15	15	SYNOPSIS:
16	16	This bill would establish the crime of
17	17	aggressive driving, which is committed when a person
18	18	operates a motor vehicle with the intent to annoy,
19	19	harass, molest, intimidate, injure, or obstruct another
20	20	person operating a motor vehicle, and commits an
21	21	enumerated offense relating to the operation of a motor
22	22	vehicle.
23	23	This bill would also establish criminal
24	24	penalties for a violation.
25	25	A BILL
26	26	TO BE ENTITLED
27	27	AN ACT
28	28	Relating to motor vehicles; to establish the crime of
29	29	aggressive driving; and to provide a criminal penalty for a
30	30	violation.
31	31	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
32	32	Section 1. (a) A person commits the crime of aggressive
33	33	driving if the operator of a motor vehicle, with the intent to
34	34	annoy, harass, molest, intimidate, injure, or obstruct another
35	35	person in a motor vehicle, the person does any of the
36	36	following:

67	67	(1) Strikes or attempts to strike another vehicle or
68	68	otherwise cause another vehicle to leave the roadway.
69	69	(2) Passes the person in a no-passing zone, in
70	70	violation of Section 32-5A-86, Code of Alabama 1975.
71	71	(3) Follows the person too closely, in violation of
72	72	Section 32-5A-89, Code of Alabama 1975.
73	73	(4) Throws any destructive or injurious material onto
74	74	the highway, in violation of Section 32-5A-60, Code of Alabama
75	75	1975.
76	76	(5) Unlawfully overtakes the person on the left, in
77	77	violation of Section 32-5A-82 or 32-5A-84, Code of Alabama
78	78	1975.
79	79	(6) Unlawfully travels below the minimum authorized
80	80	speed, in violation of Section 32-5A-174, Code of Alabama
81	81	1975.
82	82	(7) Engages in reckless driving, in violation of
83	83	Section 32-5A-190, Code of Alabama 1975.
84	84	(8) Unlawfully remains in the leftmost lane for more
85	85	than 1.5 miles without completely passing another vehicle, in
86	86	violation of Section 32-5A-80(d), Code of Alabama 1975.
87	87	(9) Brandishes a pistol or other firearm.
88	88	(b) A person who commits the crime of aggressive
89	89	driving shall be punished as follows:
90	90	(1) On a first violation, the person shall be guilty of
91	91	a Class A misdemeanor. In addition, the court shall forward a
92	92	record of the conviction to the Secretary of the Alabama State
93	93	Law Enforcement Agency and the secretary shall suspend the
94	94	person's license for a period of not less than 30 days.

124	124	person's license for a period of not less than 30 days.
125	125	(2) On a second or subsequent conviction within a
126	126	10-year period, the person shall be guilty of a Class D
127	127	felony. In addition, the court shall forward a record of the
128	128	conviction to the Secretary of the Alabama State Law
129	129	Enforcement Agency and the secretary shall revoke the person’s
130	130	license for a period of not less than one year pursuant to the
131	131	procedures of Section 32-5A-195, Code of Alabama 1975.
132	132	Section 2. This act shall become effective on October
133	133	1, 2025.
