17+SYNOPSIS:
18+This bill would require an unexpired
19+manufacturer's warranty on a heating, ventilation, and
20+air-conditioning system to be transferred to any new
21+owner upon the conveyance of the associated real
22+property.

1925 AN ACT
2026 Relating to consumer protection; to regulate the
2127 transfer of unexpired manufacturer's warranties on heating,
2228 ventilation, and air-conditioning systems with the associated
2329 real property.
2430 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
25-Section 1. (a) As used in this section, the following
26-terms have the following meanings:
27-(1) HVAC SYSTEM. A heating, ventilation, and air
28-conditioning system.
29-(2) MANUFACTURER'S WARRANTY. The original equipment
30-manufacturer's unregistered, initial, or base term warranty to
31-repair, service, or replace a component or a part of the HVAC
32-system that automatically accompanies the HVAC system at the
33-time of purchase, through no further action of the owner. The
34-term does not include any coverage extended beyond the
35-unregistered, initial term or base warranty.
36-(3) RESIDENTIAL REAL PROPERTY. Any of the following:
37-a. A single-family house.
38-b. A duplex, triplex, or quadraplex.
39-c. A unit in a multi-unit residential structure in

33+system as a fixture to the property is conveyed to a new owner
34+on or after October 1, 2025, a manufacturer's warranty in
35+effect on that system or a component of that system:
36+(1) Is automatically transferred to the new owner; and
37+(2) Continues in effect as if the new owner was the
38+original purchaser of such system or component, as applicable.

69-c. A unit in a multi-unit residential structure in
70-which title to an individual unit is transferred to the owner
71-of the unit under a condominium or cooperative system.
72-(b) If a residential real property that includes an
73-HVAC system as a fixture to the property is conveyed to a new
74-owner on or after October 1, 2025, a manufacturer's warranty
75-in effect on that system or a component of that system:
76-(1) Is automatically transferred to the new owner; and
77-(2) Continues in effect as if the new owner was the
7868 original purchaser of such system or component, as applicable.
79-(c) A warrantor continues to be obligated under the

8070 terms of a manufacturer's warranty agreement for a warranty
8171 transferred under this section and may not charge a fee for

83-(d) The transfer of a manufacturer's warranty under

76+(d) A manufacturer's warranty of an HVAC system or a
77+component of the system may not in any way be conditioned upon

8679 (e) This section applies if:
8780 (1) A sale of a residential property that includes an
8881 HVAC system as a fixture to the property occurs on or after
89-October 1, 2025;
82+October 1, 2025; and
9083 (2) A manufacturer's warranty is still in effect on the
91-HVAC system or a component of the system; and
92-(3) A warranty agreement was entered into or renewed on
93-or after October 1, 2025. A warranty agreement entered into or
94-renewed before October 1, 2025, is governed by the law in
95-effect on the date the agreement was entered into or renewed,
96-and the former law is continued in effect for that purpose.

9785 Section 2. This act shall become effective on October
