1515 SYNOPSIS:
1616 This bill would propose an amendment to the
1717 Constitution of Alabama of 2022, to authorize the
1818 members of the governing body of the City of Montgomery
1919 to participate in the Employees' Retirement System of
2020 Alabama.

2424 Proposing an amendment to the Constitution of Alabama
2525 of 2022, relating to the City of Montgomery, to allow the city
2626 council to participate in the Employees' Retirement System of
2727 Alabama.
2828 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2929 Section 1. The following amendment to the Constitution
3030 of Alabama of 2022, is proposed:
3131 PROPOSED AMENDMENT
3232 The elected or appointed members of the governing body
3333 of the City of Montgomery may participate in the Employees'
3434 Retirement System of Alabama upon the same terms and
3535 conditions as may be specified by law for any other employee
3636 in the same retirement system and shall be treated as

6666 in the same retirement system and shall be treated as
6767 employees of the city. A member holding office at the time of
6868 the ratification of this amendment may purchase service credit
6969 in the Employees' Retirement System of Alabama for the time
7070 the official has served as a member. No individual may
7171 participate in both a supernumerary program and the Employees'
7272 Retirement System of Alabama.
7373 Upon ratification of this constitutional amendment, the
7474 Code Commissioner shall number and place this amendment as
7575 appropriate in the constitution omitting this instructional
7676 paragraph and may make the following nonsubstantive revisions:
7777 change capitalization, hierarchy, spelling, and punctuation
7878 for purposes of style and uniformity; correct manifest
7979 grammatical, clerical, and typographical errors; revise
8080 internal or external citations and cross-references; harmonize
8181 language; and translate effective dates.
8282 END PROPOSED AMENDMENT
8383 Section 2. An election upon the proposed amendment
8484 shall be held in accordance with Sections 284, 284.01, and 285
8585 of the Constitution of Alabama of 2022, and the election laws
8686 of this state. The appropriate election official shall assign
8787 a ballot number for the proposed constitutional amendment on
8888 the election ballot and shall set forth the following
8989 description of the substance or subject matter of the proposed
9090 constitutional amendment:
9191 "Proposing an amendment to the Constitution of Alabama
9292 of 2022, relating to Montgomery County, to authorize the
9393 members of the Montgomery City Council to participate in the
9494 Employees' Retirement System of Alabama.
