1515 SYNOPSIS:
1616 This bill would establish the crime of
1717 aggressive driving, which is committed when a person
1818 operates a motor vehicle with the intent to annoy,
1919 harass, molest, intimidate, injure, or obstruct another
2020 person operating a motor vehicle, and commits an
2121 enumerated offense relating to the operation of a motor
2222 vehicle.
2323 This bill would also establish criminal
2424 penalties for a violation.

2727 AN ACT
2828 Relating to motor vehicles; to establish the crime of
2929 aggressive driving; and to provide a criminal penalty for a
3030 violation.
3131 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3232 Section 1. (a) A person commits the crime of aggressive
3333 driving if the operator of a motor vehicle, with the intent to
3434 annoy, harass, molest, intimidate, injure, or obstruct another
3535 person in a motor vehicle, the person does any of the
3636 following:

6767 (1) Strikes or attempts to strike another vehicle or
6868 otherwise cause another vehicle to leave the roadway.
6969 (2) Passes the person in a no-passing zone, in
7070 violation of Section 32-5A-86, Code of Alabama 1975.
7171 (3) Follows the person too closely, in violation of
7272 Section 32-5A-89, Code of Alabama 1975.
7373 (4) Throws any destructive or injurious material onto
7474 the highway, in violation of Section 32-5A-60, Code of Alabama
7575 1975.
7676 (5) Unlawfully overtakes the person on the left, in
7777 violation of Section 32-5A-82 or 32-5A-84, Code of Alabama
7878 1975.
7979 (6) Unlawfully travels below the minimum authorized
8080 speed, in violation of Section 32-5A-174, Code of Alabama
8181 1975.
8282 (7) Engages in reckless driving, in violation of
8383 Section 32-5A-190, Code of Alabama 1975.
8484 (8) Unlawfully remains in the leftmost lane for more
8585 than 1.5 miles without completely passing another vehicle, in
8686 violation of Section 32-5A-80(d), Code of Alabama 1975.
8787 (9) Brandishes a pistol or other firearm.
8888 (b) A person who commits the crime of aggressive
8989 driving shall be punished as follows:
9090 (1) On a first violation, the person shall be guilty of
9191 a Class A misdemeanor. In addition, the court shall forward a
9292 record of the conviction to the Secretary of the Alabama State
9393 Law Enforcement Agency and the secretary shall suspend the
9494 person's license for a period of not less than 30 days.

124124 person's license for a period of not less than 30 days.
125125 (2) On a second or subsequent conviction within a
126126 10-year period, the person shall be guilty of a Class D
127127 felony. In addition, the court shall forward a record of the
128128 conviction to the Secretary of the Alabama State Law
129129 Enforcement Agency and the secretary shall revoke the person’s
130130 license for a period of not less than one year pursuant to the
131131 procedures of Section 32-5A-195, Code of Alabama 1975.
132132 Section 2. This act shall become effective on October
133133 1, 2025.
