16	16	Under existing law, a person commits the crime
17	17	of unlawful possession with intent to distribute a
18	18	controlled substance if he or she knowingly possesses
19	19	more than two grams, but less than four grams, of any
20	20	mixture containing Fentanyl, any synthetic controlled
21	21	substance Fentanyl, or any synthetic controlled
22	22	substance Fentanyl analogue.
23	23	This bill would provide that a person commits
24	24	the crime of unlawful possession with intent to
25	25	distribute a controlled substance if he or she
26	26	knowingly possesses more than one-half gram, but less
27	27	than one gram, of any mixture of Fentanyl and any
28	28	synthetic controlled substance Fentanyl analogue, or
29	29	any mixture of Fentanyl or any synthetic controlled
30	30	substance Fentanyl analogue and the immediate Fentanyl
31	31	precursor, 4-anilino-N-phenethyl-4-piperidine (ANPP).
32	32	Under existing law, a person commits the crime
33	33	of trafficking in illegal drugs if he or she is
34	34	knowingly in actual or constructive possession of one
35	35	gram or more of Fentanyl or any synthetic controlled
36	36	substance Fentanyl analogue as a single component.
37	37	This bill would provide that a person commits
38	38	the crime of trafficking in illegal drugs if he or she
39	39	is knowingly in actual or constructive possession of

80	80	provide for the crime of unlawful possession with intent to

82	82	the crime of trafficking in illegal drugs.
83	83	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
84	84	Section 1. Sections 13A-12-211 and 13A-12-231, Code of
85	85	Alabama 1975, are amended to read as follows:
86	86	"§13A-12-211
87	87	(a) A person commits the crime of unlawful distribution
88	88	of controlled substances if, except as otherwise authorized,
89	89	he or she sells, furnishes, gives away, delivers, or
90	90	distributes a controlled substance enumerated in Schedules I
91	91	through V.
92	92	(b) Unlawful distribution of controlled substances is a
93	93	Class B felony.
94	94	(c) A person commits the crime of unlawful possession

124	124	(c) A person commits the crime of unlawful possession
125	125	with intent to distribute a controlled substance if, except as
126	126	otherwise authorized by law, he or she knowingly possesses any
127	127	of the following quantities of a controlled substance:
128	128	(1) More than eight grams, but less than 28 grams, of
129	129	cocaine or of any mixture containing cocaine.
130	130	(2) More than two grams, but less than four grams, of
131	131	any mixture of morphine, opium, or any salt, isomer, or salt
132	132	of an isomer thereof, including heroin or any mixture
133	133	containing Fentanyl or any synthetic controlled substance
134	134	Fentanyl or any synthetic controlled substance Fentanyl
135	135	analogue, as described in Sections 20-2-23 and 20-2-25.
136	136	(3) More than eight grams, but less than 28 grams, of
137	137	3,4-methylenedioxy amphetamine, or of any mixture containing
138	138	3,4-methylenedioxy amphetamine.
139	139	(4) More than eight grams, but less than 28 grams, of
140	140	5-methoxy-3, 4-methylenedioxy amphetamine, or of any mixture
141	141	containing 5-methoxy-3, 4-methylenedioxy amphetamine.
142	142	(5) More than eight grams, but less than 28 grams, of
143	143	amphetamine or any mixture containing amphetamine, its salt,
144	144	optical isomer, or salt of its optical isomer thereof.
145	145	(6) More than eight grams, but less than 28 grams, of
146	146	methamphetamine or any mixture containing methamphetamine, its
147	147	salts, optical isomers, or salt of its optical isomers
148	148	thereof.
149	149	(7) More than one-half gram, but less than one gram, of
150	150	any of the following:
151	151	a. Fentanyl or any synthetic controlled substance
152	152	Fentanyl analogue, as described in Sections 20-2-23 or

190	190	controlled substance is a Class B felony."

192	192	Except as authorized in Chapter 2, Title 20:
193	193	(1) Any person who knowingly sells, manufactures,
194	194	delivers, or brings into this state, or who is knowingly in
195	195	actual or constructive possession of, in excess of one kilo or
196	196	2.2 pounds of any part of the plant of the genus Cannabis,
197	197	whether growing or not, the seeds thereof, the resin extracted
198	198	from any part of the plant, and every compound, manufacture,
199	199	salt, derivative, mixture, or preparation of the plant, its
200	200	seeds, or resin including the completely defoliated mature
201	201	stalks of the plant, fiber produced from the stalks, oil, or
202	202	cake, or the completely sterilized samples of seeds of the
203	203	plant which are incapable of germination is guilty of a
204	204	felony, which shall be known as "trafficking in cannabis."
205	205	Nothing in this subdivision shall apply to samples of
206	206	tetrahydrocannabinols including, but not limited to, all
207	207	synthetic or naturally produced samples of
208	208	tetrahydrocannabinols which contain more than 15 percent by
209	209	weight of tetrahydrocannabinols and which do not contain plant
210	210	material exhibiting the external morphological features of the

241	241	plant cannabis. If the quantity of cannabis involved:
242	242	a. Is in excess of one kilo or 2.2 pounds, but less
243	243	than 100 pounds, the person shall be sentenced to a mandatory
244	244	minimum term of imprisonment of three calendar years and to
245	245	pay a fine of twenty-five thousand dollars ($25,000).
246	246	b. Is 100 pounds or more, but less than 500 pounds, the
247	247	person shall be sentenced to a mandatory minimum term of
248	248	imprisonment of five calendar years and to pay a fine of fifty
249	249	thousand dollars ($50,000).
250	250	c. Is 500 pounds or more, but less than 1,000 pounds,
251	251	the person shall be sentenced to a mandatory minimum term of
252	252	imprisonment of 15 calendar years and to pay a fine of two
253	253	hundred thousand dollars ($200,000).
254	254	d. Is 1,000 pounds or more, the person shall be
255	255	sentenced to a mandatory term of imprisonment of life.
256	256	(2) Any person who knowingly sells, manufactures,
257	257	delivers, or brings into this state, or who is knowingly in
258	258	actual or constructive possession of, 28 grams or more of
259	259	cocaine or of any mixture containing cocaine, described in
260	260	Section 20-2-25(1), is guilty of a felony, which shall be
261	261	known as "trafficking in cocaine." If the quantity involved:
262	262	a. Is 28 grams or more, but less than 500 grams, the
263	263	person shall be sentenced to a mandatory minimum term of
264	264	imprisonment of three calendar years and to pay a fine of
265	265	fifty thousand dollars ($50,000).
266	266	b. Is 500 grams or more, but less than one kilo, the
267	267	person shall be sentenced to a mandatory minimum term of
268	268	imprisonment of five calendar years and to pay a fine of one

300	300	c. Is one kilo, but less than 10 kilos, the person
301	301	shall be sentenced to a mandatory minimum term of imprisonment

304	304	d. Is 10 kilos or more, the person shall be sentenced
305	305	to a mandatory term of imprisonment of life.
306	306	(3) Any person, except as otherwise authorized by law,
307	307	who knowingly sells, manufactures, delivers, or brings into
308	308	this state, or who is knowingly in actual or constructive
309	309	possession of, four grams or more of any morphine, opium, or
310	310	any salt, isomer, or salt of an isomer thereof, including
311	311	heroin, as described in Section 20-2-23(b)(2) or Section
312	312	20-2-25(1)a., or four grams or more of any mixture containing
313	313	any such substance, or any mixture containing Fentanyl or any
314	314	synthetic controlled substance Fentanyl analogue, as described
315	315	in Sections 20-2-23 and 20-2-25, is guilty of a felony, which
316	316	shall be known as "trafficking in illegal drugs." If the
317	317	quantity involved:
318	318	a. Is four grams or more, but less than 14 grams, the
319	319	person shall be sentenced to a mandatory minimum term of
320	320	imprisonment of three calendar years and to pay a fine of
321	321	fifty thousand dollars ($50,000).
322	322	b. Is 14 grams or more, but less than 28 grams, the
323	323	person shall be sentenced to a mandatory minimum term of
324	324	imprisonment of 10 calendar years and to pay a fine of one
325	325	hundred thousand dollars ($100,000).

357	357	person shall be sentenced to a mandatory minimum term of
358	358	imprisonment of 25 calendar years and to pay a fine of five
359	359	hundred thousand dollars ($500,000).
360	360	d. Is 56 grams or more, the person shall be sentenced
361	361	to a mandatory term of imprisonment of life.
362	362	(4) Any person who knowingly sells, manufactures,
363	363	delivers, or brings into this state, or who is knowingly in
364	364	actual or constructive possession of 1,000 or more pills or
365	365	capsules of methaqualone, as described in Section 20-2-1, et
366	366	seq., is guilty of a felony, which shall be known as
367	367	"trafficking in illegal drugs." If the quantity involved:
368	368	a. Is 1,000 pills or capsules, but less than 5,000
369	369	pills or capsules, the person shall be sentenced to a
370	370	mandatory minimum term of imprisonment of three calendar years
371	371	and pay a fine of fifty thousand dollars ($50,000).
372	372	b. Is 5,000 capsules or more, but less than 25,000
373	373	capsules, the person shall be imprisoned to a mandatory
374	374	minimum term of imprisonment of 10 calendar years and pay a
375	375	fine of one hundred thousand dollars ($100,000).
376	376	c. Is 25,000 pills or more, but less than 100,000 pills
377	377	or capsules, the person shall be sentenced to a mandatory
378	378	minimum term of imprisonment of 25 calendar years and pay a
379	379	fine of five hundred thousand dollars ($500,000).
380	380	d. Is 100,000 capsules or more, the person shall be
381	381	sentenced to a mandatory term of imprisonment of life.
382	382	(5) Any person who knowingly sells, manufactures,
383	383	delivers, or brings into this state, or who is knowingly in
384	384	actual or constructive possession of 500 or more pills or

415	415	capsules of hydromorphone, as is described in Section 20-2-1,
416	416	et seq., is guilty of a felony, which shall be known as
417	417	"trafficking in illegal drugs." If the quantity involved:
418	418	a. Is 500 pills or capsules or more but less than 1,000
419	419	pills or capsules, the person shall be sentenced to a
420	420	mandatory term of imprisonment of three calendar years and to
421	421	pay a fine of fifty thousand dollars ($50,000).
422	422	b. Is 1,000 pills or capsules or more, but less than
423	423	4,000 pills or capsules, the person shall be sentenced to a
424	424	mandatory term of imprisonment of 10 calendar years and to pay
425	425	a fine of one hundred thousand dollars ($100,000).
426	426	c. Is 4,000 pills or capsules or more but less than
427	427	10,000 pills or capsules, the person shall be sentenced to a
428	428	mandatory term of imprisonment of 25 calendar years and to pay
429	429	a fine of one hundred thousand dollars ($100,000).
430	430	d. Is more than 10,000 pills or capsules, the person
431	431	shall be sentenced to a mandatory term of life.
432	432	(6) Any person who knowingly sells, manufactures,
433	433	delivers, or brings into this state, or who is knowingly in
434	434	actual or constructive possession of, 28 grams or more of
435	435	3,4-methylenedioxy amphetamine, or of any mixture containing
436	436	3,4-methylenedioxy amphetamine, is guilty of a felony, which
437	437	shall be known as "trafficking in illegal drugs." If the
438	438	quantity involved:
439	439	a. Is 28 grams or more, but less than 500 grams, the
440	440	person shall be sentenced to a mandatory minimum term of
441	441	imprisonment of three calendar years and to pay a fine of

540	540	a. Is four grams or more, but less than 14 grams, the
541	541	person shall be sentenced to a mandatory minimum term of
542	542	imprisonment of three calendar years and to pay a fine of
543	543	fifty thousand dollars ($50,000).
544	544	b. Is 14 grams or more, but less than 28 grams, the
545	545	person shall be sentenced to a mandatory minimum term of
546	546	imprisonment of five calendar years and to pay a fine of one
547	547	hundred thousand dollars ($100,000).

770	770	Fentanyl precursor, 4-anilino-N-phenenthyl-4-piperidine
771	771	(ANPP); is guilty of a felony, which shall be known as
772	772	"trafficking in illegal drugs." If the quantity involved:
773	773	a.1. Is one gram or more, but less than two grams, the
774	774	person shall be sentenced to a mandatory minimum term of
775	775	imprisonment of three calendar years and to pay a minimum fine
776	776	of fifty thousand dollars ($50,000).
777	777	2. Is two grams or more, but less than four grams, the
778	778	person shall be sentenced to a mandatory minimum term of
779	779	imprisonment of 10 calendar years and to pay a minimum fine of
780	780	one hundred thousand dollars ($100,000).
781	781	3. Is four grams or more, but less than eight grams,
782	782	the person shall be sentenced to a mandatory minimum term of
783	783	imprisonment of 25 calendar years and to pay a minimum fine of

820	820	to any penalties provided by law, upon a second conviction of
821	821	this subdivision, the person shall be sentenced to an
822	822	additional term of imprisonment of five calendar years, which
823	823	is not subject to suspension or probation.
824	824	2. Upon a third or subsequent conviction of this
825	825	subdivision, in addition to any penalties provided by law, the
826	826	person shall be sentenced to an additional term of
827	827	imprisonment of 10 calendar years, which is not subject to
828	828	suspension or probation.
829	829	(14) In lieu of the weight ranges listed in subdivision
830	830	(12), a person may instead be charged with trafficking any
831	831	substance listed in subdivisions (3) and (12) if that person
832	832	possesses 50 or more individual packages of that substance.
833	833	The person shall only be sentenced according to the sentence
834	834	range provision listed in paragraph a. of each subdivision for
835	835	the specific substance contained in the 50 or more individual
836	836	packages if charged pursuant to this subdivision, subdivision
837	837	(15), or subdivision (16), if applicable. In order to charge a
838	838	person pursuant to this subdivision, the same substance must
839	839	be contained in each of the 50 or more individual packages.
840	840	(15) The felonies of "trafficking in cannabis,"
841	841	"trafficking in cocaine," "trafficking in illegal drugs,"
842	842	"trafficking in amphetamine," "trafficking in
843	843	methamphetamine," and "trafficking in synthetic controlled
844	844	substances" as defined in subdivisions (1) through (14) shall
845	845	be treated as Class A felonies for purposes of this title,
846	846	including sentencing under Section 13A-5-9. Provided, however,
847	847	that the sentence of imprisonment for a defendant with one or
848	848	more prior felony convictions who violates subdivisions (1)

885	885	(16) Notwithstanding any provision of law to the
886	886	contrary, any person who has possession of a firearm during
887	887	the commission of any act proscribed by this section shall be
888	888	punished by a term of imprisonment of five calendar years,
889	889	which shall be in addition to, and not in lieu of, the
890	890	punishment otherwise provided, and a fine of twenty-five
891	891	thousand dollars ($25,000). The court shall not suspend the
892	892	five-year additional sentence of the person or give the person
893	893	a probationary sentence."
