1515 SYNOPSIS:
1616 Under existing law, an individual seeking
1717 compensation from the Alabama Crime Victims
1818 Compensation Commission must file a claim within one
1919 year of the injury or death upon which the claim is
2020 based.
2121 This bill would provide that an individual
2222 seeking compensation from the Alabama Crime Victims
2323 Compensation Commission may file a claim within two
2424 years of the injury or death upon which the claim is
2525 based.

2929 Relating to the Alabama Crime Victims Compensation
3030 Commission; to amend Section 15-23-12, Code of Alabama 1975,
3131 to further provide for the filing of claims.
3232 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3333 Section 1. Section 15-23-12, Code of Alabama 1975, is
3434 amended to read as follows:

3636 (a) Compensation shall not be awarded in any of the

6666 (a) Compensation shall not be awarded in any of the
6767 following circumstances:
6868 (1) A claim has been filed with the commission later
6969 than one year two years after the injury or death upon which
7070 the claim is based, unless the commission finds there was good
7171 cause for the failure to file within that time.
7272 (2) To a claimant who was the offender, or an
7373 accomplice of the offender, or who encouraged or in any way
7474 participated in the criminally injurious conduct.
7575 (3) If the award would unjustly benefit the offender or
7676 accomplice of the offender.
7777 (4) The criminally injurious conduct resulting in
7878 injury or death was reported to a law enforcement officer
7979 later than 72 hours after its occurrence, unless the
8080 commission finds there was good cause for the failure to
8181 report within that time.
8282 (b) Compensation otherwise payable to a claimant may be
8383 diminished or denied to the extent that the economic loss is
8484 recouped from collateral sources ;, or to the extent that the
8585 degree of responsibility for the cause of the injury or death
8686 is attributable to the victim as determined by the commission.
8787 (c) The commission, upon finding that the claimant or
8888 victim has not fully cooperated with appropriate law
8989 enforcement agencies, may deny, withdraw, or reduce an award
9090 of compensation.
9191 (d) The commission, on its own motion or on request of
9292 the claimant, may reconsider a decision granting or denying an
9393 award or determining its an award amount. An order on
9494 reconsideration of an award shall not require a refund of

124124 reconsideration of an award shall not require a refund of
125125 amounts previously paid, unless the award was obtained by
126126 fraud. The right of reconsideration does not affect the
127127 finality of a commission decision for the purpose of judicial
128128 review."
129129 Section 2. This act shall become effective on October
130130 1, 2025.
