1515 SYNOPSIS:
1616 Under existing law, a person commits the crime
1717 of unlawful possession with intent to distribute a
1818 controlled substance if he or she knowingly possesses
1919 more than two grams, but less than four grams, of any
2020 mixture containing Fentanyl, any synthetic controlled
2121 substance Fentanyl, or any synthetic controlled
2222 substance Fentanyl analogue.
2323 This bill would provide that a person commits
2424 the crime of unlawful possession with intent to
2525 distribute a controlled substance if he or she
2626 knowingly possesses more than one-half gram, but less
2727 than one gram, of any mixture of Fentanyl and any
2828 synthetic controlled substance Fentanyl analogue, or
2929 any mixture of Fentanyl or any synthetic controlled
3030 substance Fentanyl analogue and the immediate Fentanyl
3131 precursor, 4-anilino-N-phenethyl-4-piperidine (ANPP).
3232 Under existing law, a person commits the crime
3333 of trafficking in illegal drugs if he or she is
3434 knowingly in actual or constructive possession of one
3535 gram or more of Fentanyl or any synthetic controlled
3636 substance Fentanyl analogue as a single component.
3737 This bill would provide that a person commits
3838 the crime of trafficking in illegal drugs if he or she
3939 is knowingly in actual or constructive possession of

7878 Relating to crimes and offenses; to amend Sections
7979 13A-12-211 and 13A-12-231, Code of Alabama 1975; to further
8080 provide for the crime of unlawful possession with intent to

8282 the crime of trafficking in illegal drugs.
8383 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8484 Section 1. Sections 13A-12-211 and 13A-12-231, Code of
8585 Alabama 1975, are amended to read as follows:
8686 "§13A-12-211
8787 (a) A person commits the crime of unlawful distribution
8888 of controlled substances if, except as otherwise authorized,
8989 he or she sells, furnishes, gives away, delivers, or
9090 distributes a controlled substance enumerated in Schedules I
9191 through V.
9292 (b) Unlawful distribution of controlled substances is a
9393 Class B felony.
9494 (c) A person commits the crime of unlawful possession

124124 (c) A person commits the crime of unlawful possession
125125 with intent to distribute a controlled substance if, except as
126126 otherwise authorized by law, he or she knowingly possesses any
127127 of the following quantities of a controlled substance:
128128 (1) More than eight grams, but less than 28 grams, of
129129 cocaine or of any mixture containing cocaine.
130130 (2) More than two grams, but less than four grams, of
131131 any mixture of morphine, opium, or any salt, isomer, or salt
132132 of an isomer thereof, including heroin or any mixture
133133 containing Fentanyl or any synthetic controlled substance
134134 Fentanyl or any synthetic controlled substance Fentanyl
135135 analogue, as described in Sections 20-2-23 and 20-2-25.
136136 (3) More than eight grams, but less than 28 grams, of
137137 3,4-methylenedioxy amphetamine, or of any mixture containing
138138 3,4-methylenedioxy amphetamine.
139139 (4) More than eight grams, but less than 28 grams, of
140140 5-methoxy-3, 4-methylenedioxy amphetamine, or of any mixture
141141 containing 5-methoxy-3, 4-methylenedioxy amphetamine.
142142 (5) More than eight grams, but less than 28 grams, of
143143 amphetamine or any mixture containing amphetamine, its salt,
144144 optical isomer, or salt of its optical isomer thereof.
145145 (6) More than eight grams, but less than 28 grams, of
146146 methamphetamine or any mixture containing methamphetamine, its
147147 salts, optical isomers, or salt of its optical isomers
148148 thereof.
149149 (7) More than one-half gram, but less than one gram, of
150150 any of the following:
151151 a. Fentanyl or any synthetic controlled substance
152152 Fentanyl analogue, as described in Sections 20-2-23 or

192192 Except as authorized in Chapter 2, Title 20:
193193 (1) Any person who knowingly sells, manufactures,
194194 delivers, or brings into this state, or who is knowingly in
195195 actual or constructive possession of, in excess of one kilo or
196196 2.2 pounds of any part of the plant of the genus Cannabis,
197197 whether growing or not, the seeds thereof, the resin extracted
198198 from any part of the plant, and every compound, manufacture,
199199 salt, derivative, mixture, or preparation of the plant, its
200200 seeds, or resin including the completely defoliated mature
201201 stalks of the plant, fiber produced from the stalks, oil, or
202202 cake, or the completely sterilized samples of seeds of the
203203 plant which are incapable of germination is guilty of a
204204 felony, which shall be known as "trafficking in cannabis."
205205 Nothing in this subdivision shall apply to samples of
206206 tetrahydrocannabinols including, but not limited to, all
207207 synthetic or naturally produced samples of
208208 tetrahydrocannabinols which contain more than 15 percent by
209209 weight of tetrahydrocannabinols and which do not contain plant
210210 material exhibiting the external morphological features of the

240240 material exhibiting the external morphological features of the
241241 plant cannabis. If the quantity of cannabis involved:
242242 a. Is in excess of one kilo or 2.2 pounds, but less
243243 than 100 pounds, the person shall be sentenced to a mandatory
244244 minimum term of imprisonment of three calendar years and to
245245 pay a fine of twenty-five thousand dollars ($25,000).
246246 b. Is 100 pounds or more, but less than 500 pounds, the
247247 person shall be sentenced to a mandatory minimum term of
248248 imprisonment of five calendar years and to pay a fine of fifty
249249 thousand dollars ($50,000).
250250 c. Is 500 pounds or more, but less than 1,000 pounds,
251251 the person shall be sentenced to a mandatory minimum term of
252252 imprisonment of 15 calendar years and to pay a fine of two
253253 hundred thousand dollars ($200,000).
254254 d. Is 1,000 pounds or more, the person shall be
255255 sentenced to a mandatory term of imprisonment of life.
256256 (2) Any person who knowingly sells, manufactures,
257257 delivers, or brings into this state, or who is knowingly in
258258 actual or constructive possession of, 28 grams or more of
259259 cocaine or of any mixture containing cocaine, described in
260260 Section 20-2-25(1), is guilty of a felony, which shall be
261261 known as "trafficking in cocaine." If the quantity involved:
262262 a. Is 28 grams or more, but less than 500 grams, the
263263 person shall be sentenced to a mandatory minimum term of
264264 imprisonment of three calendar years and to pay a fine of
265265 fifty thousand dollars ($50,000).
266266 b. Is 500 grams or more, but less than one kilo, the
267267 person shall be sentenced to a mandatory minimum term of
268268 imprisonment of five calendar years and to pay a fine of one

304304 d. Is 10 kilos or more, the person shall be sentenced
305305 to a mandatory term of imprisonment of life.
306306 (3) Any person, except as otherwise authorized by law,
307307 who knowingly sells, manufactures, delivers, or brings into
308308 this state, or who is knowingly in actual or constructive
309309 possession of, four grams or more of any morphine, opium, or
310310 any salt, isomer, or salt of an isomer thereof, including
311311 heroin, as described in Section 20-2-23(b)(2) or Section
312312 20-2-25(1)a., or four grams or more of any mixture containing
313313 any such substance, or any mixture containing Fentanyl or any
314314 synthetic controlled substance Fentanyl analogue, as described
315315 in Sections 20-2-23 and 20-2-25, is guilty of a felony, which
316316 shall be known as "trafficking in illegal drugs." If the
317317 quantity involved:
318318 a. Is four grams or more, but less than 14 grams, the
319319 person shall be sentenced to a mandatory minimum term of
320320 imprisonment of three calendar years and to pay a fine of
321321 fifty thousand dollars ($50,000).
322322 b. Is 14 grams or more, but less than 28 grams, the
323323 person shall be sentenced to a mandatory minimum term of
324324 imprisonment of 10 calendar years and to pay a fine of one
325325 hundred thousand dollars ($100,000).
326326 c. Is 28 grams or more, but less than 56 grams, the

356356 c. Is 28 grams or more, but less than 56 grams, the
357357 person shall be sentenced to a mandatory minimum term of
358358 imprisonment of 25 calendar years and to pay a fine of five
359359 hundred thousand dollars ($500,000).
360360 d. Is 56 grams or more, the person shall be sentenced
361361 to a mandatory term of imprisonment of life.
362362 (4) Any person who knowingly sells, manufactures,
363363 delivers, or brings into this state, or who is knowingly in
364364 actual or constructive possession of 1,000 or more pills or
365365 capsules of methaqualone, as described in Section 20-2-1, et
366366 seq., is guilty of a felony, which shall be known as
367367 "trafficking in illegal drugs." If the quantity involved:
368368 a. Is 1,000 pills or capsules, but less than 5,000
369369 pills or capsules, the person shall be sentenced to a
370370 mandatory minimum term of imprisonment of three calendar years
371371 and pay a fine of fifty thousand dollars ($50,000).
372372 b. Is 5,000 capsules or more, but less than 25,000
373373 capsules, the person shall be imprisoned to a mandatory
374374 minimum term of imprisonment of 10 calendar years and pay a
375375 fine of one hundred thousand dollars ($100,000).
376376 c. Is 25,000 pills or more, but less than 100,000 pills
377377 or capsules, the person shall be sentenced to a mandatory
378378 minimum term of imprisonment of 25 calendar years and pay a
379379 fine of five hundred thousand dollars ($500,000).
380380 d. Is 100,000 capsules or more, the person shall be
381381 sentenced to a mandatory term of imprisonment of life.
382382 (5) Any person who knowingly sells, manufactures,
383383 delivers, or brings into this state, or who is knowingly in
384384 actual or constructive possession of 500 or more pills or

415415 capsules of hydromorphone, as is described in Section 20-2-1,
416416 et seq., is guilty of a felony, which shall be known as
417417 "trafficking in illegal drugs." If the quantity involved:
418418 a. Is 500 pills or capsules or more but less than 1,000
419419 pills or capsules, the person shall be sentenced to a
420420 mandatory term of imprisonment of three calendar years and to
421421 pay a fine of fifty thousand dollars ($50,000).
422422 b. Is 1,000 pills or capsules or more, but less than
423423 4,000 pills or capsules, the person shall be sentenced to a
424424 mandatory term of imprisonment of 10 calendar years and to pay
425425 a fine of one hundred thousand dollars ($100,000).
426426 c. Is 4,000 pills or capsules or more but less than
427427 10,000 pills or capsules, the person shall be sentenced to a
428428 mandatory term of imprisonment of 25 calendar years and to pay
429429 a fine of one hundred thousand dollars ($100,000).
430430 d. Is more than 10,000 pills or capsules, the person
431431 shall be sentenced to a mandatory term of life.
432432 (6) Any person who knowingly sells, manufactures,
433433 delivers, or brings into this state, or who is knowingly in
434434 actual or constructive possession of, 28 grams or more of
435435 3,4-methylenedioxy amphetamine, or of any mixture containing
436436 3,4-methylenedioxy amphetamine, is guilty of a felony, which
437437 shall be known as "trafficking in illegal drugs." If the
438438 quantity involved:
439439 a. Is 28 grams or more, but less than 500 grams, the
440440 person shall be sentenced to a mandatory minimum term of
441441 imprisonment of three calendar years and to pay a fine of
442442 fifty thousand dollars ($50,000).

489489 drugs." If the quantity involved:
490490 a. Is 28 grams or more, but less than 500 grams, the
491491 person shall be sentenced to a mandatory minimum term of
492492 imprisonment of three calendar years and to pay a fine of
493493 fifty thousand dollars ($50,000).
494494 b. Is 500 grams or more, but less than one kilo, the
495495 person shall be sentenced to a mandatory minimum term of

539539 illegal drugs." If the quantity involved:
540540 a. Is four grams or more, but less than 14 grams, the
541541 person shall be sentenced to a mandatory minimum term of
542542 imprisonment of three calendar years and to pay a fine of
543543 fifty thousand dollars ($50,000).
544544 b. Is 14 grams or more, but less than 28 grams, the
545545 person shall be sentenced to a mandatory minimum term of
546546 imprisonment of five calendar years and to pay a fine of one
547547 hundred thousand dollars ($100,000).
548548 c. Is 28 grams or more, but less than 56 grams, the
549549 person shall be sentenced to a mandatory minimum term of
550550 imprisonment of 15 calendar years and to pay a fine of two

552552 d. Is 56 grams or more, the person shall be sentenced

554554 (9) Any person who knowingly sells, manufactures,

557557 lysergic acid diethylamide, or four grams or more of any

608608 amphetamine or any mixture containing amphetamine, its salt,
609609 optical isomer, or salt of its optical isomer thereof, is
610610 guilty of a felony, which shall be known as "trafficking in
611611 amphetamine." If the quantity involved:
612612 a. Is 28 grams or more but less than 500 grams, the
613613 person shall be sentenced to a mandatory minimum term of
614614 imprisonment of three calendar years and to pay a fine of
615615 fifty thousand dollars ($50,000).

659659 methamphetamine or any mixture containing methamphetamine, its
660660 salts, optical isomers, or salt of its optical isomers
661661 thereof, is guilty of a felony, which shall be known as
662662 "trafficking in methamphetamine." If the quantity involved:
663663 a. Is 28 grams or more but less than 500 grams, the
664664 person shall be sentenced to a mandatory minimum term of
665665 imprisonment of three calendar years and to pay a fine of
666666 fifty thousand dollars ($50,000).
667667 b. Is 500 grams or more, but less than one kilo, the
668668 person shall be sentenced to a mandatory minimum term of
669669 imprisonment of five calendar years and to pay a fine of one
670670 hundred thousand dollars ($100,000).
671671 c. Is one kilo but less than 10 kilos, the person shall

710710 synthetic controlled substance or a synthetic controlled
711711 substance analogue, as described in Section 20-2-23(a)(4) or
712712 (5), except for any synthetic controlled substance Fentanyl
713713 analogue referenced in subdivision (13), is guilty of a
714714 felony, which shall be known as "trafficking in synthetic

720720 b. Is 500 grams or more, but less than 1 kilo, the
721721 person shall be sentenced to a mandatory minimum term of
722722 imprisonment of 10 calendar years and to pay a fine of one
723723 hundred thousand dollars ($100,000).
724724 c. Is one kilo, but less than 10 kilos, the person
725725 shall be sentenced to a mandatory minimum term of imprisonment
726726 of 15 calendar years and to pay a fine of two hundred fifty

763763 possession of, one gram or more of either: (i) Fentanyl or any
764764 synthetic controlled substance Fentanyl analogue, as described
765765 in Sections 20-2-23 or 20-2-25, as a single component as
766766 described in Sections 20-2-23 and 20-2-25, ; (ii) any mixture
767767 of Fentanyl and any synthetic controlled substance Fentanyl
768768 analogue; or (iii) any mixture of Fentanyl or any synthetic
769769 controlled substance Fentanyl analogue and the immediate
770770 Fentanyl precursor, 4-anilino-N-phenenthyl-4-piperidine
771771 (ANPP); is guilty of a felony, which shall be known as
772772 "trafficking in illegal drugs." If the quantity involved:
773773 a.1. Is one gram or more, but less than two grams, the
774774 person shall be sentenced to a mandatory minimum term of
775775 imprisonment of three calendar years and to pay a minimum fine
776776 of fifty thousand dollars ($50,000).
777777 2. Is two grams or more, but less than four grams, the
778778 person shall be sentenced to a mandatory minimum term of
779779 imprisonment of 10 calendar years and to pay a minimum fine of
780780 one hundred thousand dollars ($100,000).
781781 3. Is four grams or more, but less than eight grams,
782782 the person shall be sentenced to a mandatory minimum term of
783783 imprisonment of 25 calendar years and to pay a minimum fine of
784784 five hundred thousand dollars ($500,000).
785785 4. Is eight grams or more, the person shall be
786786 sentenced to a mandatory term of imprisonment of life and to
787787 pay a minimum fine of seven hundred fifty thousand dollars

789789 b.1. Notwithstanding any provision of law, in addition

820820 to any penalties provided by law, upon a second conviction of
821821 this subdivision, the person shall be sentenced to an
822822 additional term of imprisonment of five calendar years, which
823823 is not subject to suspension or probation.
824824 2. Upon a third or subsequent conviction of this
825825 subdivision, in addition to any penalties provided by law, the
826826 person shall be sentenced to an additional term of
827827 imprisonment of 10 calendar years, which is not subject to
828828 suspension or probation.
829829 (14) In lieu of the weight ranges listed in subdivision
830830 (12), a person may instead be charged with trafficking any
831831 substance listed in subdivisions (3) and (12) if that person
832832 possesses 50 or more individual packages of that substance.
833833 The person shall only be sentenced according to the sentence
834834 range provision listed in paragraph a. of each subdivision for
835835 the specific substance contained in the 50 or more individual
836836 packages if charged pursuant to this subdivision, subdivision
837837 (15), or subdivision (16), if applicable. In order to charge a
838838 person pursuant to this subdivision, the same substance must
839839 be contained in each of the 50 or more individual packages.
840840 (15) The felonies of "trafficking in cannabis,"
841841 "trafficking in cocaine," "trafficking in illegal drugs,"
842842 "trafficking in amphetamine," "trafficking in
843843 methamphetamine," and "trafficking in synthetic controlled
844844 substances" as defined in subdivisions (1) through (14) shall
845845 be treated as Class A felonies for purposes of this title,
846846 including sentencing under Section 13A-5-9. Provided, however,
847847 that the sentence of imprisonment for a defendant with one or
848848 more prior felony convictions who violates subdivisions (1)

879879 through (14) shall be the sentence provided therein, or the
880880 sentence provided under Section 13A-5-9, whichever is greater.
881881 Provided further, that the fine for a defendant with one or
882882 more prior felony convictions who violates subdivisions (1)
883883 through (14) shall be the fine provided therein, or the fine
884884 provided under Section 13A-5-9, whichever is greater.
885885 (16) Notwithstanding any provision of law to the
886886 contrary, any person who has possession of a firearm during
887887 the commission of any act proscribed by this section shall be
888888 punished by a term of imprisonment of five calendar years,
889889 which shall be in addition to, and not in lieu of, the
890890 punishment otherwise provided, and a fine of twenty-five
891891 thousand dollars ($25,000). The court shall not suspend the
892892 five-year additional sentence of the person or give the person
893893 a probationary sentence."
894894 Section 2. This act shall become effective on October
895895 1, 2025.
