16	16	Under existing law, beginning in February 2025,
17	17	the board of registrars or the Secretary of State must
18	18	use change-of-address information supplied by the
19	19	United States Postal Service through the National
20	20	Change of Address database and at least one other voter
21	21	registration database, such as the Electronic
22	22	Registration Information Center, to identify registered
23	23	voters whose addresses may have changed.
24	24	This bill would remove the Electronic
25	25	Registration Information Center as a voter registration
26	26	database that the board of registrars or the Secretary
27	27	of State may use to identify voters whose addresses may
28	28	have changed.

68	68	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
69	69	Section 1. Section 17-4-30, Code of Alabama 1975, is
70	70	amended to read as follows:
71	71	"§17-4-30
72	72	(a) Beginning in February 2025, and in February of
73	73	every fourth year thereafter, the board of registrars, or the
74	74	Secretary of State , if acting as the board's agent pursuant to
75	75	subsection (h), shall use change-of-address information
76	76	supplied by the United States Postal Service through the
77	77	National Change of Address database and by at least one other
78	78	voter registration database, including, but not limited to,
79	79	the Electronic Registration Information Center or NVRA a
80	80	National Voter Registration Act designated agency, to identify
81	81	registered voters whose addresses may have changed.
82	82	(b)(1) If the board of registrars or Secretary of State
83	83	determines from the change-of-address information that a
84	84	registered voter has moved to a different residence address
85	85	that is under the jurisdiction of the same board of
86	86	registrars, the board of registrars shall change the
87	87	registration records of that voter to show the new address,
88	88	and the board of registrars or Secretary of State, within 90
89	89	days after identifying the potential change, shall send the
90	90	voter a notice of the change by forwardable mail along with a
91	91	postage prepaid, pre-addressed return card on which the
92	92	registered voter may correct his or her current address
93	93	information. The notice shall inform the voter that if the
94	94	voter did not change his or her residence, he or she is

124	124	voter did not change his or her residence, he or she is
125	125	required to return the pre-addressed card no later than the
126	126	last day to register to vote before an election.
127	127	(2) If the board of registrars or Secretary of State
128	128	determines from the change-of-address information that a
129	129	registered voter has moved to a different residence address
130	130	that is under the jurisdiction of a different board of
131	131	registrars or to a residence address outside of the state, the
132	132	board of registrars or Secretary of State, within 90 days
133	133	after identifying the potential change, shall send the voter a
134	134	notice of the change by forwardable mail along with a postage
135	135	prepaid, pre-addressed return card on which the registered
136	136	voter may verify or correct his or her current address
137	137	information. The notice shall include both of the following:
138	138	a. A statement informing the voter that if the
139	139	pre-addressed card is not returned within the time specified
140	140	in the notice, the voter will be permitted to vote in that
141	141	same jurisdiction during the period from the date the notice
142	142	was mailed and ending on the day after the date of the second
143	143	general election for federal office, provided the voter
144	144	completes a voter registration update form. If the voter does
145	145	not update his or her voter registration record or vote during
146	146	the period ending on the day after the date of the second
147	147	general election for federal office, the voter's name shall be
148	148	removed from the list of eligible voters.
149	149	b. Information concerning how the voter may continue
150	150	his or her eligibility to vote in another jurisdiction if the
151	151	voter has changed his or her residence to an address outside
152	152	of the jurisdiction of the board of registrars under which he

182	182	of the jurisdiction of the board of registrars under which he
183	183	or she is then registered.
184	184	(c) The board of registrars or Secretary of State shall
185	185	record and maintain in the statewide voter registration
186	186	database the dates on which the notice is mailed to a
187	187	registered voter and the card is subsequently returned to the
188	188	board by the registered voter.
189	189	(d) The board of registrars shall update the statewide
190	190	voter registration database using the information reported to
191	191	the board by the registered voters on the prepaid,
192	192	pre-addressed return cards provided for in this section.
193	193	(e) If the registered voter does not respond to the
194	194	notice provided in this section within 90 days of the date on
195	195	which the notice was mailed or if the notice is returned to
196	196	the board of registrars as undeliverable, the board of
197	197	registrars or its agent shall change the status of the voter
198	198	to inactive and indicate in the statewide voter registration
199	199	database the date the change is recorded and that the voter
200	200	did not respond to the mailing or that the mailing was
201	201	returned as undeliverable, in a manner provided by rule by the
202	202	Secretary of State.
203	203	(f) The names of persons to be removed from the list of
204	204	registered voters pursuant to this section shall be published
205	205	in accordance with Section 17-4-10.
206	206	(g) The Secretary of State may adopt rules as necessary
207	207	to implement this section.
208	208	(h) The Secretary of State may act as an agent for a
209	209	board of registrars, only upon receiving the written consent
210	210	of the county commission, in implementing this section."
