1515 SYNOPSIS:
1616 Certain psychoactive compounds, including
1717 delta-8-tetrahydrocannabinol (delta-8 THC),
1818 delta-9-tetrahydrocannabinol (Delta-9 THC), and
1919 delta-10-tetrahydrocannabinol (delta-10 THC) can be
2020 manufactured in concentrated amounts from hemp-derived
2121 cannabidiol (CBD).
2222 Under existing law, psychoactive cannabinoids
2323 may not be sold to minors and must be located in an
2424 area where minors cannot access the products.
2525 This bill would prohibit the sale of any
2626 beverage that contains any amount of psychoactive
2727 cannabinoids, except as permitted under the medical
2828 cannabis laws.
2929 This bill would also provide that delta-9-THC is
3030 specifically included in the definition of psychoactive
3131 cannabinoids for purposes of the law.

6666 the Code of Alabama 1975; to prohibit the sale of any
6767 beverages containing a psychoactive derivative of CBD, with
6868 exceptions; to provide for criminal penalties; and to amend
6969 Section 13A-12-214.4, Code of Alabama 1975, to specifically
7070 add delta-9 THC to the definition of "psychoactive
7171 cannabinoids."
7272 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7373 Section 1. Sections 13A-12-214.4 is amended to read as
7474 follows:
7575 "§13A-12-214.4
7676 (a) As used in this section, "psychoactive
7777 cannabinoids" means cannabinoids derived from or found in hemp
7878 as defined in Section 2-8-381, including, but not limited to,
7979 delta-8-tetrahydrocannabinol , delta-9-tetrahydrocannabinol,
8080 and delta-10-tetrahydrocannabinol.
8181 (b) Except as provided in Chapter 2A of Title 20,
8282 psychoactive cannabinoids shall not be sold, distributed, or
8383 marketed to, or possessed by an individual who is under 21
8484 years of age.
8585 (c) Any psychoactive cannabinoids lawfully sold in this
8686 state must be located in an area in which individuals under
8787 the age of 21 years of age are not permitted access.
8888 (d) Any person who sells, distributes, or markets
8989 psychoactive cannabinoids to individuals under 21 years of age
9090 shall be guilty of a Class B misdemeanor.
9191 (e) Any individual under 21 years of age who is in
9292 possession of psychoactive cannabinoids shall be issued a
9393 citation similar to a uniform nontraffic citation and shall be
9494 fined not less than fifty dollars ($50) nor more than two

124124 fined not less than fifty dollars ($50) nor more than two
125125 hundred dollars ($200) for each violation or community service
126126 in equal value of the fine and shall be assessed no other
127127 court costs or fees. In addition, on a third or subsequent
128128 conviction, including convictions in district court or
129129 municipal court, the individual shall be issued a citation
130130 similar to a uniform nontraffic citation and shall be fined
131131 four hundred dollars ($400) for each violation or community
132132 service in equal value of the fine.
133133 (f) Any psychoactive cannabinoids sold in this state
134134 shall be packaged in child-resistant containers."
135135 Section 2. Section 13A-12-214.5 is added to the Code of
136136 Alabama 1975, to read as follows:
137137 §13A-12-214.5
138138 (a) For purposes of this section, "psychoactive
139139 cannabinoids" has the same meaning as defined in Section
140140 13A-12-214.4.
141141 (b) Notwithstanding Section 13A-12-214.4 and except as
142142 provided in Chapter 2A of Title 20, no beverage containing any
143143 amount of psychoactive cannabinoids may be lawfully sold in
144144 this state.
145145 (c) Any person who sells, distributes, or markets a
146146 beverage containing psychoactive cannabinoids in violation of
147147 this section shall be guilty of a Class B misdemeanor.
148148 Section 3. This act shall become effective on October
149149 1, 2025.
