15	15	SYNOPSIS:
16	16	Under existing law, commissions consisting of
17	17	associations of producers of a specific agriculture
18	18	commodity may be certified by the Alabama Department of
19	19	Agriculture and Industries to conduct a referendum on
20	20	levying an assessment to promote the respective
21	21	commodity that members of the association produce.
22	22	This bill would increase the levy that may be
23	23	assessed on the sale of a cotton bale.
24	24	This bill would also make nonsubstantive,
25	25	technical revisions to update the existing code
26	26	language to current style.

29	29	AN ACT
30	30	Relating to agriculture; to amend Section 2-8-199, Code
31	31	of Alabama 1975, to increase the levy that may be assessed on
32	32	the sale of cotton bales; and to make nonsubstantive,
33	33	technical revisions to update the existing code language to
34	34	current style.
35	35	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

66	66	Section 1. Section 2-8-199, Code of Alabama 1975, is
67	67	amended to read as follows:
68	68	"§2-8-199
69	69	(a) If in the referendum a majority or more of the
70	70	cotton producers who are eligible to participate and who
71	71	actually vote therein, shall vote in the affirmative and in
72	72	favor of the levying and collection of collecting the
73	73	assessment proposed in the referendum, then the assessment
74	74	shall be levied on a per bale basis and collected in the
75	75	manner hereinafter provided.
76	76	(b) All cotton producers who produced cotton in the
77	77	crop year immediately preceding the referendum shall be
78	78	eligible to may participate in the referendum. Following the
79	79	referendum and within 30 days thereafter, the certified
80	80	commission shall canvass, tabulate, and publicly declare and
81	81	announce the results thereof.
82	82	(c) The assessment levied upon the sale of cotton shall
83	83	may not exceed one dollar and thirty cents ($1) ($1.30) per
84	84	bale. The commission shall determine the assessment amount on
85	85	an annual basis."
86	86	Section 2. This act shall become effective on October
87	87	1, 2025.
