15	15	SYNOPSIS:
16	16	Certain psychoactive compounds, including
17	17	delta-8-tetrahydrocannabinol (delta-8 THC),
18	18	delta-9-tetrahydrocannabinol (Delta-9 THC), and
19	19	delta-10-tetrahydrocannabinol (delta-10 THC) can be
20	20	manufactured in concentrated amounts from hemp-derived
21	21	cannabidiol (CBD).
22	22	Under existing law, psychoactive cannabinoids
23	23	may not be sold to minors and must be located in an
24	24	area where minors cannot access the products.
25	25	This bill would prohibit the sale of any
26	26	beverage that contains any amount of psychoactive
27	27	cannabinoids, except as permitted under the medical
28	28	cannabis laws.
29	29	This bill would also provide that delta-9-THC is
30	30	specifically included in the definition of psychoactive
31	31	cannabinoids for purposes of the law.

34	34	AN ACT
35	35	Relating to cannabis; to add Section 13A-12-214.5 to
36	36	the Code of Alabama 1975; to prohibit the sale of any

66	66	the Code of Alabama 1975; to prohibit the sale of any
67	67	beverages containing a psychoactive derivative of CBD, with
68	68	exceptions; to provide for criminal penalties; and to amend
69	69	Section 13A-12-214.4, Code of Alabama 1975, to specifically
70	70	add delta-9 THC to the definition of "psychoactive
71	71	cannabinoids."
72	72	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
73	73	Section 1. Sections 13A-12-214.4 is amended to read as
74	74	follows:
75	75	"§13A-12-214.4
76	76	(a) As used in this section, "psychoactive
77	77	cannabinoids" means cannabinoids derived from or found in hemp
78	78	as defined in Section 2-8-381, including, but not limited to,
79	79	delta-8-tetrahydrocannabinol , delta-9-tetrahydrocannabinol,
80	80	and delta-10-tetrahydrocannabinol.
81	81	(b) Except as provided in Chapter 2A of Title 20,
82	82	psychoactive cannabinoids shall not be sold, distributed, or
83	83	marketed to, or possessed by an individual who is under 21
84	84	years of age.
85	85	(c) Any psychoactive cannabinoids lawfully sold in this
86	86	state must be located in an area in which individuals under
87	87	the age of 21 years of age are not permitted access.
88	88	(d) Any person who sells, distributes, or markets
89	89	psychoactive cannabinoids to individuals under 21 years of age
90	90	shall be guilty of a Class B misdemeanor.
91	91	(e) Any individual under 21 years of age who is in
92	92	possession of psychoactive cannabinoids shall be issued a
93	93	citation similar to a uniform nontraffic citation and shall be
94	94	fined not less than fifty dollars ($50) nor more than two

124	124	fined not less than fifty dollars ($50) nor more than two
125	125	hundred dollars ($200) for each violation or community service
126	126	in equal value of the fine and shall be assessed no other
127	127	court costs or fees. In addition, on a third or subsequent
128	128	conviction, including convictions in district court or
129	129	municipal court, the individual shall be issued a citation
130	130	similar to a uniform nontraffic citation and shall be fined
131	131	four hundred dollars ($400) for each violation or community
132	132	service in equal value of the fine.
133	133	(f) Any psychoactive cannabinoids sold in this state
134	134	shall be packaged in child-resistant containers."
135	135	Section 2. Section 13A-12-214.5 is added to the Code of
136	136	Alabama 1975, to read as follows:
137	137	§13A-12-214.5
138	138	(a) For purposes of this section, "psychoactive
139	139	cannabinoids" has the same meaning as defined in Section
140	140	13A-12-214.4.
141	141	(b) Notwithstanding Section 13A-12-214.4 and except as
142	142	provided in Chapter 2A of Title 20, no beverage containing any
143	143	amount of psychoactive cannabinoids may be lawfully sold in
144	144	this state.
145	145	(c) Any person who sells, distributes, or markets a
146	146	beverage containing psychoactive cannabinoids in violation of
147	147	this section shall be guilty of a Class B misdemeanor.
148	148	Section 3. This act shall become effective on October
149	149	1, 2025.
