16	16	This bill would propose an amendment to the
17	17	Constitution of Alabama of 2022, to authorize the
18	18	members of the governing body of the City of Montgomery
19	19	to participate in the Employees' Retirement System of
20	20	Alabama.
21	21	A BILL
22	22	TO BE ENTITLED
23	23	AN ACT
24	24	Proposing an amendment to the Constitution of Alabama
25	25	of 2022, relating to the City of Montgomery, to allow the city
26	26	council to participate in the Employees' Retirement System of
27	27	Alabama.
28	28	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
29	29	Section 1. The following amendment to the Constitution
30	30	of Alabama of 2022, is proposed:
31	31	PROPOSED AMENDMENT
32	32	The elected or appointed members of the governing body
33	33	of the City of Montgomery may participate in the Employees'
34	34	Retirement System of Alabama upon the same terms and
35	35	conditions as may be specified by law for any other employee
36	36	in the same retirement system and shall be treated as

66	66	in the same retirement system and shall be treated as
67	67	employees of the city. A member holding office at the time of
68	68	the ratification of this amendment may purchase service credit
69	69	in the Employees' Retirement System of Alabama for the time
70	70	the official has served as a member. No individual may
71	71	participate in both a supernumerary program and the Employees'
72	72	Retirement System of Alabama.
73	73	Upon ratification of this constitutional amendment, the
74	74	Code Commissioner shall number and place this amendment as
75	75	appropriate in the constitution omitting this instructional
76	76	paragraph and may make the following nonsubstantive revisions:
77	77	change capitalization, hierarchy, spelling, and punctuation
78	78	for purposes of style and uniformity; correct manifest
79	79	grammatical, clerical, and typographical errors; revise
80	80	internal or external citations and cross-references; harmonize
81	81	language; and translate effective dates.
82	82	END PROPOSED AMENDMENT
83	83	Section 2. An election upon the proposed amendment
84	84	shall be held in accordance with Sections 284, 284.01, and 285
85	85	of the Constitution of Alabama of 2022, and the election laws
86	86	of this state. The appropriate election official shall assign
87	87	a ballot number for the proposed constitutional amendment on
88	88	the election ballot and shall set forth the following
89	89	description of the substance or subject matter of the proposed
90	90	constitutional amendment:
91	91	"Proposing an amendment to the Constitution of Alabama
92	92	of 2022, relating to Montgomery County, to authorize the
93	93	members of the Montgomery City Council to participate in the
94	94	Employees' Retirement System of Alabama.
