1717 SYNOPSIS
1818 Existing law requires businesses that sell
1919 alcoholic beverages to train their employees under the
2020 Alcoholic Beverage Control Board's Responsible Vendor
2121 Program. The law further provides that the course of
2222 instruction and test may be given online.
2323 This bill would further implement the law by
2424 directing the board to adopt rules that recognize and
2525 enable vendors to conduct the program online. This
2626 bill provides that an employee who scores 70 percent
2727 or higher on the test has successfully completed the
2828 course.
2929 This bill further provides that if the board
3030 fails to adopt the rules within four months of the
3131 bill's enactment, the board will lose its
3232 authorization to operate retail liquor stores.
3333 This bill would also delete duplicative
3434 language and make nonsubstantive, technical revisions
3535 to update the existing code language to current style.

6969 Relating to the Alcoholic Beverage Control Board; to
7070 amend Section 28-10-6, Code of Alabama 1975, to further
7171 provide for the Responsible Vendor Program by setting a
7272 passing grade for vendor employees who are tested on program
7373 course material; to implement vendor training and testing
7474 online by establishing a deadline for the Alcoholic Beverage
7575 Control Board to adopt rules for online training and testing;
7676 to revoke the authority of the board to operate any liquor
7777 stores for failure to adopt the rules; and to make
7878 nonsubstantive, technical revisions to update the existing
7979 code language to current style.
8080 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8181 Section 1. Section 28-10-6, Code of Alabama 1975, is
8282 amended to read as follows:
8383 "ยง28-10-6
8484 (a) In order to qualify for certification, the vendor
8585 shall comply with the following requirements:
8686 (1) Provide a course of instruction for its employees
8787 approved by the board which shall include subjects dealing
8888 with alcoholic beverages as follows:
8989 a. Laws regarding the sale of alcoholic beverages for
9090 on-the-premises consumption and/or for off-the-premises sale
9191 for on-premises or off-premises consumption.
9292 b. Methods of recognizing and dealing with underage
9393 customers.
9494 c. The development of specific procedures Procedures for

124124 c. The development of specific procedures Procedures for
125125 refusing sale to sell alcoholic beverages to underage
126126 customers, ; for assisting employees in dealing with underage
127127 customers;, and for dealing with handling intoxicated
128128 customers.
129129 (2) Require each employee who is authorized to sell
130130 alcoholic beverages in the normal course of his or her
131131 employment to complete the employee training course of
132132 instruction set out in subdivision (1) and to achieve a
133133 passing grade of 70 percent or higher on a test of the course
134134 subjects within 30 days of commencing employment. Responsible
135135 vendor training or testing may be conducted online by
136136 computer, in a classroom, or by live trainers. Any online
137137 training must include employee testing to pass. Nothing in
138138 this subdivision shall be construed to require an in-person
139139 test administrator or proctor.
140140 (3) Require all trained employees to attend additional
141141 meetings at least semiannually or such other schedule of
142142 meetingson another periodic basis as may be approved by the
143143 board, by rule, which meetings shall include the dissemination
144144 of existing and new information presentation of additional
145145 information covering the applicable subjects specified in this
146146 section and explainingan explanation of the vendor's policies
147147 and procedures relating to those subjects.
148148 (4) Maintain employment records of the training of its
149149 employees required by this section . The records, which may be
150150 maintainedkept in a digital format , provided the records
151151 maycan be produced within 48 hours at the request of the
152152 board.

183183 (5) Post signs on the vendor's premises informing
184184 customers of the vendor's policy against selling alcoholic
185185 beverages to underaged persons underage customers.
186186 (b)(1) Responsible vendor training and testing may be
187187 conducted online by computer or in person by instructors.
188188 (2) Nothing in this section shall be construed to
189189 require the following:
190190 a. The presence of an administrator or proctor during
191191 testing, whether online or in person.
192192 b. Post-testing review of the subjects covered on the
193193 examination.
194194 (c)(1) No later than 120 days from the effective date
195195 of this act, the board shall certify rules consistent with the
196196 requirements of this act, including rules providing for both
197197 the presentation of the course of instruction and testing
198198 online by vendors.
199199 (2) If the board fails to certify rules by the 120th
200200 day from the effective date of this act as required under
201201 subdivision (1), the board may no longer operate any liquor
202202 store as defined in Section 28-3-1 ."
203203 Section 2. This act shall become effective
