18 | 18 | | This bill would prohibit law enforcement |

19 | 19 | | officers from using the four-point restraint, also |

20 | 20 | | known as the hog-tie position, to restrain an |

22 | 22 | | This bill would require law enforcement agencies |

23 | 23 | | to adopt policies and procedures prohibiting the use of |

24 | 24 | | the four-point restraint. |

25 | 25 | | This bill would also provide criminal penalties |

30 | 30 | | Relating to law enforcement; to prohibit the use of |
---|
31 | 31 | | certain techniques by law enforcement officers; to require law |
---|
32 | 32 | | enforcement agencies to adopt certain policies and procedures; |
---|
33 | 33 | | and to provide criminal penalties for violations. |

34 | 34 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

35 | 35 | | Section 1. (a) For the purposes of this section, the |
---|
36 | 36 | | following terms have the following meanings: |
---|
37 | 37 | | (1) FOUR-POINT RESTRAINT. To restrain or confine an |
---|
38 | 38 | | individual face-down on the ground by connecting or fastening |
---|

72 | 72 | | (3) LAW ENFORCEMENT OFFICER. As defined in Section |
---|
73 | 73 | | 36-21-40, Code of Alabama 1975. |
---|
74 | 74 | | (b) A law enforcement officer shall not do either of |
---|
75 | 75 | | the following: |
---|
76 | 76 | | (1) Use a four-point restraint to detain, restrain, or |
---|
77 | 77 | | transport any individual. |
---|
78 | 78 | | (2) Place any individual in a face down position that |
---|
79 | 79 | | restricts oxygen or blood flow to the individual's head or |
---|
80 | 80 | | neck. |
---|
81 | 81 | | (c) Each law enforcement agency shall include a |
---|
82 | 82 | | prohibition against the use of four-point restraint in the |
---|
83 | 83 | | agency's existing policies and procedures. |
---|
84 | 84 | | (d) The use of four-point restraint in violation of |
---|
85 | 85 | | this section is a Class A misdemeanor. |
---|
86 | 86 | | Section 2. This act shall become effective on October |
---|
87 | 87 | | 1, 2025. |
