16	16	Existing law authorizes the Alabama State Law
17	17	Enforcement Agency to issue driver licenses to foreign
18	18	nationals.
19	19	This bill would provide that a foreign national
20	20	driver license may not be used for purposes of
21	21	providing valid photo identification when voting.
22	22	A BILL
23	23	TO BE ENTITLED
24	24	AN ACT
25	25	Relating to foreign national driver licenses; to amend
26	26	Section 32-6-10.1, Code of Alabama 1975, to provide that
27	27	foreign national driver licenses may not be used as photo
28	28	identification for voting purposes.
29	29	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
30	30	Section 1. Section 32-6-10.1, Code of Alabama 1975, is
31	31	amended to read as follows:
32	32	"§32-6-10.1
33	33	(a) For the purposes of this section, the following
34	34	terms have the following meanings:
35	35	(1) FOREIGN NATIONAL. An individual who is not a
36	36	citizen of the United States.

67	67	(2) LICENSE. An Alabama driver license, non-driver
68	68	identification card, or vessel license.
69	69	(b) The application for a license to be issued to a
70	70	foreign national shall contain, in addition to the information
71	71	on the established application, the applicant's country of
72	72	origin and the expiration date of the acceptable form of
73	73	immigration documentation as outlined in this section.
74	74	(c) Applications for a foreign national license shall
75	75	be processed only at driver license offices designated by the
76	76	Secretary of the Alabama State Law Enforcement Agency.
77	77	(d) The license issued to a foreign national shall
78	78	include a designation that the license is issued to a foreign
79	79	national in a manner set forth by the Secretary of the Alabama
80	80	State Law Enforcement Agency on the license. The designation
81	81	shall distinguish between foreign nationals with lawful
82	82	permanent residence in the United States and foreign nationals
83	83	whose authorized period of stay in the United States is
84	84	temporary.
85	85	(e) The license issued to a foreign national shall
86	86	expire on the date of the expiration of the acceptable form of
87	87	immigration documentation provided at the time of application.
88	88	(f) In order for a foreign national to renew his or her
89	89	license, the applicant must re-initiate the licensing process
90	90	in the same manner as a first-time applicant.
91	91	(g) Under no circumstances shall the agency issue a
92	92	license for a period of less than 30 days.
93	93	(h) A license issued pursuant to this section may not
94	94	be presented or accepted for purposes of complying with

125	125	Section 17-9-30.
126	126	(h)(i) The Secretary of the Alabama State Law
127	127	Enforcement Agency shall adopt rules concerning the
128	128	enforcement of this section."
