1515 SYNOPSIS:
1616 Under existing law, beginning in February 2025,
1717 the board of registrars or the Secretary of State must
1818 use change-of-address information supplied by the
1919 United States Postal Service through the National
2020 Change of Address database and at least one other voter
2121 registration database, such as the Electronic
2222 Registration Information Center, to identify registered
2323 voters whose addresses may have changed.
2424 This bill would remove the Electronic
2525 Registration Information Center as a voter registration
2626 database that the board of registrars or the Secretary
2727 of State may use to identify voters whose addresses may
2828 have changed.

6868 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6969 Section 1. Section 17-4-30, Code of Alabama 1975, is
7070 amended to read as follows:
7171 "ยง17-4-30
7272 (a) Beginning in February 2025, and in February of
7373 every fourth year thereafter, the board of registrars, or the
7474 Secretary of State , if acting as the board's agent pursuant to
7575 subsection (h), shall use change-of-address information
7676 supplied by the United States Postal Service through the
7777 National Change of Address database and by at least one other
7878 voter registration database, including, but not limited to,
7979 the Electronic Registration Information Center or NVRA a
8080 National Voter Registration Act designated agency, to identify
8181 registered voters whose addresses may have changed.
8282 (b)(1) If the board of registrars or Secretary of State
8383 determines from the change-of-address information that a
8484 registered voter has moved to a different residence address
8585 that is under the jurisdiction of the same board of
8686 registrars, the board of registrars shall change the
8787 registration records of that voter to show the new address,
8888 and the board of registrars or Secretary of State, within 90
8989 days after identifying the potential change, shall send the
9090 voter a notice of the change by forwardable mail along with a
9191 postage prepaid, pre-addressed return card on which the
9292 registered voter may correct his or her current address
9393 information. The notice shall inform the voter that if the
9494 voter did not change his or her residence, he or she is

124124 voter did not change his or her residence, he or she is
125125 required to return the pre-addressed card no later than the
126126 last day to register to vote before an election.
127127 (2) If the board of registrars or Secretary of State
128128 determines from the change-of-address information that a
129129 registered voter has moved to a different residence address
130130 that is under the jurisdiction of a different board of
131131 registrars or to a residence address outside of the state, the
132132 board of registrars or Secretary of State, within 90 days
133133 after identifying the potential change, shall send the voter a
134134 notice of the change by forwardable mail along with a postage
135135 prepaid, pre-addressed return card on which the registered
136136 voter may verify or correct his or her current address
137137 information. The notice shall include both of the following:
138138 a. A statement informing the voter that if the
139139 pre-addressed card is not returned within the time specified
140140 in the notice, the voter will be permitted to vote in that
141141 same jurisdiction during the period from the date the notice
142142 was mailed and ending on the day after the date of the second
143143 general election for federal office, provided the voter
144144 completes a voter registration update form. If the voter does
145145 not update his or her voter registration record or vote during
146146 the period ending on the day after the date of the second
147147 general election for federal office, the voter's name shall be
148148 removed from the list of eligible voters.
149149 b. Information concerning how the voter may continue
150150 his or her eligibility to vote in another jurisdiction if the
151151 voter has changed his or her residence to an address outside
152152 of the jurisdiction of the board of registrars under which he

182182 of the jurisdiction of the board of registrars under which he
183183 or she is then registered.
184184 (c) The board of registrars or Secretary of State shall
185185 record and maintain in the statewide voter registration
186186 database the dates on which the notice is mailed to a
187187 registered voter and the card is subsequently returned to the
188188 board by the registered voter.
189189 (d) The board of registrars shall update the statewide
190190 voter registration database using the information reported to
191191 the board by the registered voters on the prepaid,
192192 pre-addressed return cards provided for in this section.
193193 (e) If the registered voter does not respond to the
194194 notice provided in this section within 90 days of the date on
195195 which the notice was mailed or if the notice is returned to
196196 the board of registrars as undeliverable, the board of
197197 registrars or its agent shall change the status of the voter
198198 to inactive and indicate in the statewide voter registration
199199 database the date the change is recorded and that the voter
200200 did not respond to the mailing or that the mailing was
201201 returned as undeliverable, in a manner provided by rule by the
202202 Secretary of State.
203203 (f) The names of persons to be removed from the list of
204204 registered voters pursuant to this section shall be published
205205 in accordance with Section 17-4-10.
206206 (g) The Secretary of State may adopt rules as necessary
207207 to implement this section.
208208 (h) The Secretary of State may act as an agent for a
209209 board of registrars, only upon receiving the written consent
210210 of the county commission, in implementing this section."
