1717 SYNOPSIS:
1818 Under existing law, human trafficking in the
1919 second degree is a Class B felony.
2020 This bill would provide that knowingly
2121 advertising, either online or in print, access to the
2222 sexual or labor servitude of another is human
2323 trafficking in the second degree.
2424 This bill would also make nonsubstantive,
2525 technical revisions to update the existing code
2626 language to current style.

3030 Relating to crimes and offenses; to amend Section
3131 13A-6-153, Code of Alabama 1975; to further provide for the
3232 crime of human trafficking in the second degree; and to make
3333 nonsubstantive, technical revisions to update the existing
3434 code language to current style.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

6868 "ยง13A-6-153
6969 (a) A person commits the crime of human trafficking in
7070 the second degree if:
7171 (1) A person He or she knowingly benefits, financially
7272 or by receiving anything of value, from participation in a
7373 venture or engagement for the purpose of sexual servitude or
7474 labor servitude.
7575 (2) A person He or she knowingly recruits, entices,
7676 solicits, induces, harbors, transports, holds, restrains,
7777 provides, maintains, subjects, or obtains by any means another
7878 person for the purpose of labor servitude or sexual servitude.
7979 (3) He or she knowingly advertises, either online or in
8080 print, access to the sexual or labor servitude of another.
8181 (3)(b) A corporation, or any other legal entity other
8282 than an individual, may be prosecuted for human trafficking in
8383 the second degree for an act or omission only if an agent of
8484 the corporation or entity performs the conduct which is an
8585 element of the crime while acting within the scope of his or
8686 her office or employment and on behalf of the corporation or
8787 entity, and the commission of the crime was either authorized,
8888 requested, commanded, performed, or within the scope of the
8989 person's employment on behalf of the corporation or entity or
9090 constituted a pattern of conduct that an agent of the
9191 corporation or entity knew or should have known was occurring.
9292 (4)(c) Any person who obstructs, or attempts to
9393 obstruct, or in any way interferes with or prevents the
9494 enforcement of this section shall be guilty of a Class B
9595 felony.
