1515 SYNOPSIS:
1616 Under existing law, commissions consisting of
1717 associations of producers of a specific agriculture
1818 commodity may be certified by the Alabama Department of
1919 Agriculture and Industries to conduct a referendum on
2020 levying an assessment to promote the respective
2121 commodity that members of the association produce.
2222 This bill would increase the levy that may be
2323 assessed on the sale of a cotton bale.
2424 This bill would also make nonsubstantive,
2525 technical revisions to update the existing code
2626 language to current style.

2929 AN ACT
3030 Relating to agriculture; to amend Section 2-8-199, Code
3131 of Alabama 1975, to increase the levy that may be assessed on
3232 the sale of cotton bales; and to make nonsubstantive,
3333 technical revisions to update the existing code language to
3434 current style.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

6666 Section 1. Section 2-8-199, Code of Alabama 1975, is
6767 amended to read as follows:
6868 "ยง2-8-199
6969 (a) If in the referendum a majority or more of the
7070 cotton producers who are eligible to participate and who
7171 actually vote therein, shall vote in the affirmative and in
7272 favor of the levying and collection of collecting the
7373 assessment proposed in the referendum, then the assessment
7474 shall be levied on a per bale basis and collected in the
7575 manner hereinafter provided.
7676 (b) All cotton producers who produced cotton in the
7777 crop year immediately preceding the referendum shall be
7878 eligible to may participate in the referendum. Following the
7979 referendum and within 30 days thereafter, the certified
8080 commission shall canvass, tabulate, and publicly declare and
8181 announce the results thereof.
8282 (c) The assessment levied upon the sale of cotton shall
8383 may not exceed one dollar and thirty cents ($1) ($1.30) per
8484 bale. The commission shall determine the assessment amount on
8585 an annual basis."
8686 Section 2. This act shall become effective on October
8787 1, 2025.
