1717 SYNOPSIS:
1818 Under existing law, the Alabama Board of
1919 Cosmetology and Barbering is responsible for licensing
2020 and regulating cosmetologists, barbers, estheticians,
2121 manicurists, and other practitioners of beauty culture.
2222 This bill would provide for the licensing and
2323 regulation of esthetician/makeup artists by the board,
2424 would provide for certain exemptions, and would specify
2525 qualifications for licensing.

2929 Relating to the Alabama Board of Cosmetology and
3030 Barbering; to amend Sections 34-7B-1, 34-7B-13, and 34-7B-25,
3131 Code of Alabama 1975; to define esthetics/makeup application,
3232 esthetition/makeup artists, and makeup application; to provide
3333 further for exemptions; to require registration with the board
3434 by October 1, 2025; and to add Section 34-7B-22.1 to the Code
3535 of Alabama 1975, to provide for licensing qualifications.
3636 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3737 Section 1. Sections 34-7B-1, 34-7B-13, and 34-7B-25 of
3838 the Code of Alabama 1975, are amended to read as follows:

6969 "§34-7B-1
7070 For the purposes of this chapter, the following terms
7171 shall have the following meanings:
7272 (1) APPRENTICE. Any person engaged in learning the
7373 practices defined in this article including, but not limited
7474 to, assisting in the performance of any acts of barbering or
7575 cosmetology on the general public under the constant and
7676 direct supervision of a person who has held a valid current
7777 license issued by the board for at least five years, in a shop
7878 licensed by the board.
7979 (2) BARBERING. The occupation of shaving or trimming
8080 the beard, cutting or dressing the hair, giving facial or
8181 scalp massages, giving facial or scalp treatment with oils or
8282 creams or other preparations made for that purpose, either by
8383 hand or by means of mechanical appliances, singeing and
8484 shampooing the hair, dyeing the hair, or permanently waving or
8585 straightening the hair of any living or deceased person for
8686 compensation, as performed by a Class 2 barber.
8787 (3) BOARD. The Alabama Board of Cosmetology and
8888 Barbering.
8989 (4) CLASS 1 BARBER. A person who only does the
9090 following in his or her ordinary course of business: Arranges,
9191 cleans, cuts, or singes the hair of any person or massages,
9292 cleans, stimulates, exercises, or does similar work on the
9393 scalp, face, or neck of any person with the hands, or with
9494 mechanical or electrical apparatus or appliance, or by the use
9595 of cosmetic preparations, antiseptics, tonics, lotions, or
9696 creams. Any one or a combination of the following practices,
9797 when done upon the human body above the seventh cervical

128128 vertebra for cosmetic purposes and not for the treatment of
129129 disease or physical or mental ailments, and when done for
130130 payment, directly or indirectly or without payment for the
131131 public generally: Shaving or trimming the beard or trimming
132132 the hair.
133133 (5) CLASS 2 BARBER. Any person, other than a student or
134134 apprentice, who performs barbering on the general public for
135135 compensation, and who shall satisfy the qualifications and
136136 licensure requirements provided in this chapter for a Class 2
137137 barber. For the purposes of this chapter, the term barber,
138138 standing alone, shall be deemed a reference to a Class 2
139139 barber.
140140 (6) COSMETOLOGIST. Any person, other than a student or
141141 apprentice, who performs cosmetology on the general public for
142142 compensation, and who shall satisfy the qualifications and
143143 licensure requirements provided in this article for a
144144 cosmetologist.
145145 (7) COSMETOLOGY. Any of the practices generally
146146 recognized as beauty culture, hairdressing, or any other
147147 designation engaged in by any person who performs such on the
148148 general public for compensation including, but not limited to,
149149 cleansing, singeing, cutting, arranging, dressing, curling,
150150 braiding, waxing, bleaching, weaving, coloring the hair by
151151 hand or mechanical apparatus, the use of creams, lotions, or
152152 cosmetic preparations, with or without massage, on the scalp,
153153 face, arms, legs, feet, or hands, esthetics practices, nail
154154 technology, manicure, pedicure, or desairology.
155155 (8) ESTHETICIAN. Any person, other than a student or

185185 (8) ESTHETICIAN. Any person, other than a student or
186186 apprentice, who performs esthetics on the general public for
187187 compensation, and who shall satisfy the qualifications and
188188 licensure requirements provided in this article for an
189189 esthetician.
190190 (9) ESTHETICIAN/MAKEUP ARTIST. Any person, other than a
191191 student or apprentice, who performs a combination of the
192192 practices of esthetics and makeup application on the general
193193 public for compensation, and who shall satisfy the
194194 qualifications and licensure requirements provided in this
195195 article for an esthetician/makeup artist.
196196 (9)(10) ESTHETICS. The practice of performing acts of
197197 skin care including, but not limited to, facials, body waxing,
198198 makeup application, and general esthetics procedures on the
199199 general public for compensation.
200200 (11) ESTHETICS/MAKEUP APPLICATION. A combination of the
201201 practices of esthetics and makeup application.
202202 (10)(12) ESTHETICS/MANICURE. A combination of the
203203 practices of esthetics and manicure.
204204 (11)(13) ESTHETICIAN/MANICURIST. Any person, other than
205205 a student or apprentice, who performs a combination of the
206206 practices of esthetics and manicure on the general public for
207207 compensation, and who shall satisfy the qualifications and
208208 licensure requirements provided in this article for an
209209 esthetician/manicurist.
210210 (12)(14) INSTRUCTOR. A licensee who teaches in a
211211 licensed or registered school of barbering or any branch of
212212 cosmetology and completes any applicable requirements for
213213 continuing education.

244244 (13)(15) LICENSE. A document issued by the board which
245245 entitles the holder to practice the profession listed on the
246246 document.
247247 (14)(16) LICENSEE. Any person holding a license issued
248248 pursuant to this article.
249249 (17) MAKEUP APPLICATION. The practice of applying
250250 cosmetic preparations and other cosmetic products to the skin,
251251 eyebrows, and lashes of the faces and necks of the general
252252 public for compensation.
253253 (15)(18) MANICURE. The practice of beautifying or
254254 grooming the fingernails, toenails, adding nail tips,
255255 extensions, gels, or massaging the hands, forearms, feet, or
256256 lower legs of the general public for compensation.
257257 (16)(20) MANICURIST. Any person, other than a student
258258 or apprentice, who performs the practice of manicure on the
259259 general public for compensation, and who shall satisfy the
260260 qualifications and licensure requirements provided in this
261261 article for a manicurist.
262262 (17)(19) MANICURE/WAXING. A combination of the
263263 practices of manicure and waxing.
264264 (18)(21) MANICURIST/WAXER. Any person, other than a
265265 student or apprentice, who performs a combination of the
266266 practices of manicure and waxing on the general public for
267267 compensation, and who shall satisfy the qualifications and
268268 licensure requirements provided in this article for a
269269 manicurist/waxer.
270270 (19)(22) NATURAL HAIR STYLING. The practice of
271271 cleansing, weaving or interweaving, extending, locking,

301301 cleansing, weaving or interweaving, extending, locking,
302302 braiding, or arranging the hair without cutting, coloring,
303303 permanent waving, relaxing, removing, or chemical treatments.
304304 (20)(23) NATURAL HAIRSTYLIST. Any person, other than a
305305 student, who performs natural hair styling on the general
306306 public for compensation, and who shall satisfy the
307307 qualifications and licensure requirements provided in this
308308 article for a natural hairstylist.
309309 (21)(24) SCHOOL. An establishment licensed or
310310 registered by the board to teach any or all of the practices
311311 of barbering or cosmetology.
312312 (22)(25) SHAMPOO ASSISTANT. Any person who is licensed
313313 to perform only the practices of shampooing, cleansing, or
314314 applying temporary weekly color rinses to the hair of the
315315 general public for compensation, and who shall satisfy the
316316 qualifications and licensure requirements provided in this
317317 article for a shampoo assistant.
318318 (23)(26) SHOP. Any place where barbering or cosmetology
319319 is practiced including, but not limited to, a mobile salon.
320320 Only a properly licensed person, who is not an apprentice or a
321321 student, may operate a shop.
322322 (24)(27) STUDENT. Any person who is engaged in learning
323323 any practice regulated by this article in a school licensed or
324324 registered pursuant to this article, and who, as part of the
325325 learning process, performs or assists in any practice
326326 regulated by this article under the immediate supervision of
327327 an instructor who is licensed pursuant to this article.
328328 (25)(28) THREADING. The practice of eyebrow removal
329329 with the use of a loop made of cotton or any other material.

360360 (26)(29) THREADER. Any person engaged in the practice
361361 of threading on the general public for compensation, and who
362362 shall satisfy the qualifications and licensure requirements
363363 provided in this article for a threader."
364364 "§34-7B-13
365365 This chapter does not apply to any of the following
366366 persons, activities, or services:
367367 (1) Service in the case of emergency or domestic
368368 upheaval, without compensation.
369369 (2) Licensed medical professionals operating within the
370370 scope of their normal practice.
371371 (3) Personnel of the United States armed services
372372 performing their ordinary duties.
373373 (4) Any public trade school or other public school or
374374 school program under the purview of the State Board of
375375 Education or a local board of education.
376376 (5) Any person who only occasionally dresses hair and
377377 receives no compensation therefor, or does any other act or
378378 thing mentioned in this chapter, without holding himself or
379379 herself out to the public as a provider of any practices
380380 defined in this chapter for compensation.
381381 (6) Departments in retail establishments where
382382 cosmetics are demonstrated and offered for sale but where no
383383 other acts of cosmetology or barbering are performed.
384384 (7) The licensees of any county or municipal barber
385385 board or commission in existence on August 1, 2013, unless
386386 such board or commission elects, by resolution adopted by the
387387 governing body of the county or municipality, to come under

417417 governing body of the county or municipality, to come under
418418 the provisions of this chapter.
419419 (8) Any person who practices as a Class 1 barber.
420420 (9) Any person who works exclusively under contract
421421 with the International Alliance of Theatrical Stage Employees
422422 (IATSE), or its successor organization. "

424424 (a) Threaders shall register with the board and pay an
425425 original license fee by January 28, 2014. Any person licensed
426426 pursuant to this section subsection shall be subject to this
427427 chapter and rules adopted by the board , including, but not
428428 limited to, shop requirements, sanitation procedures, and
429429 license renewal.
430430 (b) An esthetician/makeup artist shall register with
431431 the board and pay an original license fee commencing on
432432 October 1, 2025. Any person licensed pursuant to this
433433 subsection shall be subject to this chapter and rules adopted
434434 by the board including, but not limited to, shop requirements,
435435 sanitation procedures, and license renewal. "
436436 Section 2. Section 34-7B-22.1 is added to the Code of
437437 Alabama 1975, to read as follows:
438438 §34-7B-22.1
439439 (a) No person may be admitted to an examination or
440440 licensed as an esthetician/makeup artist unless he or she
441441 holds a license as an esthetician and has successfully
442442 completed at least 500 clock hours of skin care fundamentals
443443 instruction in a licensed or registered school of cosmetology
444444 or 500 clock hours of skin care fundamentals instruction in a
445445 licensed or registered school of esthetics under this chapter.

476476 (b) Any applicant who satisfies the qualifications in
477477 subsection (a), pays any applicable examination fee,
478478 successfully completes the examination, and pays the license
479479 fee shall be issued an esthetician/makeup artist license.
480480 Section 3. This act shall become effective on June 1,
