17	17	SYNOPSIS:
18	18	Under existing law, the Governor is authorized
19	19	to appoint an individual to fill a vacancy in the
20	20	office of Attorney General, State Auditor, Secretary of
21	21	State, State Treasurer, and Commissioner of Agriculture
22	22	and Industries.
23	23	This bill would propose an amendment to the
24	24	Constitution of Alabama of 2022, to authorize the
25	25	Governor to fill a vacancy in the office of Lieutenant
26	26	Governor.
27	27	A BILL
28	28	TO BE ENTITLED
29	29	AN ACT
30	30	Proposing an amendment to Section 136 of the
31	31	Constitution of Alabama of 2022, relating to the filling of
32	32	vacancies by the Governor; to authorize the Governor to
33	33	appoint an individual to fill a vacancy in the office of
34	34	Lieutenant Governor.
35	35	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
36	36	Section 1. The following amendment to the Constitution
37	37	of Alabama of 2022, is proposed:

69	69	"Sec. 136
70	70	Should the office of Lieutenant Governor,
71	71	attorney-general, state auditor, secretary of state, state
72	72	treasurer, or commissioner of agriculture and industries
73	73	become vacant from any cause, the governor shall fill such
74	74	vacancy until the disability is removed or a successor elected
75	75	and qualified. In case any of said officers shall become of
76	76	unsound mind, such unsoundness shall be ascertained by the
77	77	supreme court upon the suggestion of the governor."
78	78	Upon ratification of this constitutional amendment, the
79	79	Code Commissioner shall number and place this amendment as
80	80	appropriate in the constitution omitting this instructional
81	81	paragraph and may make the following nonsubstantive revisions:
82	82	change capitalization, hierarchy, spelling, and punctuation
83	83	for purposes of style and uniformity; correct manifest
84	84	grammatical, clerical, and typographical errors; revise
85	85	internal or external citations and cross-references; harmonize
86	86	language; and translate effective dates.
87	87	END OF PROPOSED AMENDMENT
88	88	Section 2. An election upon the proposed amendment
89	89	shall be held in accordance with Sections 284 and 285 of the
90	90	Constitution of Alabama of 2022, and the election laws of this
91	91	state. The appropriate election official shall assign a ballot
92	92	number for the proposed constitutional amendment on the
93	93	election ballot and shall set forth the following description
94	94	of the substance or subject matter of the proposed
95	95	constitutional amendment:
