Section
3535 16-1-27, Code of Alabama 1975; to require the State Board of
3636 Education to adopt a model policy restricting the use of cell

3838 of education to adopt a policy based on that model.

6969 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7070 Section 1. Section 16-1-27, Code of Alabama 1975, is
7171 amended to read as follows:
7272 "§16-1-27
7373 (a) A local board of education may permit any pupil to
7474 carry a pocket pager, cellular telephone, or other electronic
7575 communication device while on school property and may permit
7676 any pupil to use a pocket pager, cellular telephone, or other
7777 electronic communication device, when such use is expressly
7878 and specifically permitted by the school administrator,
7979 teacher, or employee who is acting in a supervisory capacity
8080 at the time of the use. For purposes of this section, the
8181 following terms have the following meanings:
8282 (1) ELECTRONIC COMMUNICATION DEVICE. Any privately
8383 owned, portable wireless device that has the capability to
8484 provide voice, messaging, or other data communication between
8585 two or more parties including, but not limited to, a cellular
8686 phone, tablet, computer, pager, or other electronic messaging
8787 device. This term does not include any device that is owned or
8888 issued to students by the local board of education.
8989 (2) STATE BOARD. The State Board of Education.
9090 (b)(1) No later than January 1, 2026, the state board
9191 shall adopt a model policy that prohibits public K-12 students
9292 from using an electronic communication device during the
9393 school day.
9494 (2) The model policy shall provide exceptions
9595 including, but not limited to, permitting a student to use an
9696 electronic communication device:

126126 electronic communication device:
127127 a. In the event of an emergency or to manage the
128128 student's health care; or
129129 b. If the use is included in the student's
130130 individualized education program (IEP) or a plan developed
131131 under Section 504 of the Rehabilitation Act of 1973, 29 U.S.C.
132132 § 794. Any pupil found in violation of this section shall be
133133 subject to suspension by the board of education.
134134 (c) Each No later than the beginning of the 2026-2027
135135 school year, each local board of education may adopt shall
136136 adopt and implement a local policy that pertains to pocket
137137 pagers, cellular telephones, and other electronic
138138 communication devices relating to the use of electronic
139139 communication devices on school property. The policy, at a
140140 minimum, shall reflect the model policy adopted by the state
141141 board."
142142 Section 2. This act shall become effective on June 1,
