1717 SYNOPSIS:
1818 Under existing federal law, certain persons may
1919 not possess a firearm under certain conditions,
2020 including if the person has been convicted of a felony,
2121 the person is a fugitive from justice, the person is an
2222 unlawful user of or addicted to a controlled substance,
2323 the person has been adjudicated as having a mental
2424 illness, the person is an alien and is illegally
2525 present in the United States, the person has been
2626 discharged from the Armed Forces under dishonorable
2727 conditions, or the person is subject to a domestic
2828 violence restraining order or convicted of domestic
2929 violence.
3030 This bill would provide state criminal
3131 penalties, in a Class 1 municipality for the possession
3232 of a firearm by those persons who may not possess a
3333 firearm under federal law.
3434 Under existing federal law, it is unlawful to
3535 knowingly possess a stolen firearm or stolen
3636 ammunition.
3737 This bill would provide state criminal penalties
3838 in a Class 1 municipality for the possession of a
3939 stolen firearm or ammunition.
4040 This bill would provide criminal penalties in a
4141 Class 1 municipality for possession of certain

7171 Class 1 municipality for possession of certain
7272 prohibited firearms, accessories, and attachments,
7373 including a short-barrel shotgun, short-barrel rifle,
7474 firearm silencer, or machinegun, or any part or device
7575 that can make an otherwise semi-automatic firearm

7979 AN ACT
8080 Relating to Class 1 municipalities; to provide
8181 prohibitions on the unlawful possession of a firearm; to
8282 provide prohibitions on the unlawful transfer of a firearm to
8383 a person prohibited from possessing a firearm; to provide
8484 prohibitions on the possession of a stolen firearm or
8585 ammunition; to provide prohibitions on the possession of
8686 certain prohibited firearms under certain conditions; and to
8787 provide criminal penalties for a violation.
8888 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8989 Section 1. This act shall only apply in Class 1
9090 municipalities.
9191 Section 2. (a) A person may not purchase, use, own, or
9292 possess a firearm if the person is otherwise prohibited from
9393 shipping, transporting, possessing, or receiving a firearm in
9494 interstate commerce pursuant to 18 U.S.C. § 922(g), relating
9595 to the unlawful possession of a firearm.
9696 (b) A violation of this section is a Class B felony.

126126 (b) A violation of this section is a Class B felony.
127127 Section 3. (a) A person may not knowingly sell, give,
128128 or otherwise dispose of any firearm or ammunition to any
129129 person who is otherwise prohibited from shipping,
130130 transporting, possessing, or receiving a firearm in interstate
131131 commerce pursuant to 18 U.S.C. § 922(g), relating to the
132132 unlawful possession of a firearm.
133133 (b) A violation of this section is a Class B felony.
134134 Section 4. (a) A person may not receive, possess,
135135 conceal, store, barter, sell, or dispose of any stolen firearm
136136 or stolen ammunition, knowing or having reasonable cause to
137137 believe that the firearm or ammunition was stolen.
138138 (b) A violation of this section is a Class B felony.
139139 Section 5. (a) A person may not possess any of the
140140 following:
141141 (1) A short-barreled shotgun, as the term is defined
142142 under 18 U.S.C. § 921.
143143 (2) A short-barreled rifle, as the term is defined
144144 under 18 U.S.C. § 921.
145145 (3) A machinegun, as the term is defined under 18
146146 U.S.C. § 921.
147147 (4) A firearm silencer or firearm muffler, as those
148148 terms are defined under 18 U.S.C. § 921.
149149 (5) Any device, part, component, or combination of
150150 parts specifically designed or intended to allow an otherwise
151151 semi-automatic firearm to automatically shoot more than one
152152 shot with a single function of the trigger of the firearm to
153153 which the trigger is affixed so that the trigger rests and
154154 continues firing without any additional physical manipulation

184184 continues firing without any additional physical manipulation
185185 of the trigger by the shooter.
186186 (b) A violation of this section is a Class B felony.
187187 (c) A person has a continuing duty to inspect a firearm
188188 possessed, purchased, transferred, used, or sold by the
189189 person, including any device, part, component, or combination
190190 of parts attached to the firearm, to ensure the firearm, or
191191 device, part, component, or combination thereof, is not
192192 prohibited under subsection (a). A person who possesses,
193193 obtains, receives, sells, purchases, or uses a firearm or
194194 trigger activator prohibited under subsection (a) shall be
195195 deemed to have possessed the firearm or trigger activator
196196 knowingly.
197197 (d) Nothing in this section shall be construed to
198198 prohibit a person from manufacturing, importing, selling,
199199 offering for sale, possessing, receiving, transferring, or
200200 transporting any item for which the person is in compliance
201201 with the National Firearms Act, 26 U.S.C. § 5801 et seq., or
202202 other applicable federal law.
203203 Section 6. This act shall become effective on October
204204 1, 2025.
