1717 SYNOPSIS:
1818 Under existing law, the Governor is authorized
1919 to appoint an individual to fill a vacancy in the
2020 office of Attorney General, State Auditor, Secretary of
2121 State, State Treasurer, and Commissioner of Agriculture
2222 and Industries.
2323 This bill would propose an amendment to the
2424 Constitution of Alabama of 2022, to authorize the
2525 Governor to fill a vacancy in the office of Lieutenant
2626 Governor.

2929 AN ACT
3030 Proposing an amendment to Section 136 of the
3131 Constitution of Alabama of 2022, relating to the filling of
3232 vacancies by the Governor; to authorize the Governor to
3333 appoint an individual to fill a vacancy in the office of
3434 Lieutenant Governor.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3636 Section 1. The following amendment to the Constitution
3737 of Alabama of 2022, is proposed:

6868 PROPOSED AMENDMENT
6969 "Sec. 136
7070 Should the office of Lieutenant Governor,
7171 attorney-general, state auditor, secretary of state, state
7272 treasurer, or commissioner of agriculture and industries
7373 become vacant from any cause, the governor shall fill such
7474 vacancy until the disability is removed or a successor elected
7575 and qualified. In case any of said officers shall become of
7676 unsound mind, such unsoundness shall be ascertained by the
7777 supreme court upon the suggestion of the governor."
7878 Upon ratification of this constitutional amendment, the
7979 Code Commissioner shall number and place this amendment as
8080 appropriate in the constitution omitting this instructional
8181 paragraph and may make the following nonsubstantive revisions:
8282 change capitalization, hierarchy, spelling, and punctuation
8383 for purposes of style and uniformity; correct manifest
8484 grammatical, clerical, and typographical errors; revise
8585 internal or external citations and cross-references; harmonize
8686 language; and translate effective dates.
8787 END OF PROPOSED AMENDMENT
8888 Section 2. An election upon the proposed amendment
8989 shall be held in accordance with Sections 284 and 285 of the
9090 Constitution of Alabama of 2022, and the election laws of this
9191 state. The appropriate election official shall assign a ballot
9292 number for the proposed constitutional amendment on the
9393 election ballot and shall set forth the following description
9494 of the substance or subject matter of the proposed
9595 constitutional amendment:
9696 "Proposing an amendment to the Constitution of Alabama
