18 | 18 | | Existing law requires businesses that sell |

19 | 19 | | alcoholic beverages to train their employees under the |
---|
20 | 20 | | Alcoholic Beverage Control Board's Responsible Vendor |
---|
21 | 21 | | Program. The law further provides that the course of |
---|
22 | 22 | | instruction and test may be given online. |
---|
23 | 23 | | This bill would further implement the law by |
---|
24 | 24 | | directing the board to adopt rules that recognize and |
---|
25 | 25 | | enable vendors to conduct the program online. This |
---|
26 | 26 | | bill provides that an employee who scores 70 percent |
---|
27 | 27 | | or higher on the test has successfully completed the |
---|
28 | 28 | | course. |
---|
29 | 29 | | This bill further provides that if the board |
---|
30 | 30 | | fails to adopt the rules within four months of the |
---|
31 | 31 | | bill's enactment, the board will lose its |
---|
32 | 32 | | authorization to operate retail liquor stores. |

91 | 91 | | for on-premises or off-premises consumption. |

---|

129 | 129 | | (2) Require each employee who is authorized to sell |

130 | 130 | | alcoholic beverages in the normal course of his or her |
---|
131 | 131 | | employment to complete the employee training course of |
---|
132 | 132 | | instruction set out in subdivision (1) and to achieve a |
---|
133 | 133 | | passing grade of 70 percent or higher on a test of the course |

134 | 134 | | subjects within 30 days of commencing employment. Responsible |
---|
135 | 135 | | vendor training or testing may be conducted online by |
---|
136 | 136 | | computer, in a classroom, or by live trainers. Any online |
---|
137 | 137 | | training must include employee testing to pass. Nothing in |
---|
138 | 138 | | this subdivision shall be construed to require an in-person |
---|
139 | 139 | | test administrator or proctor. |
---|
140 | 140 | | (3) Require all trained employees to attend additional |
---|
141 | 141 | | meetings at least semiannually or such other schedule of |
---|
142 | 142 | | meetingson another periodic basis as may be approved by the |
---|
143 | 143 | | board, by rule, which meetings shall include the dissemination |
---|
144 | 144 | | of existing and new information presentation of additional |
---|
145 | 145 | | information covering the applicable subjects specified in this |
---|
146 | 146 | | section and explainingan explanation of the vendor's policies |
---|
147 | 147 | | and procedures relating to those subjects. |
---|
148 | 148 | | (4) Maintain employment records of the training of its |
---|
149 | 149 | | employees required by this section . The records, which may be |
---|
150 | 150 | | maintainedkept in a digital format , provided the records |
---|
151 | 151 | | maycan be produced within 48 hours at the request of the |
---|

192 | 192 | | b. Post-testing review of the subjects covered on the |
---|

194 | 194 | | (c)(1) No later than 120 days from the effective date |
---|
195 | 195 | | of this act, the board shall certify rules consistent with the |
---|
196 | 196 | | requirements of this act, including rules providing for both |
---|

199 | 199 | | (2) If the board fails to certify rules by the 120th |
