1717 SYNOPSIS:
1818 Under existing law that prohibits a foreign
1919 principal from acquiring certain interests in certain
2020 agricultural and forest property or other real property
2121 in the state, the term "foreign principal" is defined
2222 as a government, government official, political party,
2323 or member of a political party of certain specified
2424 countries, or any country or government identified on
2525 any sanctions list of the U.S. Department of the
2626 Treasury's Office of Foreign Assets Control.
2727 This bill would expand the definition of
2828 "foreign principal" to include an individual or company
2929 identified on any sanctions list of the United State
3030 Department of the Treasury's Office of Foreign Assets
3131 Control.
3232 This bill would specify that the terms
3333 "agricultural and forest property" and "real property"
3434 mean agricultural and forest property and real property
3535 in the state.
3636 This bill would expand the existing law that
3737 prohibits a foreign principal from acquiring certain
3838 ownership interests in agricultural and forest property
3939 and real property to also prohibit a foreign principal
4040 from acquiring a leasehold interest in any of these
4141 properties in the state.

7474 AN ACT
7575 Relating to real property; to amend Section 35-1-1.1,
7676 Code of Alabama 1975, to prohibit certain individuals,
7777 companies, countries, governments, or related entities from
7878 acquiring certain interests in real property in the state.
7979 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8080 Section 1. Section 35-1-1.1, Code of Alabama 1975, is
8181 amended to read as follows:
8282 "§35-1-1.1
8383 (a) This section shall be known and may be cited as the
8484 Alabama Property Protection Act.
8585 (b) For purposes of this section, the following words
8686 have the following meanings:
8787 (1) AGRICULTURAL AND FOREST PROPERTY. All real property
8888 in the state used for raising, harvesting, and selling crops
8989 or for the feeding, breeding, management, raising, sale of, or
9090 the production of livestock, or for the growing and sale of
9191 timber and forest products.
9292 (2) CRITICAL INFRASTRUCTURE FACILITY. Any of the
9393 following:
9494 a. A chemical manufacturing facility.
9595 b. A refinery.
9696 c. A plant or facility producing electric energy no

126126 c. A plant or facility producing electric energy no
127127 matter how generated or produced.
128128 d. A water treatment facility or wastewater treatment
129129 plant.
130130 e. A liquid natural gas terminal.
131131 f. A telecommunications central switching office.
132132 g. A gas processing plant, including any plant used in
133133 the processing, treatment, or fractionation of natural gas.
134134 h. A seaport facility as defined in Section 40-13-1.
135135 i. Aerospace or spaceport infrastructure.
136136 j. An airport as defined in Section 23-1-411.
137137 (3) FOREIGN COUNTRY OF CONCERN. China, Iran, North
138138 Korea, and Russia. This term shall not include Taiwan.
139139 (4) FOREIGN PRINCIPAL. Any of the following:
140140 a. The government or any official of the government of
141141 a foreign country of concern.
142142 b. A political party or member of a political party or
143143 any subdivision of a political party in a foreign country of
144144 concern.
145145 c. A country or ,government, individual, or company
146146 identified on any sanctions list of the United StateStates
147147 Department of the Treasury's Office of Foreign Assets Control.
148148 (5) MILITARY INSTALLATION. A base, camp, post, station,
149149 yard, or center that is under the jurisdiction of the
150150 Department of Defense or its affiliates, encompassing at least
151151 10 contiguous acres.
152152 (6) REAL PROPERTY. Land, buildings, fixtures, and all
153153 other improvements to land in the state.
154154 (c) Notwithstanding any other law, no foreign principal

184184 (c) Notwithstanding any other law, no foreign principal
185185 shall acquire title to, or acquire a controlling interest in,
186186 or a leasehold interest in, any of the following:
187187 (1) Agricultural and forest property.
188188 (2) Real property on or within 10 miles of any military
189189 installation or critical infrastructure facility.
190190 (d)(1)SubsectionThe prohibition in subsection (c)
191191 against purchasing or otherwise acquiring title to, or a
192192 controlling interest in, property as set forth in the
193193 subsection shall apply only to the purchase of or other
194194 acquisition of title to real, or controlling interest in, the
195195 property on or after August 1, 2023. The purchase of or other
196196 acquisition of title to real property prior to August 1, 2023,
197197 is governed by the law in effect immediately prior to August
198198 1, 2023, and that law is continued in effect for that purpose.
199199 (2) The prohibition in subsection (c) against acquiring
200200 a leasehold interest in property as set forth in the
201201 subsection, shall apply to any leasehold interest acquired on
202202 or after August 1, 2025. The acquisition of a leasehold
203203 interest in the property prior to August 1, 2025, is governed
204204 by the law in effect immediately prior to August 1, 2025, and
205205 that law is continued in effect for that purpose.
206206 (e) No title insurer, title agent, real estate
207207 licensee, or other settlement provider as defined by the Real
208208 Estate Procedures Act, 12 U.S.C. § 2601 et seq., shall be
209209 liable for any violation of subsection (c).
210210 Section 2. This act shall become effective on August
211211 1, 2025.
