1515 SYNOPSIS:
1616 This bill would establish the crime of mail
1717 theft, which is committed when a person takes mail
1818 addressed to another person from the addressee's
1919 mailbox or other premises without the effective consent
2020 of the addressee and with the intent to deprive the
2121 addressee of the mail.
2222 This bill would establish criminal penalties for
2323 a violation based on the amount of mail stolen.
2424 This bill would establish heightened criminal
2525 penalties if the defendant committed the mail theft
2626 with the intent to obtain personally identifing
2727 information to defraud the victim.

3030 AN ACT
3131 Relating to crimes and offenses; to establish the crime
3232 of mail theft; and to provide criminal penalties for
3333 violations.
3434 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3535 Section 1. (a) As used in this section, the following
3636 terms have the following meanings:

6666 terms have the following meanings:
6767 (1) MAIL. A letter, postcard, package, bag, or other
6868 sealed article to which either of the following apply:
6969 a. Is delivered by the United States Postal Service, a
7070 common carrier, or a delivery service and has not yet been
7171 received by the person to whom it is addressed.
7272 b. Has been left in a location for delivery by the
7373 United States Postal Service, a common carrier, or a delivery
7474 service.
7575 (2) SENSITIVE PERSONALLY IDENTIFYING INFORMATION. The
7676 term as defined under Section 8-38-2, Code of Alabama 1975.
7777 (b) A person commits the crime of mail theft if both of
7878 the following occur:
7979 (1) The person takes mail addressed to another person
8080 from the addressee's mailbox or other premises.
8181 (2) The person acts without the effective consent of
8282 the addressee and with the intent to deprive the addressee of
8383 the mail.
8484 (c)(1) Except as otherwise provided in this subsection,
8585 mail theft is a Class A misdemeanor.
8686 (2) Mail theft is a Class D felony if mail is
8787 unlawfully taken from 10-29 addresses.
8888 (3) Mail theft is a Class C felony if mail is
8989 unlawfully taken from 30 or more addresses.
9090 (d) If it is established that a person committed mail
9191 theft under subsection (b) with the intent to obtain the
9292 sensitive personally identifying information to defraud the
9393 addressee, the person shall be punished as follows:

124124 (1) If mail is unlawfully taken from less than 10
125125 addresses, the person shall be guilty of a Class C felony.
126126 (2) If mail is unlawfully taken from more than 10 or
127127 more addresses, the person shall be guilty of a Class B
128128 felony.
129129 Section 2. This act shall become effective on October
130130 1, 2025.
