|---|
| 16 | 16 | | This bill would establish the crime of failure |

| 17 | 17 | | to render aid, which would be committed if, while |
|---|
| 18 | 18 | | engaged in the illegal use of a controlled substance |
|---|
| 19 | 19 | | with another: (i) a person knowingly fails to seek |
|---|
| 20 | 20 | | medical assistance for another individual suffering |
|---|
| 21 | 21 | | from an overdose of the controlled substance or |
|---|
| 22 | 22 | | suffering a significant adverse physical reaction to |
|---|
| 23 | 23 | | the controlled substance; and (ii) the overdose or |
|---|
| 24 | 24 | | adverse physical reaction proximately causes the death |
|---|
| 25 | 25 | | of the other individual. |

| 29 | 29 | | Relating to crimes and offenses; to establish the crime |

| 30 | 30 | | of failure to render aid; and to provide for a criminal |

| 32 | 32 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

| 33 | 33 | | Section 1. (a) A person commits the crime of failure to |
|---|
| 34 | 34 | | render aid if, while engaged in the unlawful use of a |
|---|
| 35 | 35 | | controlled substance enumerated in Schedules I through V with |
|---|
| 36 | 36 | | another individual, all of the following occur: |
|---|

| 73 | 73 | | proximately causes the death of the other individual. |

| 74 | 74 | | (b) Failure to render aid is a Class C felony. |

| 75 | 75 | | Section 2. This act shall become effective on October |
