1818 SYNOPSIS:
1919 Under existing law, the Alabama State Board of
2020 Veterinary Medical Examiners is authorized to regulate
2121 the practice of veterinary medicine in this state.
2222 This bill would prohibit a veterinarian from
2323 prescribing or dispensing any medication without a
2424 valid veterinarian-client-patient relationship.
2525 This bill would provide that a veterinarian-
2626 client-patient relationship created with one
2727 veterinarian exists among all other veterinarians
2828 practicing at the same location.
2929 This bill would further define what
3030 circumstances create a new veterinarian-client-patient
3131 relationship and would define the terms "client,"
3232 "patient," and "animal."
3333 This bill would provide a maximum amount of time
3434 within which a veterinarian may refill a prescription.
3535 This bill would also make nonsubstantive,
3636 technical revisions to update the existing code
3737 language to current style.

7171 Relating to veterinary medicine and the Alabama State
7272 Board of Veterinary Medical Examiners; to amend Section
7373 34-29-61, Code of Alabama 1975, to define the terms
7474 "veterinarian-client-patient relationship," "client,"
7575 "patient," and "animal"; to prohibit veterinarians from
7676 dispensing mediation without a veterinarian-client-patient
7777 relationship; to provide the amount of time within which a
7878 prescription may be refilled; to provide the
7979 veterinarian-client-patient relationship is shared among all
8080 veterinarians at a location; and to make nonsubstantive,
8181 technical revisions to update the existing code language to
8282 current style.
8383 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8484 Section 1. Section 34-29-61, Code of Alabama 1975, is
8585 amended to read as follows:
8686 "ยง34-29-61
8787 For the purposes of this article, the following terms
8888 shall have the following meanings ascribed by this section :
8989 (1) ACCREDITED SCHOOL OF VETERINARY MEDICINE. Any
9090 veterinary college or division of a university or college that
9191 offers the degree of doctor of veterinary medicine or its
9292 equivalent and is accredited by the American Veterinary
9393 Medical Association (AVMA).
9494 (2) ANIMAL. Any animal or mammal other than man,
9595 including birds, fish, reptiles, wild or domestic, member of
9696 the kingdom animalia other than humans, whether living or
9797 dead.

128128 (3) APPLICANT. A person who files an application to be
129129 licensed to practice veterinary medicine or licensed as a
130130 veterinary technician.
131131 (4) BOARD. Alabama State Board of Veterinary Medical
132132 Examiners.
133133 (5) CLIENT. A person who has entered into an agreement
134134 with a veterinarian for the purposes of obtaining veterinary
135135 medicine services in-person.
136136 (5)(6) CONSULTING VETERINARIAN. A veterinarian licensed
137137 in another state who gives advice or demonstrates techniques
138138 to a licensed Alabama veterinarian or group of licensed
139139 Alabama veterinarians. A consulting veterinarian shall may not
140140 utilize this privilege to circumvent the law.
141141 (6)(7) DIRECT SUPERVISION. The A supervising
142142 veterinarian has initially examined the animal and will
143143 examine at other times as acceptable veterinary medical
144144 practice requires, consistent with the particular delegated
145145 animal health care task. The supervising veterinarian is on
146146 the premises and is quickly and easily available.
147147 (7)(8) EMERGENCY. The An animal has been placed in a
148148 life threatening condition and immediate treatment is
149149 necessary to sustain life.
150150 (8)(9) FOREIGN VETERINARY GRADUATE, EXCLUDING CANADA.
151151 Any person, including a foreign national or an American
152152 citizen, who has received a professional veterinarian medical
153153 degree from an American Veterinary Medical Association listed
154154 veterinary college that is not accredited by the American
155155 Veterinary Medical Association.

185185 Veterinary Medical Association.
186186 (9)(10) IMMEDIATE SUPERVISION. The A supervising
187187 veterinarian is on the premises and in audible or visual range
188188 of the animal patient and the person treating the patient.
189189 (10)(11) INDIRECT SUPERVISION. The A supervising
190190 veterinarian has examined the animal and has given written or
191191 oral instructions for the treatment of the animal while the
192192 supervising veterinarian is away from the premises.
193193 (11)(12) LICENSE. Any permit, approval, registration,
194194 or certificate of qualification issued by the board.
195195 (12)(13) LICENSED VETERINARIAN. A person who is validly
196196 and currently licensed to practice veterinary medicine in
197197 Alabama.
198198 (13)(14) LICENSED VETERINARY TECHNICIAN. A person who
199199 is validly and currently licensed to practice as a veterinary
200200 technician in Alabama.
201201 (15) PATIENT. Any single animal or representative
202202 segment of a consignment or herd.
203203 (14)(16) PERSON. Any individual, firm, partnership,
204204 association, joint venture, cooperative, or corporation or any
205205 other group or combination acting in concert; and whether or
206206 not acting as a principal, trustee, fiduciary, receiver, or as
207207 any kind of legal or personal representative, or as the
208208 successor in interest, assigning agent, factor, servant,
209209 employee, director, officer, or any other representative of
210210 such person.
211211 (15)(17) PRACTICE OF VETERINARY MEDICINE:
212212 a. To diagnose, treat, correct, change, relieve, or
213213 prevent animal disease, deformity, defect, injury, or other

243243 prevent animal disease, deformity, defect, injury, or other
244244 physical or mental condition; including the prescription or
245245 administration of any drug, medicine, biologic, apparatus,
246246 application, anesthesia, or other therapeutic or diagnostic
247247 substance or technique on any animal , including, but not
248248 limited to, acupuncture, dentistry, animal psychology, animal
249249 chiropractic, theriogenology, surgery, including cosmetic
250250 surgery, any manual, mechanical, biological, or chemical
251251 procedure for testing for pregnancy or for correcting
252252 sterility or infertility, or to render service or
253253 recommendations with regard to any of the above.
254254 b. To represent directly or indirectly, publicly or
255255 privately, an ability and willingness to do any act described
256256 in paragraph a.
257257 c. To use any title, words, abbreviations, or letters
258258 in a manner or under circumstances which induce the belief
259259 that the person using them is qualified to do any act
260260 described in paragraph a. Such use shall be prima facie
261261 evidence of the intention to represent oneself as engaged in
262262 the practice of veterinary medicine.
263263 d. Collects To collect blood or other samples for the
264264 purpose of diagnosing disease or other conditions. This
265265 paragraph shall not apply to unlicensed personnel employed by
266266 the United States Department of Agriculture or the Alabama
267267 Department of Agriculture who are engaged in the Brucellosis
268268 eradication program or external parasite control program
269269 pursuant to Section 2-15-192.
270270 e. To remove any embryo from a food animal or companion
271271 animal for the purpose of transplanting the embryo into

301301 animal for the purpose of transplanting the embryo into
302302 another female animal or for the purpose of cryopreserving the
303303 embryo, or to implant the embryo into a food or companion
304304 animal. It shall not be considered the practice of veterinary
305305 medicine for a person or his or her full-time employees to
306306 remove an embryo from the food or companion animal of the
307307 person for the purpose of transplanting or cryopreserving the
308308 embryo, or to implant an embryo into the food or companion
309309 animal of the person, provided ownership of the food or
310310 companion animal shall not be transferred or employment of the
311311 person shall not be changed for the purpose of circumventing
312312 this article.
313313 f. To provide veterinary medical services to a client
314314 or patient in this state, through telephonic, electronic, or
315315 other means, regardless of the location of the veterinarian,
316316 shall constitute the practice of veterinary medicine in this
317317 state and shall require licensure within this state and a
318318 veterinarian-client-patient relationship must be established.
319319 (16)(18) SUPERVISING VETERINARIAN. A veterinarian who
320320 assumes responsibility for the professional care given to an
321321 animal by a person working under his or her direction.
322322 (17)(19) TEMPORARY LICENSE. Temporary permission to
323323 practice veterinary medicine issued by the board pursuant to
324324 this article.
325325 (18)(20) UNLICENSED ASSISTANT. Any individual who is
326326 not a licensed veterinary technician or veterinarian and is
327327 employed by a licensed veterinarian.
328328 (19)(21) VETERINARIAN-CLIENT-PATIENT RELATIONSHIP
329329 (VCPR). A relationship in which all of the following are

359359 (VCPR). A relationship in which all of the following are
360360 satisfied:
361361 a. when the A veterinarian has assumed responsibility
362362 for making medical judgments regarding the health of the
363363 animal or animals a patient and the need for medical treatment
364364 and is created by actual examination by the veterinarian of
365365 the animal or a representative segment of a consignment or
366366 herd the client has agreed to comply with the veterinarian's
367367 instructions.
368368 b. A veterinarian has physically examined a
369369 patient within the previous 12 months or more frequently as
370370 dictated by the age of the patient, medical condition of the
371371 patient, treatment therapy, or use of controlled substances.
372372 c. A veterinarian has sufficient knowledge of a patient
373373 to initiate a general or preliminary diagnosis of its medical
374374 condition.
375375 d. A veterinarian is personally acquainted with the
376376 keeping and care of a patient due to timely examination of the
377377 patient and timely visits by the veterinarian to the facility
378378 where the patient is managed by a veterinarian.
379379 e. A veterinarian is readily available for ongoing or
380380 follow-up evaluation and care of a patient or has arranged for
381381 emergency or continuing veterinary care and treatment of a
382382 patient by an appropriate veterinary professional.
383383 f. A veterinarian provides oversight of treatment,
384384 compliance, and outcome of a patient.
385385 g. A veterinarian maintains complete and legible
386386 medical records of a patient, including an assessment and
387387 treatment plan, in a manner that another veterinarian may

417417 treatment plan, in a manner that another veterinarian may
418418 proceed with continuity of care and treatment of the patient.
419419 h. A veterinarian-client-patient relationship is case
420420 specific and a new veterinarian-client-patient relationship
421421 shall be established for each new medical problem or
422422 diagnosis. A prescription may be refilled for 12 months after
423423 the initial prescription unless medically prohibited or
424424 restricted or prohibited by current law or rule. The
425425 veterinarian-client-patient relationship remains with the
426426 veterinarian who established the initial
427427 veterinarian-client-patient relationship and remains valid
428428 with other veterinarians within the practice premises where
429429 the medical records of the patient are kept. Another
430430 veterinarian in the practice where the initial
431431 veterinarian-client-patient relationship was established may
432432 refill an original prescription for a period of 12 months
433433 after the initial prescription. If the original prescription
434434 is altered in drug form, quantity, or dosage by another
435435 veterinarian associated with the practice, a new
436436 veterinarian-client-patient relationship shall be established.
437437 If a patient is hospitalized when changes in diagnosis or
438438 treatment are made, the changes shall be communicated to the
439439 client.
440440 i. A veterinarian is prohibited from prescribing or
441441 dispensing medications without a valid
442442 veterinarian-client-patient relationship.
443443 (20)(22) VETERINARIAN, DOCTOR OF VETERINARY MEDICINE,
444444 DVM, VMD, or EQUIVALENT TITLE. A person who has received a
445445 doctor's degree in veterinary medicine from an accredited

475475 doctor's degree in veterinary medicine from an accredited
476476 school of veterinary medicine or holds an Educational
477477 Commission for Foreign Veterinary Graduates (ECFVG)
478478 certificate issued by the American Veterinary Medical
479479 Association (AVMA).
480480 (21)(23) VETERINARY FACILITIES. Any place or unit from
481481 which the practice of veterinary medicine is conducted. The
482482 following are types of veterinary facilities:
483483 a. Veterinary or Animal Hospital or Clinic. Meets or
484484 exceeds all mandatory requirements as listed in the
485485 administrative code of the board for veterinary facilities. In
486486 doing so, it provides quality examination, diagnostic, and
487487 health maintenance services for medical and surgical treatment
488488 of animals and is equipped to provide housing and nursing care
489489 for the animals during illness or convalescence.
490490 b. Specialty Practice or Clinic. Provides complete
491491 specialty service by a veterinarian who has advanced training
492492 in that specialty and is a diplomat of an approved specialty
493493 college. It meets all minimum standards that are applicable to
494494 that specialty.
495495 c. Central Hospital. Shall meet all requirements of
496496 paragraph a., as well as provide specialized care including
497497 24-hour nursing care and specialty consultation on a permanent
498498 or on-call basis. It is mainly utilized on referral from area
499499 veterinary hospitals or clinics.
500500 d. Satellite, Outpatient, or Mobile Small Animal
501501 Clinics. A supportive facility owned by or associated with, or
502502 both, and has ready access to, within a reasonable distance, a
503503 full-service veterinary hospital or clinic or a central

533533 full-service veterinary hospital or clinic or a central
534534 hospital providing all mandatory services and meeting all
535535 minimum standards. The public shall be informed of the
536536 limitation of services by way of a posted notice in plain view
537537 and easily readable or by notice provided to the client by
538538 flyer or card which clearly specifies those mandatory
539539 veterinary medical services which are not provided. In
540540 addition, the main location and telephone number of the
541541 veterinary hospital or clinic providing the required service,
542542 as well as the signed agreement with the veterinary hospital
543543 or clinic shall also be posted in plain view and be easily
544544 readable. A veterinarian associated with this veterinary
545545 hospital or clinic shall be on call during and after operation
546546 of the satellite, outpatient, or mobile clinic to render aid
547547 if necessary. The personnel of satellite, outpatient, or
548548 mobile clinics shall consist of one or more veterinarians and
549549 auxiliary personnel necessary to provide adequate outpatient
550550 service. Operation of any satellite, outpatient, or mobile
551551 clinic shall be under the direct supervision of a licensed
552552 veterinarian who remains on the premises during the entire
553553 time of operation.
554554 e. Large Animal Mobile Clinic. Must provide
555555 examination, diagnostic, and preventive medicine, and minor
556556 surgical services for large animals not requiring confinement
557557 or hospitalization. Emergency service and radiology service
558558 shall be provided by that veterinarian or by written agreement
559559 with another veterinarian or group of veterinarians in
560560 practice in that locale. These clinics shall provide a degree
561561 of veterinary care compatible with the level of standards

592592 considered adequate to the practice of veterinary medicine
593593 currently available in the area. Complete hospital facilities
594594 may be provided by the nearest large animal hospital or
595595 veterinary school.
596596 f. Emergency Clinic. A facility established to receive
597597 patients and to treat illnesses and injuries of an emergency
598598 nature requiring treatment. The clinic shall provide
599599 professional diagnostic and emergency treatment during hours
600600 when local veterinary hospitals are normally closed. Emergency
601601 clinics shall meet all mandatory requirements of a veterinary
602602 hospital or clinic.
603603 (22)(24) VETERINARY INTERN. A person who is working
604604 towards completion of an ECFVG certificate and who is working
605605 under the direct or indirect supervision of a board approved
606606 licensed veterinarian in any state to complete the practical
607607 experience internship required for licensing in Alabama.
608608 (23)(25) VETERINARY MEDICINE. Includes veterinary
609609 surgery, theriogenology, dentistry, acupuncture, animal
610610 psychology, chiropractic, and all other branches or
611611 specialties of veterinary practice.
612612 (24)(26) VETERINARY STUDENT PRECEPTEE. A person who is
613613 pursuing a veterinary degree in an accredited school of
614614 veterinary medicine which has a preceptor or extern program
615615 and who has completed the academic requirements of the
616616 program.
617617 (25)(27) VETERINARY TECHNICIAN STUDENT. Any person
618618 enrolled in an AVMA accredited veterinary technology program;

649649 gaining clinical experience under the supervision of a
650650 licensed veterinarian or licensed veterinary technician in a
651651 clinical setting.
652652 (26)(28) VETERINARY TECHNOLOGY. The skills and
653653 knowledge accrued in a post-high school course of study,
654654 accredited by the AVMA Committee on Education (COE) or the
655655 board, in the area of care and treatment of animals. It
656656 embodies limited skills, responsibility, and minimal exercise
657657 of independent judgment in the treatment of patients of
658658 veterinarians while under direct, indirect, or immediate
659659 supervision of a veterinarian.
660660 (27)(29) WHOLESALE VETERINARY DRUG DISTRIBUTOR. A
661661 person engaged in the business of distributing veterinary
662662 drugs and medicines for resale to veterinary practitioners and
663663 other veterinary wholesalers and possesses a current permit
664664 issued by the Alabama Board of Pharmacy to engage in the
665665 selling of veterinary drugs or medicines in the State of
666666 Alabama."
667667 Section 2. This act shall become effective on October
668668 1, 2025.
