1515 SYNOPSIS:
1616 This bill would establish the crime of failure
1717 to render aid, which would be committed if, while
1818 engaged in the illegal use of a controlled substance
1919 with another: (i) a person knowingly fails to seek
2020 medical assistance for another individual suffering
2121 from an overdose of the controlled substance or
2222 suffering a significant adverse physical reaction to
2323 the controlled substance; and (ii) the overdose or
2424 adverse physical reaction proximately causes the death
2525 of the other individual.

2929 Relating to crimes and offenses; to establish the crime
3030 of failure to render aid; and to provide for a criminal
3131 penalty for a violation.
3232 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3333 Section 1. (a) A person commits the crime of failure to
3434 render aid if, while engaged in the unlawful use of a
3535 controlled substance enumerated in Schedules I through V with
3636 another individual, all of the following occur:

6666 another individual, all of the following occur:
6767 (1) The other individual suffers an overdose of the
6868 controlled substance or suffers a significant adverse physical
6969 reaction to the controlled substance.
7070 (2) The person knowingly fails to seek medical
7171 assistance for the other individual.
7272 (3) The overdose or adverse physical reaction
7373 proximately causes the death of the other individual.
7474 (b) Failure to render aid is a Class C felony.
7575 Section 2. This act shall become effective on October
7676 1, 2025.
